KNOW ALL MEN BY THESE PRESENTS: That the undersigned, NEW COLONY, LTD., a

Considering the south line of the aforementioned northeast quarter as bearing
N. 89° 44' 00" W. and with all bearings contained herein relative thereto;

do hereby dedicate, transfer and convey to the City of Fort Collins, Colorado, for public use forever a
permanent 20 foot wide casement for utility purposes in the City of Fort Collins, County of Latimer,
State of Colorado, more particularly described as follows:
A tract of land situated in the northeast quarter of Section 22, Township 7 North,
Range 69 West of the Sixth Principal Meridian, City of Fort Collins, County of
Latimer, State of Colorado, being more particularly described as follows:
Commencing at the east quarter corner of Section 22; thence west along the south
line of the northeast quarter a distance of 644.00 feet; thence on a deflection angle to
the right of 79' 13' 14" a distance of 22.11 feet to a point on the northwesterly line of
the 20 foot sanitary sewer easement, as shown on the plat of Foothills Apartments,
Addition recorded July 28, 1971 in Book 1470 at Page 235, and the Point of
Beginning; thence continuing northwesterly along the last described course a
distance of 116.28 feet; thence on a deflection angle to the left of 10' 25' 46" a
distance of 22.58 feet to an angle point in a 10-foot utility easement shown on the
plat of Foothills Apartments, Addition; thence on a deflection angle to the right of
47' 16' 32" along the southeasterly line of the easement a distance of 27.22 feet;
thence on a deflection angle to the right of 132°43'28" a distance of 42.88 feet;
thence on a deflection angle to the right of 10°25'46" a distance of 108.68 feet;
thence on a deflection angle to the left of 640 45' 46" a distance of 22.11 feet to the
Point of Beginning; containing 2,904 square feet or 0.067 acres, more or less.

not accept the duty of maintenance of such easement.
