DEED OF DEDICATION
KNOW ALL MEN BY THESE PRESENTS: That the undersigned IVAN D.
SHUPE and LLOYD E. ROBERTS, doing business as SHUPE AND ROBERTS
RENTALS, being the owner, and MIDAS REALTY CORPORATION, a Delaware
Corporation, being the lessee, of certain real property in Larimer
County, Colorado legally described at Book 2074 Page 505 in the
Larimer County Records, in consideration of Ten Dollars ($10.00) in
hand paid, receipt of which is hereby acknowledged, and other good
and valuable consideration, does hereby dedicate, transfer and
convey to the City of Fort Collins, Colorado, a Municipal
Corporation, for public use forever a permanent easement for a
pedestrian sidewalk and bus bench pad in the City of Fort Collins,
County of Larimer, State of Colorado, more particularly described
on Exhibit "A" attached hereto and by this reference made a part
hereof.
It is understood by the undersigned that, by acceptance of
this dedication, the City of Fort Collins will not accept the duty
of maintenance of such easement.

DESCRIPTION OF THE MIDAS PEDESTRIAN EASEMENT
A 15.00 feet wide Pedestrian Easement located in the Northeast
quarter of Section 35, Township 7 North, Range 69 West of the
Sixth Principal Meridian, City of Fort Collins, Larimer County,
Colorado, the said easement is also located in Lot 5 of the Plat of
RCD Plaza South Subdivision, a plat of record with the Clerk and
Recorder of the said Larimer County, the said easement is also a
portion of that certain tract of land as described in a deed dated
October 1, 1980 , and recorded in Book 2074 at Page 505, and in a
deed dated October 1, 1980 and recorded in Book 2074 at Page 504
records of the said Clerk and Recorder, more particularly described
as follows;
Commencing at the southeast corner of the said Lot 5 of the Plat of
RCD Plaza South Subdivision, the said southeast corner is also the
TRUE POINT OF BEGINNING of this description;
THENCE along the east line of the said Lot 5, North 00 degrees
05 minutes 00 seconds West for a distance of 135.01 feet;
THENCE continuing along the said east line of Lot 5, along a
curve to the left having a radius of 15.00 feet, a central angle of
89 degrees 50 minutes 45 seconds and an arc length of 23.52 feet,
being subtended by a chord of North 45 degrees 00 minutes 23
seconds West for a distance of 21.18 feet to the north line of the
said Lot 5;
THENCE along the said north line of Lot 5, North 89 degrees 55
minutes 45 seconds West for a distance of 0.04 feet to a line which
is 15.00 feet westerly of and parallel with the said east line of
Lot 5;
THENCE along the said parallel line, South 00 degrees 05
minutes 00 seconds East for a distance of 149.97 feet to the south
line of the said Lot 5;
THENCE along the said south line, South 89 degrees 55 minutes
45 seconds East for a distance of 15.00 feet to the point of
beginning. Containing 2202 square feet more or less.
The above described tract is subject to all easements and rights of
ways now existing or of record.
I hereby state that the above description was prepared by me and is
true and correct to the best of my professional knowledge, belief
and opinion. The description is based upon previously recorded
plats and deeds and not upon a actual field survey.
