RODEMERIiER, RE�_,RDER - LARIIER COUITY CO STATE DOC FEE- $.00 ORDINANCE NO. 106, 1987 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING ORDINANCE NO. 55, 1987, OF SAID COUNCIL ANNEXING PROPERTY KNOWN AS THE DUECK COLORADO PROPERTIES, LTD. ANNEXATION TO THE CITY OF FORT COLLINS, COLORADO WHEREAS, by Ordinance No. 55, 1987, the Council of the City of Fort Collins did annex certain property known as the Dueck Colorado Properties, Ltd. Annexation; and WHEREAS, the legal description, as set forth in Ordinance No. 55, 1987, contained certain errors and omissions which may lead to confusion as to the land annexed; and WHEREAS, the Council of the City of Fort Collins has determined that it is in the best interests of the citizens of the City and the general public that said Ordinance be amended to describe with greater precision and accuracy the land intended to be annexed. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the legal description contained in Section 1 of Ordinance No. 55, 1987, be amended to read as follows: That portion of Sections 13 and 14, Township 6 North, Range 69 West of t:he 6th Principal Meridian, Larimer County, Colorado, being more particularly described as follows: Considering the West line of the Northwest One -Quarter of said Section 13 as bearing North 00°03'30" West and with all bearings contained herein relative thereto: Beginning at the West One -Quarter corner of said Section 13, thence along the West line of said Northwest One -Quarter North 00°03'30" West 1330.52 feet, thence South 88°47'08" West 46.70 feet to a point on the Westerly right of way of U.S. Highway 287; thence North 00°05'00" East, 234.68 feet along said right-of-way; thence North 89'56'30" East, 99.99 feet to a point on the Easterly right-of-way of U.S. Highway 287, said point: also being the Northwest corner of that certain parcel of land described in deed recorded in Book 1108, Page 489 records of said County, thence along the Northerly and Easterly line of said parcel of land described in said Book and Page, South 83' 52'00" East, 873.44 feet and again South 00'05'00" West, 969.12 feet; thence South 27°55'28" West, 25.66 feet to a point on the Northerly line of the Halcyon Annexation to the City of Fort Collins, Colorado, thence along said Northerly line the following 12 courses and distances: North 47'50'03" West, 143.01 feet; North 38°47'25" West, 137.28 feet; South 70°08'41" West, 114.83 feet; North 78'06'41" West, 38.83 feet; South 76°49'39" West, 48.27 feet; North 87°52'44" West, 27.02 feet; South 56'07'45" West, 87.92 feet; South 32'40'13" West 264.91 feet; South 170 12'34" West, 118.30 feet; South 16°10'43" West, 168.68 feet; South 03003'59" East 95.00 feet; North 89°48'47" West, 152.37 feet to a point on the Easterly right-of-way of U.S. Highway 287, thence leaving said right-of-way North 89°48'47" West, 50.00 feet to the point of beginning. Said parcel contains 23.37 acres more or less and is subject to all existing easements and rights -of -way of record or as now in use. Introduced, considered favorably on first reading, and ordered published this 7th day of July, A.D., 1987, and to be presented for final passage on the 21st day of July, A.D. 1987. ANNEXATION TO THE CITY OF FORT COLLINS, COLORADO WHEREAS, Article II, Section 30 of the Constitution of the State of Colorado requires that one of the following conditions be met before an unincorporated area be annexed to a municipality: 1. The question of annexation be submitted to a vote of the landowners and registered electors of the area to be annexed and the majority of such persons voting, vote in favor of annexation; or 2. The annexing municipality receive a petition for annexation signed by more than 50% of the landowners in the area who own more than 50% of the land; or 3. The area to be annexed be entirely surrounded by or be solely owned by the annexing municipality; and WHEREAS, 100% of the landowners in the Dueck Colorado Properties, Ltd. Annexation area have signed a petition for annexation; and WHEREAS, not less than one -sixth (1/6th) of the perimeter of the area to be annexed is contiguous with the City of Fort Collins and a community of interest exists between the territory to be annexed and the City of Fort Collins; and the territory to be annexed is urban or will be urbanized in the near future; and such territory is integrated or is capable of being integrated with the City of Fort Collins; and WHEREAS, no election is required and no additional terms and conditions are to be imposed in connection with this annexation; and WHEREAS, the Council has found and determined and does hereby find and determine that said petition is in substantial compliance with the annexation laws of the State of Colorado and that the territory is eligible for annexation, and the City Council desires to annex the same to the City of Fort Collins; and NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. That the following described property be, and hereby is, annexed to the City of Fort Collins and made a part of said City, to be known as the Dueck Colorado Properties, Ltd. Annexation. That in annexing said territory to the City of Fort Collins, the City of Fort Collins does not assume any obligation respecting the construction of water mains, sewer lines, gas mains, electric service lines, streets or any other services or utilities in connection with the territory hereby annexed except as may be provided by the ordinances of the City of Fort Collins. Section 3. That no building permit shall be issued for any of the lands herein described unless said lands have been zoned under the zoning ordinances of the City.
