ORDINANCE NO. 8 , 1986
OF THE COUNCIL OF THE CITY OF FORT COLLINS
ANNEXING PROPERTY KNOWN AS THE
SOUTH HARMONY ANNEXATION
TO THE CITY OF FORT COLLINS, COLORADO
WHEREAS, Article II, Section 30 of the Constitution of the State of
Colorado requires that one of the following conditions be met before an
unincorporated area be annexed to a municipality:
1. The question of annexation be submitted to a vote of the
landowners and registered electors of the area to be annexed
and the majority of such persons voting, vote in favor of
annexation; or
2. The annexing municipality receive a petition for annexation
signed by more than 50% of the landowners in the area who
own more than 50% of the land; or
3. The area to be annexed be entirely surrounded by or be
solely owned by the annexing municipality; and
WHEREAS, 100% of the landowners in the South Harmony Annexation area
have signed a petition for annexation; and
WHEREAS, not less than one -sixth (1/6th) of the perimeter of the area
to be annexed is contiguous with the City of Fort Collins and a community
of interest exists between the territory to be annexed and the City of Fort
Collins; and the territory to be annexed is urban or will be urbanized in
the near future; and such territory is integrated or is capable of being
integrated with the City of Fort Collins; and
WHEREAS, no election is required and no additional terms and
conditions are to be imposed in connection with this annexation; and
WHEREAS, the Council has found and determined and does hereby find and
determine that said petition is in substantial compliance with the
annexation laws of the State of Colorado and that the territory is eligible
for annexation, and the City Council desires to annex the same to the City
of Fort Collins; and
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS:
Section 1. That the following described property
A tract of land situate in Sections 5 and 6, Township 6 North, Range
68 West of the Sixth P.M., Larimer County, Colorado which considering
the West line of the Southwest 1/4 of said Section 5 as bearing N 00'
24' 30" W and with all bearings contained herein relative thereto is
contained within the boundary lines which begin at the West 1/4
corner of said Section 5 and run thence along the West line of the
Northwest 1/4 of said Section 5, N 00' 23' 07" W 2430.79 feet to a
point on the South right-of-way line of Colorado State Highway No.
68, thence along said South right-of-way line, S 89° 37' 06" E 30.00
feet, and again N 45' 00' 09" E 70.20 feet, and again S 89' 37' 06" E
4226.90 feet, and again S 87' 05' 06" E 113.20 feet, and again N 87'
30' S4" E 581.10 feet, and again N 83' 49' 54" E 218.60 feet, and
again S 48' 51' 36" E 66.38 feet, and again N 83' 50' 12" E 31.05
feet to a point on the East line of the Northeast 1/4 of said Section
5; thence along said East line, S 010 45' 07" E 2259.47 feet; thence N
89° 58' 22" W 2677.03 feet to the North- South centerline of said
Section 5; thence along said centerline, S 01' 01' 20" E 1491.48 feet
to the South line of the North 1/2 of the Southwest 1/4 of said
Section 5; thence along said South line, S 89' 39' 35" W 2691.31 feet
to a point on the West line of the Southwest 1/4 of said Section 5;
thence along said West line, N 00' 24' 30" W 277.86 feet; thence N
800 21' 10" W 1956.72 feet to a point on the East right-of-way line of
the Union Pacific Railroad; thence along said East right-of-way line,
N 140 30' 38" E 731.03 feet to the North line of the Southeast 1/4 of
said Section 7; thence along said North line, S 89' 52' 33" E 1738.53
feet to the point of beginning containing 406.5867 acres more or less.
be, and it hereby is, annexed to the City of Fort Collins and made a part
of said City, to be known as the South Harmony Annexation.
Section 2. That in annexing said territory to the City of Fort
Collins, the City of Fort Collins does not assume any obligation respecting
the construction of water mains, sewer lines, gas mains, electric service
lines, streets or any other services or utilities in connection with the
territory hereby annexed except as may be provided by the ordinances of the
City of Fort Collins.
Section 3. That within ninety (90) days from the date this Ordinance
becomes effective, no building permit shall be issued for any of the lands
herein described unless said lands have been zoned under the zoning ordi-
nances of the City.
Introduced, considered favorably on first reading, and ordered
published this 21st day of January, A.D. 1986, and to be presented for
final passage on the 4th day of February, A.D. 1986.
