CONSENT AND SUBORDINATION AGREEMENT
WHEREAS, Donald H. Scott and Mary S. Scott on this 8th day of February, 1995, executed
a Deed of Dedication for Easement to the City of Fort Collins, Larimer County, State of Colorado
for a permanent drainage easement which easement covers lands in Latimer County, Colorado,
described on Exhibit "A" attached hereto and incorporated herein, and recorded in the records of
Larimer County, Colorado on Aord 1995 at
Reception Number: h4 a 17.3 3
NOW, THEREFORE, 1ST CHOICE BANK, the holders and owners of a Deed of Trust
properly recorded in the records of Larimer County, Colorado at Reception Number 94084618, for
valuable consideration, the receipt of which is hereby acknowledged, hereby consents to the terms
and provision of said drainage easement, without, however, joining in any warranties, guarantees or
indemnities contained therein, and agree that the subject Deed of Trust shall be subordinate to such
easement in the event of foreclosure thereof.

EXHIBIT "A"
An easement for the detention of storm water situate on Lot 10 of Creger Plaza Second
Replat according to the plat on file in the office of the Clerk and Recorder of Larimer
County, Colorado. Said Lot 10 being located in the Northeast Quarter of Section 35,
Township 7 North, Range 69 West of the 6th .'rincipal Meridian, City of Fort Collins,
County of Larimer, State of Colorado.
The perimeter of said easement for the detention of storm water being more
particularly described as follows:
Beginning at the Northwest corner of said Lot 10 and considering the North line of
said Lot 10 as bearing South 890 49' 40" East with all bearings contained herein
relative thereto;
thence along the North line of said Lot 10 South 89' 49' 40" East, 75.00;
thence South 010 04' 00" West, 100,00 feet to the South line of said Lot 10;
thence along the South line of said Lot 10 South 89' 49' 40" East, 35.00 feet;
thence North 010 04' 00" East, 35.00 feet;
thence South 891 49'40" East, 100.00 feet;
thence North 01104' 00" East, 65.00 feet to the North line of said Lot 10;
thence along the North line of said Lot 10 South 89' 49' 40" East, 79.69 feet to the
Northeast corner of said Lot 10;
thence along the East line of said Lot 10 South 03' 02' 05" West, 46.24 feet to the
beginning of a curve concave to the West having a central angle of 08' 10' 49"and a
radius of 380.00 feet, thence Southwesterly along the arc of said curve 54.25 feet to the
Southeast corner of said Lot 10;
thence along the South line of said Lot 10 North 89' 49' 40" West, 282.38 feet to the
Southwest corner of said Lot 10;
thence along the West line of said Lot 10 North 010 04' 00" East, 100.00 feet to the
POINT OF BEGINNING.
The above described easement contains 18724 square feet, more or less, and is subject
to all easements and rights -of -way of record or by use.
