DEED OF DEDICATION FOR EASEMENT
(Permanent Utility, Grading, Drainage and Access Easement)
KNOW ALL MEN BY THESE PRESENTS: That APC LIMITED, a Joint
Venture ("APC"), being the owner of certain real property in Larimer
County, Colorado, legally described at Reception Number 96089906 in
the Larimer County, Colorado records (the "APC Property"), in
consideration of Ten Dollars and no/100 ($10.00) in hand paid,
receipt of which is hereby acknowledged, and other good and valuable
consideration, does hereby dedicate, transfer, and convey to the City
of Fort Collins, Colorado, a Municipal Corporation (the "City"), a
permanent utility, grading, drainage and access easement on, over and
under a portion of the APC Property, which portion is more
particularly described on the attached Exhibit -A (the "Easement")
IA-1 and /9-2-
The undersigned understands that, by acceptance of this
dedication, the City will not accept the duty of maintenance of such
Easement.
Everitt Enterprises Limited Partnership No. 1 ("EELP") shall be
responsible for constructing, at its sole cost, the storm water
drainage improvement facilities as have heretofore been approved by
the City (the "Drainage Facilities") in and on the Easement.
After initial construction of the Drainage Facilities by EELP,
any future costs of maintaining the Drainage Facilities shall be
borne by the owner(s) of the APC Property.
