GRANT OF SLOPE EASEMENT
KNOW ALL MEN BY THESE PRESENTS that, for the sum of TWO HUNDRED
TWENTY-FIVE DOLLARS ($225.00) and other good and valuable consideration,
receipt and adequacy of which is hereby acknowledged, JIM F. KINYON, of the
County of Douglas, State of Colorado, whose address is 4284 S. Salida Way,
Aurora, Colorado 80013, (hereinafter the "Grantor") does hereby grant to THE
CITY OF FORT COLLINS, COLORADO, a municipal corporation (hereinafter the
"City"), a slope easement over and across the following described premises:
Lot 16, Block 6, the Sixth Fairview Subdivision, in the City of Fort
Collins, Larimer County, Colorado, and commonly known as 1504
Lynnwood Drive, Fort Collins, Colorado.
This easement is more particularly shown on Exhibit "A" attached hereto and
made a part hereof and contains 200 square feet, more or less.
The Grantor warrants and represents that he is the lawful owner of the
above described property and has the full power to execute this grant.
As a part of the consideration hereof and by aceptance of this grant of
easement, the City agrees to do the following work, at its own expense:
1. Slope the ground in the area of the easement with a maximum slope of
3:1 (three feet horizontal for every foot of rise or fall) from the proposed
improvements at the edge of the existing. street right-of-way to the existing
ground at the edge of the slope easement area.
2. Stabilize the slope bank of said easement through the use and
establishment of bluegrass sod.
3. Relocate or replace, in a comparable manner, sprinklers and fencing
belonging to the Grantor within the easement area.
Whenever used herein, the singular number shall include the plural, the
plural the singular, and the use of any gender shall be applicable to all
genders. All of the covenants herein shall be binding upon the respective
heirs, personal representatives, successors or assigns of the parties hereto.
IN WITNESS WHEREOF, the Grantor has hereunto set their hand and seal the
day and year first above written; and the Grantee has caused this Easement to
be executed as an Agreement by its City Manager, attested to by its City
Clerk, and its corporate seal to be hereunto affixed, all pursuant to a motion
adopted by the City Council of the City of Fort Collins on the lgth day of
OC'cober , 1988.
