ORDINANCE NO. 88 , 1985
OF THE COUNCIL OF THE CITY OF FORT COLLINS
ANNEXING PROPERTY KNOWN AS THE
STUTE ANNEXATION #1
TO THE CITY OF FORT COLLINS, COLORADO
WHEREAS, Article II, Section 30 of the Constitution of the State of
Colorado requires that one of the following conditions be met before an
unincorporated area be annexed to a municipality:
1. The question of annexation be submitted to a vote of the
landowners and registered electors of the area to be annexed
and the majority of such persons voting, vote in favor of
annexation; or
2. The annexing municipality receive a petition for annexation
signed by more than 50% of the landowners in the area who
own more than 50% of the land; or
3. The area to be annexed be entirely surrounded by or be
solely owned by the annexing municipality; and
WHEREAS, 100% of the landowners in the Stute Annexation #1 area have
signed a petition for annexation; and
WHEREAS, not less than one -sixth (1/6th) of the perimeter of the area
to be annexed is contiguous with the City of Fort Collins and a community
of interest exists between the territory to be annexed and the City of Fort
Collins; and the territory to be annexed is urban or will be urbanized in
the near future; and such territory is integrated or, is capable of being
integrated with the City of Fort Collins; and
WHEREAS, no election is required and no additional terms and
conditions are to be imposed in connection with this annexation; and
WHEREAS, the Council has found and determined and does hereby find and
determine that said petition is in substantial compliance with the
annexation laws of the State of Colorado and that the territory is eligible
for annexation, and the City Council desires to annex the same to the City
of Fort Collins; and
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS:
Section 1. That the following described property
A tract of land situate in the County of Larimer, State of
Colorado to -wit:
BEING a portion of the NE 1/4 of Section 4, T 6 N, R 68 W and a
portion of the SE 1/4 of Section 33, T 7 N, R 68 W of the 6th
P.M., Larimer County, Colorado.
Considering the North line of the NE 1/4 of Section 4, T 6 N, R
68 W, 6th P.M. as bearing West, and with all bearings contained
herein relative thereto.
Beginning at a point on the North line of NE 1/4 of said Section
4 from which the North 1/4 corner of said Section 4 bears S 900
00'00" W 1485.94 feet, said point also being on the East line of
the Harmony Annexation No. 4 to the City of Fort Collins and the
TRUE POINT OF BEGINNING; thence along said East line of Harmony
Annexation No. 4 N 18°17'24" W 175.88 feet to the Northerly
right-of-way line of Colorado State Highway No. 68; thence
departing from the East line of Harmony Annexation No. 4 along
said Northerly right -of way line the following three (3) courses
and distances: N 84°17'22" E 130.74 feet; N 90°UO'00" E 400.00
feet; S 84°17'22" E 201.00 feet; thence departing from said
Northerly right-of-way line S 08°35'22" W 194.86 feet to a point
on the Southerly riyht-of-way line of said Colorado State Highway
No. 68; thence departing said Southerly right of -way line along
the East line of that certain parcel of land described at Book
2180, Page 0034 records of Larimer County, Colorado, the
following four (4) courses and distances: S 43°48'00" E 101.41
feet; S 11°45'00" E 164.06 feet; S 04°04'30" E 325.00 feet; S
38026'30" E 116.04 feet; thence departing said East line of said
parcel S 77°03'25" W 257.19 feet to a point on the West line of
said parcel, said point also being on the Easterly right-of-way
line of the Fossil Creek Inlet Ditch; thence along said Easterly
right-of-way line of said ditch the following two (2) courses and
distances: N 36°30'00" W 322.36 feet; N 61°20'00" W 221.87 feet;
thence departing said Easterly right-of-way line of said ditch N
88044'16" W 168.65 feet to a point on the Westerly right-of-way
line of said ditch, said point also being on the East line of
Smith Annexation to the City of Fort Collins; thence along said
Westerly right-of-way line of said ditch and East line of said
annexation the following two (2) courses and distances; N
00052'00" W 159.28 feet; N 25°39'00" W 250.26 feet to a point on
the Southerly riyht-of-way line of Colorado State Highway No.
68, said point also being on the South line of Harmony Annexation
No. 4; thence along the Southerly right-ot-way line and said
South line of Harmony Annexation No. 4 S 89°59'55" E 45.09 feet;
thence departing said Southerly right-of-way line along the East
line of said Harmony Annexation No. 4 N 18°17'24" W 33.77 feet to
the TRUE POINT OF BEGINNING, containing 12.00 acres more or less.
be, and it hereby is, annexed to the City of Fort Collins and made a part
of said City, to be known as the Stute Annexation #1.
Section 2. That in annexing said territory to the City of Fort
Collins, the City of Fort Collins does not assume any obligation respecting
the construction of water mains, sewer lines, gas mains, electric service
lines, streets or any other services or utilities in connection with the
territory hereby annexed except as may be provided by the ordinances of the
City of Fort Collins.
Section 3. That within ninety (90) days from the date this Ordinance
becomes effective, no building permit shall be issued for any of the lands
herein described unless said lands have been zoned under the zoning
ordinances of the City.
Introduced, considered favorably on first reading, and ordered
published this 20th day of August, A.D. 1985, and to be presented for final
passage on the 3rd day of September, N.D. 1985.
