OF THE DIRECTOR OF COMMUNITY PLANNING
AND ENVIRONMENTAL SERVICES
OF THE CITY OF FORT COLLINS VACATING A
PORTION OF A DRAINAGE EASEMENT
ON LOTS 1 AND 2, BOARDWALK CROSSING FILING 2
WHEREAS, Section 2.1.5 of the Land Use Code of the City of Fort Collins authorizes the
Director of Community Planning and Environmental Services to vacate certain easements by
resolution or by approval of replats containing notation of such dedication, and
WHEREAS, the Owner has requested that the City vacate a portion of a drainage
easement on Lots 1 and 2, Boardwalk Crossing, Filing 2, located on the east side of South
Mason Street, south of Boardwalk and north of Troutman Parkway, more particularly described
on Exhibit "A and
WHEREAS, the vacation has been reviewed and approved by the pertinent City
Departments, which departments report no objections to the vacations.
NOW, THEREFORE, be it resolved by the Director of Community Planning and
Environmental Services of the City of Fort Collins, that a portion of a drainage easement on Lots
1 and 2, Boardwalk Crossing, Filing 2, located on the east side of South Mason Street, south of
Boardwalk and north of Troutman Parkway, more particularly described on Exhibits "A",
attached hereto and incorporated herein by this reference, is hereby vacated.
Passed and adopted at an administrative hearing held by the Current Planning Director
as the delegee of the Director of Community Planning and Environmental Services of the City of
Fort Collins this qi day ofyCiztebsrA.D. 2005.

KNOW ALL MEN BY THESE PRESENTS: That the undersigned being the owners of the
following described land:
Lot 2, Boardwalk Crossing, Filing 2, situate in the Northeast `/4 of Section 35,
Township 7 North, Range 69 West of the Sixth P.M., Fort Collins, Latimer
County, Colorado
do hereby dedicate and convey to the City of Fort Collins, Colorado, for public use forever
hereafter a 5.00 foot wide permanent and non-exclusive utility easement which will run with the
laud and is described as follows:
Begin at the Southeast comer of said Lot 2 and run thence N 00' 04' 30" E 15.00
feet and again N 89' 55' 30" W 57.00 feet to the true point of beginning; thence N

It is understood by the undersigned that, by acceptance of this dedication, the City of Fort Collins
does not have the duty to maintain the easement.
