CONSENT AND SUBORDINATION AGREEMENT
WHEREAS, Jack E. Trigg, on the 6th day of November, 1989,
executed a certain Easement Dedication to the City of Fort Collins
fox tho instnllat -n of utilities, which easement covers land in
Larimer County, Colorado, described below:
The northerly 10 feet, and the westerly 10 feet of the
not therly 30 feet of Lot 21, Block 2, Hill Pond on Spring
Creek 2nd Filing, a Planned Unit Development.
NOW THEREFORE, HIGHLAND DEVELOPMENT PARTNERSHIP, the holders
and wners of a Mortgage Deed recorded Reception No. 86000452 in
the Lari.mer County, Colorado records, for a valuable consideration,
the receipt of which is hereby acknowledged, hereby consents to the
terms and provisions of said easement aforesaid without, however,
joining in any of the warranties, guarantees or indemnities
,-nntained therein, nd agree that the subject Deed of Trust shall
be subordinate to such easement in the event of foreclosure
thereof.
