ACCEPTING AND APPROVING THE FLAT OF WHAT IS BROWN AS
THE EAST ACRES SECOND ANNEXATION TO THE CITY OF FORT
COLLINS AND TO BE INCLUDED WITHIN THE LIMITS AND JURIS-
DICTION THEREOF, PURSUANT TO THE AUTHORITY CONTAINED IN
ARTICLE 11, CHAPTER 139, COLORADO REVISED STATUTES, 1953
WHEREAS, heretofore a written petition was presented to th4 Council
of the City of Fort Collins in substantial compliance with the provisions of
Article 11, Chapter 139, Colorado Revised Statutes, by the owners of mare than
fifty per cent (50%) of the area and who comprise the majority of landowners
residing in the area of land embraced in what is known as the East Acres
Second Annexation to the City of Fort Collins, wherein and whereby said
petitioner• patitionedi:the City of Fort Collins fair annexation of all the
territory embraced in what is known as the East Acres Second Annexation is
the City of Fort Collins, Colorado, comprising the lands shown in the plat
thereof attached to said petition and'moro particularly described as herein+
after set forth, and
WHEREAS, said petition was accepted by the Council of the City of
Fort Collins by resolution passed and adopted on 86eimbor 10$ 1964, and
WHEREAS, notice for hearing on the 21st day of January, 1965, on
an ordinance approving the anasxation of said territory and including the name
within the limits and juriddiction of the City of Fort Collins was duly
published as provided by law, and
WHEREAS, the Council of the City of Fort Collins has found that the
petition and the docoments thereto attached meet the requirements of Article
11, Chapter 139„ Colorado Revised Statutes, 19339 and
WHEREAS, no proceedings for an election to determine the question of
annexation have been initiated by written counter -petition as provided by law
and no objection to annexation laving boon model
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINEt
Section 1. That after due consideration of the petition for
annexation, the petition for the annexation ei all the territory in what is
known and described as the Bast Acres Second Annexation to the City of Fort
Collins, Colorado, as shown by the plat thereof annexed to said petition and
which is more particularly described as follows, to -wits
Commencing at the Northeast corner of Tract 1 of East
Acres, a subdivision in the M of NE} of Section 24,
Township 7 North, Mange 69 West of the bth F. 1l.,
thence West 129 feet; thence South 223 test; thence
West 135 feet; thence south 272 foot; thence Feat 264
feet; these* Worth 493 fastete the point of beginning;
be accepted and approved and that said territory be annexed and made a part
of the City of Fort Collins and be included within the limits and jurisdiction
of the City of Fort Collins as a "C" Residential District, anal that the City
Clerk be and he is hereby authorised and directed to prepare certified copies
of this ordinance, to each of which shall be attached a plat of said East
Acres Second Annexation to the City of Fort Collins, Colorado, sad shall file
a copy thereof in the office of the Clerk end Recorder of the County of Lariwr,
and another copy thereof in the office of the Clark of the City of Fort Collins,
together with a certified copy of said petition, sod another Copy of said
Petition and approving ordinance with the Secretary of State of the State of
Colorado.
Section 2. That in accepting and approving the plat of the test
Acres Second Annexation to the City of Fort Collins, the City of Fort Collins
does not assume obligations respecting the conetrueties of water mains, sewer
lines, gas mains, electric light lines or other services or utilities with
respect to service of said addition, except as may be required and provided by
the owners of the property within the limits of said addition in Compliance,
with the terms and provisions of Chapter 13, Code of Ordinances of the City of
Fort Collins, Colorado, 1958, as &needed, relating to local end public
Improvements.
Introduced, consider*d favorably on first reading, and ordered
published this 21st day of January, A. D. 19659 and to be presented for final
Passage on the filth day of February, A. D. 1965.
