ORDINANCE NO. 12 , 1964
ACCSPTINO AND APPROVING THE PLAT OF WHAT IS'RNOWN AS THE
SOUTH SHIELDS STREET NINTH ANNEXATION TO THE CITY OF FORT
COLLINS AND TO BE INCLUDED WITHIN THE LIMITS AND JURIS-
uicnoN THEREOF, PURSUANT TO THE AUTHORITY CONTAINED IN
ARTICLE 11, CHAPTER 139, COLORADO REVISED STATUTES, 1953.
WHEREAS, heretofore a written petition was presented to the Council
of the City of Fort Collins in substantial compliance with the provisions of
Article 11, Chapter 1390 Colorado Revised Statutes, by the owners of more than
fifty per seat (50%) of the arms and who comprise the majority of landowners
residing in the area of land embraced in what is known as the South Shields
Street Ninth Annexation to the City of Fort Collins, wherein and whereby said
petitioners petitioned the City of Fort Collins for annotation of all the
territory embraced in what is known as the South Shields Street Ninth Annexation
to the City of Fort Collins, Colorado, comprising the lands shown in the plat
thereof attached to said petition and more particularly described as hereinafter
sot forth, and
WHEREAS, said petition was accepted by the Council of the City of
Fort Collins by resolution passed and adopted on February 27. 1964. and
WHEREAS, notice for bearing an the 9th day of April. A. D.. 19641, on
an ordinance approving the annexation of said territory and including the same
within the limits and jurisdiction of the City of Fort Collins was duly published
as provided by law. and
WHEREAS, the Council of the City of Fort Collins be* found that the
petition and the documents thereto attached most the requirements of Article 11,
Chapter 139, Colorado Revised Statutes, 1953, and
WHEREAS. no proceedings for an election to determine the question of
annexation have been initiated by written countor-potition as provided by law
and so objection to annexation having been made.
BE IT ORDAIM BY THE COUNCIL OF THE CITY OF FORT COLLINSs
Section 1. That after duo consideration of the petition for annexation,
the petition for the annexation of all the territory in what is known and described
as the South Shields Street Ninth Annexation to the City of Fort Collins . Colorado,
as shown by the plat thereof annexed to said petition and which is more particularly
described as follows, to -wits
Partial No. it A tract of land situate in the Nl't of the Sl#
of Section 150 Township 7 North, Range 69 West of the 6th
P.m., in the County of Lorimer and State of Colorado, which
considering the last line of said Sly as bearing due South
and with all bearings contained herein relative theretoo
is contained within the boundary lines which begin at a
point which bears S. 313.50 feet from the last k corner of
said Section 15 and run thence South 348.83 feet to the SE
corner of the N� of the Nt' of the Slk of said Section 15;
thence S. 15.00 feat; thence W. 280.00 feet; thence N. 17.24
feat to a point on the S. line of the Nk of the Nti of the
Sly of said section 15; thence N. 89°32130" W. 1048.69 feat
along said South line to the West line of the lit of the Slh
of said Section 15, thence N. 00003' W. 346.72 feet along said
West line, thence S. 89*34' last 1328.99 foot to the point of
beginning, containing 10.713 acres, more or less; AND
Parcel No. 21 A tract of land located in Section 15, Town-
ship 7 North, Range 69 West of the 6th P.M., in the County
of Lorimar and State of Colorado, more particularly described
as fellowat Considering the last line of the Sly of said
Section 15 as bearing due South and with all bearings contained
heroin relative thereto„ begin at the Nl corner of the Sit of
the Nlk of said Slk and run thence South 15.00 foot; thence
West 280.00 foot4 thence North 17.24 feet to the North line
of said South j of the NA of the SRC; thence along said
line S. 89°32030" last 280.00 feet to the point of beginning,
containing .0964 acres. more or loss;
be accepted and approved and that said territory be annexed and mad* a part of
the City of Fort Collins and be iacluded within the limits and jurisdiction of
the City of Fort Collins with Parcel No. i an a "C" Residential District and
with Parcel No. 2 as an "A" Residential District, and that the City Clerk be
and he is hereby authorised and directed to preporo certified copies of this
ordinaca, to each of which shall be attached a plat of said South Shields
Street Ninth Annexation to the City of Fort Collins, Colorados and shall file
a copy thereof in the office of the Clerk and Recorder of the County of Lorimer,
and mother copy thereof in the office of the Clerk of the city of Fort Collins,
together with a certified copy of said petition and another copy of said petition
and approving ordinance with the Secretary of State of the State of Colorado.
Section 2. That in accepting and approving the plat of the South
Shields Street Ninth Annexation to the City of Fort Collins, the City of Fort
Collins does not assume obligations respecting the construction of water mains,
saver lines, gas wins, electric light lines or other services or utilities with
respect to service of said addition, except as may be required and provided by
the owners of the property within the limits of said addition in compliance
with the torus and provisions of Chapter 15. Coda of Ordinances of the City
of Tort Collins, Colorado. 1958* as amended, relating to local and public

Introduced, considered favorably on first reading and ordered pub-
liahod this 9th'd4y of April, A. D.. 1964* and to be presented for final passage
on the 7th day of easy. A. D., 1964.,
