ORDINANCE NO. 161, 1982
OF THE COUNCIL OF THE CI7Y-19 FORT COLLINS
ANNEXING PROPERTY KNOWN AS THE
MOBILE PREMIX -PROSPECT ROAD ANNEXATION
TO THE CITY OF FORT COLLINS, COLORADO
WHEREAS, Article II, Section 30 of the Constitution of the State of
Colorado requires that one of the following conditions be met before an
unincorporated area be annexed to a municipality:
1. The question of annexation be submitted to a vote of
the landowners and registered electors of the area to
be annexed and the majority of such persons voting,
vote in favor of annexation; or
2. The annexing municipality receive a petition for
annexation signed by more than 50% of the landowners in
the area who own more than 50% of the land; or
3. The area to be annexed be entirely surrounded by or be
solely owned by the annexing municipality; and
WHEREAS, 100% of the landowners in the Mobile Premix -Prospect Road
Annexation area have signed a petition for annexation; and
WHEREAS, not less than one -sixth (1/6th) of the perimeter of the area
to be annexed is contiguous with the City of Fort Collins and a community
of interest exists between the territory to be annexed and the City of Fort
Collins; and the territory to be annexed is urban or will be urbanized in
the near future; and such territory is integrated or is capable of being
integrated with the City of Fort Collins; and
WHEREAS, no election is required and no additional terms and condi-
tions are to be imposed in connection with this annexation; and
WHEREAS, the Council has found and determined and does hereby find and
determine that said petition is in substantial compliance with the annexa-
tion laws of the State of Colorado and that the territory is eligible
for annexation, and the City Council desires to annex the same to the City
of Fort Collins; and
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS:
Section 1. That the following described property
A tract of land located in the East 112 of Section 18,
and the West 112 of Section 17, T7N, R68W, of the 6th
P.M., Larimer County, Colorado, being more particularly
described as follows:
Considering the East line of said Section 18 as bearing
S 00' 00'00" E and with all bearings contained herein
relative thereto:
Commencing at the Southeast corner of said Section 18,
said point being the True Point of Beginning; thence, S
89°09'00" W, 233.46 feet along the South line of said
East 112 of Section 18; thence N 00°02'12" W, 758.64
feet; thence, S 89008'06" W, 455.27 feet more or less
to a point on the easterly right-of-way of the Colorado
and Southern Railroad; thence, along the said easterly
right-of-way on the following courses:
N 18°14'36" W, 736.30 feet;
Thence, along a spiral curve to the left with a delta
of 03°00' and a chord bearing N 19°15'07" W, 152.60
feet to a point of curvature;
Thence, along a curve to the left with a delta of
45°38'35", an arc length of 1180.60 feet and a chord
bearing N 44°03'53" W, 1149.63 feet to a point of
spiral curvature:
Thence, along a spiral curve to the left with a delta
of 03°00' and a chord bearing N 68°52'40" W, 152.60
feet;
Thence, N 69053'11" W, 779.29 feet to a point on the
north -south centerline of said Section 18; thence,
leaving the said easterly right-of-way of the Colorado
and Southern Railroad N 00°03'02" E, 685.96 feet along
the said north -south centerline of Section 18 to a
point on the West bank of the Cache La Poudre river;
thence, along the said West bank on the following
courses:
S 66-38-10" E, 180.77 feet;
Thence, N 41°11'00" E, 124.14 feet;

Thence, N 11°37'47" E, 152.53 feet;
Thence, N 14°38'53" E, 237.29 feet;
Thence, N 57°04'50" E, 185.17 feet;
Thence, N 66°18'55" E, 59.52 feet to a point on the
South line of the North 1/2 of the Northeast 1/4 of
Section 18; thence, leaving the said West bank of the
Cache La Poudre River along the said North 1/2 line, N
89-16-34" E, 84.27 feet; thence, S 68°11'00" E, 758.68
feet; thence, S 07°27'00" E, 520.70 feet; thence, S
82°25'00" E, 1249.40 feet more or less to a point on
the East line of Section 18 which lies 2989.85 feet
North of the Southwest corner of said Section 18;
thence, S 90°00'00" E, 1069.82 feet; thence, S 00°00'
00" E, 2240.34 feet; thence, N 89*29'30" W, 1069.86
feet more or less to a point on the East line of said
Section 18; thence, S 00°00'00" E, 759.00 feet along
the East line of said Section 18 to the True Point of
Beginning.
The above described tract contains 154.192 acres more
or less and is subject to all easements and rights -of -
way now on record.
be, and it hereby is, annexed to the City of Fort Collins and made a part
of said City, to be known as the Mobile Premix -Prospect Road Annexation.
Section 2. That in annexing said territory to the City of Fort
Collins, the City of Fort Collins does not assume any obligation respecting
the construction of water mains, sewer lines, gas mains, electric service
lines, streets or any other services or utilities in connection with the
territory hereby annexed except as may be provided by the ordinances of the
City of Fort Collins.
Section 3. That within ninety (90) days from the date this Ordinance
becomes effective, no building permit shall be issued for any of the lands
herein described unless said lands have been zoned under the zoning ordi-
nances of the City.
Introduced, considered favorably on first reading, and ordered pub-
lished this 21st day of December , A.D. 1982, and to be presented for final
passage on the 4tn_ day o1 January__, A.D. 1983.
