KNOW ALL MEN BY THESE PRESENTS: That the undersigned, being the
Owner of the following -described land, to -wit a tract of land
situate in the NW 1/4 of Section 33, T7N, R68W of the 6th P.M., as
more particularly described in the attached Exhibit "A", does
hereby dedicate, transfer and convey to the City of Fort Collins,
Colorado ("City"), for public use forever, a permanent easement in
the County of Larimer, State of Colorado, for the purpose of
constructing, installing, operating and maintaining a storm
drainage detention pond thereon, said easement being more
particularly described in the attached Exhibit "B".
The City acknowledges that the storm drainage detention pond is
necessary to serve Woodland Park Final P.U.D. and has been sized to
accommodate storm drainage waters from Woodland Park Final P.U.D.
and also to accommodate two adjacent properties presently owned by
Robert W. Shields and Wendy L. Shields and by Ilene E. Shields,
contemplated to be developed into either five residential units and
a church or 26 residential units. The City covenants and agrees
that it shall not approve storm drainage plans for any development
properties which would exceed the engineered capacity of said
detention pond.
It is understood by the undersigned that, by acceptance of this
Permanent Storm Drainage Easement, the City of Fort Collins,
Colorado will not accept the duty of maintenance of such easement.

Shields and Wendy L. Shields, being the Owners of the following -
described land, to -wit a tract of land situate in the NW 1/4 of
Section 33, T7N, R68W of the 6th P.M., as more particularly
described in the attached Exhibit "A", do hereby dedicate, transfer
and convey to the City of Fort Collins, Colorado, for public use
forever, a permanent easement for the conveyance of storm drainage
waters in a buried pipeline with a surface swale and the
maintenance of such pipeline and swale in the County of Larimer,
State of Colorado, more particularly described in the attached
Exhibit "B".
It is understood by the undersigned that, by acceptance of this
Permanent Storm Drainage Easement, the City of Fort Collins,
Colorado will not accept the duty of maintenance of such easement.
