RE: FORT RAM VILLAGE P.U.D., FIRST FILING
Dear Glen:
This letter is submitted to explain my understanding of the on -
site storm drainage for Fort Ram Village P.U.D., First Filing.
The drawings, as submitted, indicate the project will detain on -
site stormwater runoff and discharge at a maximum rate as deter-
mined by a 2-year historical condition.
This site is upstream of the Larimer County Canal No. 2, and has
historically discharged to the canal. However, because of the
offsite drainage problems which have occurred in the basin, the
Canal Company will not acknowledge acceptance of the design for
onsite drainage. Therefore, it is my understanding that if
Topanga Enterprises desires to start onsite construction prior to
resolution of the offsite drainage, the City will accept a
revised design plan for temporary total onsite stormwater
retention, and they will not withhold building permits.
If you find my understanding the same as yours, no response is
necessary. However, if you do not agree please respond,
immediately.

RE: Fort Ram Village P.U.D., First Filing
Dear Mr. Gray:
After careful consideration, the City of Fort Collins will accept payment in the
amount of $15,300.00 which will satisfy your obligation as Developer of Fort Ram
Village P.U.D., First Filing to improve West Plum Street (to current City local
street standards) from City Park Avenue to Constitution Avenue. The payment will
satisfy the requirement of Section 2.D. (ii) of the Development Agreement. Upon
receipt of your payment, building permits will no longer be held to secure this
obligation.
It is our plan to use the money and additional City funds to reconstruct the Plum
Street pavement to add a crown to the street and to upgrade the pavement to
satisfy City standards. Our plan is to do this construction next summer.
I understand that there are still punch list items, not related to this issue
of Plum Street paving, that must still be completed prior to the City accepting
the public improvements. Please work with the construction inspector to take
care of these items.
