ORDINANCE NO. 1 , 1985
OF THE COUNCIL OF THE CITY OF FORT COLLINS
ANNEXING PROPERTY KNOWN AS THE
SPRINGBROOK TWO ANNEXATION
TO THE CITY OF FORT COLLINS, COLORADO
WHEREAS, Article II, Section 30 of the Constitution of
Colorado requires that one of the following conditions be
unincorporated area he annexed to a municipality:

the landowners and registered electors of the area to
he annexed and the majority of such persons voting,
vote in favor of annexation; or
2 The annexing municipality receive a petition for
annexation signed by more than 50% of the landowners in
the area who own more than 50% of the land; or
3 The area to he annexed be entirely surrounded by or he
solely owned by the annexing municipality; and
WHEREAS, 100% of the landowners in the Springbrook Two Annexation area
have signed a petition for annexation; and
WHEREAS, not less than one -sixth (1/6th) of the perimeter of the area
to be annexed is contiguous with the City of Fort Collins and a community
of interest exists between the territory to be annexed and the City of Fort
Collins; and the territory to he annexed is urban or will be urhanized in
the near future; and such territory is integrated or is capable of heing
integrated with the City of Fort Collins; and
WHEREAS, no election is required and no additional terms and condi-
tions are to be imposed in connection with this annexation; and
WHEREAS, the Council has found and determined and does hereby find and
determine that said petition is in substantial compliance with the annexa-
tion laws of the State of Colorado and that the territory is eligible
for annexation, and the City Council desires to annex the same to the City
of Fort Collins; and
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS:

Section 1. That the following described property
Lots 1, 2 and 3 of subdivision of a part of the West 1/2 of the
Northwest 1/4 of Section 27, Township 7 North, Range 69 West of
the 6th P.M., and 1 Rod along the East line of the West 1/2 of
the Northwest 1/4 joining the County Road and said Lot 1 all
situate in the Northwest 1/4 of the Northwest 1/4 of Section
27, Township 7 North, Range 69 West of the Sixth P.M., Larimer
County, Colorado and being more particularly described as fol-
lows: Considering the North line of the said Northwest 1/4 as
bearing S 89'31' E and with all bearings contained herein rela-
tive thereto is contained within the boundary lines which begin
at a point on the North line of the said Northwest 1/4 which
bears S 89°31' E 1298.85 feet from the Northwest Corner of
said Section 27 and run thence along said North line S 89°31' E
16.50 feet to the West 1/16 Corner on the North line of said
Section 27; thence along the East line of the West 112 of the
Northwest 1/4 of said Section 27, S 00°04' E 1142.70 feet to the
North line of Hull Street; thence along said North line, N 89°31'
W 962.85 feet to the West line of said Lot 3; thence along the
boundary line of said Lot 3, N 00°04' W 708.30 feet, and again S
89°31' E 322.50 feet to the West boundary line of said Lot 2;
thence along said West line, N 00°04' W 30.00 feet; thence along
the North lines of said Lots 2 and 1, S 89°31' E 623.85 feet;
thence N 00°04' W 404.40 feet to the point of beginning contain-
ing 16.2497 acres more or less.
be, and it hereby is, annexed to the City of Fort Collins and made a part
of said City, to be known as the Springbrook Two Annexation.
Section 2. That in annexing said territory to the City of Fort
Collins, the City of Fort Collins does not assume any obligation respecting
the construction of water mains, sewer lines, gas mains, electric service
lines, streets or any other services or utilities in connection with the
territory hereby annexed except as may be provided by the ordinances of the
City of Fort Collins.
Section 3. That within ninety (90) days from the date this Ordinance
becomes effective, no building permit shall be issued for any of the lands
herein described unless said lands have been zoned under the zoning ordi-
nances of the City.
Section 4. The City of Fort Collins hereby consents to the inclusion
of the lands which are the subject of this annexation ordinance into
the Municipal Subdistrict, Northern Colorado Water Conservancy District.
