OF TORT COLLINS AMD TO BB INCLUDED WITHIN THE LIMITS
AND JURISDICTION THEREOF, PURSUANT TO THE AUTHORITY
CONTAINED IN ARTICLE 11, CHAPTER 1399 COLORADO REVISED
STATUX93 1953
wHRREAS, heretofore a written petition was presented to the
Council of the City of Port Collins in substantial cospliaacs with tba
provisions of Article 11, Chapter 139, Colorado Revised Statutes, by the
sole owners residing in the area of land embraced in whet is knows as the
Sixth Highlander Heights Amasxatian to the City of Tort Collins, wherein
and whereby said petitioners petitioned the City of tort Collins for
annexation of all the territory embraced in what is knowa ne the Sixth
:3ighLander Heights Annexation to the City of tart Collins, Colorado, com-
prising the lands shown in the plat thereof attached to Said potitiou dud
more particularly described as hereinafter set forth, and

WHEREAS, notice for hearing on the 21st day of Noveslbas, A, 6„
1963, on on ordinance approving the annexation of Said territory end in -

Collins was duly published as provided by lap, and
WHEREAS, the Council of the City of Fort Collins has fomed that

Article 11, Chapter 139, Colorado Revised Statutes, 1953. and
WIhERBA8, no proceedings for an aloatisn to determine the question
of annexation have been initiated by written counter petition As provided by
Law and no objection to annexation having been made,
BE IT ORDAINED BY THE COUNCIL OF THE CITY Ot PORT COLLINS$
Section 1. That after due conaidoratien of the potion for msasx-
ation, the petition for the asslexation of all the territory in what is known
and described as the Sixth Highlander %eights Annexation to the City of Port
Collins, Colorado, as shown by the plat thereof sausxed to Said petition and
which is more particularly described as follows, ta•witi
A part of the Southwest Qaartar (SWO of Section 1S,
Township 7 North, Range bS West of the 6th Principal
Meridian in the County of l.arlmer, State of Colorado,
contained within the boundary lines as shown, consid-
ering the 'Bast line of said Southwest Quarter (SWk) to
bear North 00003'50" West with all hearings contained
herein relative thereto: CmmmWeing at the sowtheaat
corner of the Northeast Quarter (N Ek) of the Southwest
Quarter (ffi;) of said Section l8, said corner being the
true point of beginning and also the Northeast corner
of the Prospect Estate Subdivision as platted and re-
corded in the office of the County Clerk and Recorder
of Larimer County, Colorado; thence South 89.28'00" West
along the North line of said Prospect Estates Subdivision
a distance of 291.97 feet to a point on the East line of
tl*A Fourth Highlander Heights Annexation as filed in the
office of the County Clark and Recorder, Larimer County,
Colorado; tbouee North 00`03'50" East along the East line
of said Fourth Highlander Heights Annexatlon, a dlata ca
of 810.41 feet; thence South 63'S7'25" East 323.13 feat
to a point on the East line of the Southwest Quarter (SW'})
of said Section 16; thence South 00*03150" East along
the. East line of the Southwest Quarter (SWh) of said
Section 18 a distance of 665.82 feet to the true point
of beginning;
bt+ accepted and approved and that said territory be annexed and made a part
of the City of Fort Collins and be included within the limits and juriedlation
of the City of Fort Collins41h the area North of Pitkin Street to be in the "C"
Residential District, and with the area South of Pitkin Street to be in the "A"
fYcsidential District, and that the City Clark be and he is hereby eutheriaed and
directed to prepare certified copies of this ordinance, to •sah of which *bail
bo attached a plat of said Sixth Highlander Heights Annexation to the City of
Fart Collins, Colorado, and shall file a copy thereof in the office of the Clark
acid recorder of the County of Larimar, and another copy thereof In the office of
the Clerk of the City of Port Collins, together with a certified copy of said
petition and another copy of said petition and approving ordinance with the
Secretary of State of the State of Colorado.
Section 2. That in accepting and approving the plat of the Sixth
bUghlander Heights Annexation to the City of fort Collins, the City at fort
Collins does not assume obligations respecting the construction of wetter mains,
sewer. lines, ,gas mains, electric light lines or other services or utilities with
,expect to service of said addition, except as may be required and provided by the
n+.uners of the property within the limits of said addition in compliance with the
toms and provisions of Chapter 150 Code of ordinances of the City of fort Collins*
Colorado, 1958, as amended, relating to local and public -improvement*.
Introduced, considered favorably on first reading and ordered
published this 21st day of Movember, A. D., 1963, and to be presented for
final passage on the 12th day of December. A. D., 1963.
