(SIGHT DISTANCE AND UTILITY EASEMENTS)
KNOW ALL KEN BY THESE PRESENTS: That the undersigned,
327006 Alberta, Ltd., being the owner of certain real property
in Larimer County, Colorado, legally described as Lots 152 and
174 of Huntington Hills, Filing Two, being a portion of
Estates of Huntington Hills, Filing One, a P.U.D., in
consideration of Ten Dollars ($10.00) in hand paid, receipt of
which is hereby acknowledged, and other good and valuable
consideration, does hereby dedicate, transfer and convey to
the City of Fort Collins, Colorado, a Municipal Corporation,
for public use forever a permanent sight distance easement in
the City of Fort Collins, County of Larimer, State of
Colorado. The area within sight distance easements is
restricted to the following:
1) Fences shall not exceed 42" in height and shall be
of open design. If fences exceed 32" in height, they shall be
constructed of split rail with a minimum dimension of 12"
between horizontal members.
2) Berms, hedges and shrubs shall not exceed 32" in
height.
3) Tree planting shall be restricted to deciduous
trees only. The lowest branch of any tree shall be no less than
42" from grade.
It is understood by the undersigned that, by acceptance
of this dedication, the City of Fort Collins will not accept the
duty of maintenance of such easement.
