RCPTN # 200202.4764 03/06/2002 13:37:00 # PAGES - 3 FEE - $15.00 M RODENBERGER RECORDER, LARIMER COUNTY CO STATE DOC FEE - $.00 ORDINANCE NO. 025, 2002 OF THE COUNCIL OF THE CITY OF FORT COLLINS ANNEXING PROPERTY KNOWN AS THE WEBSTER FARM ANNEXATION TO THE CITY OF FORT COLLINS, COLORADO WHEREAS, Resolution 2001-165 finding substantial compliance and initiating annexation proceedings, has heretofore been adopted by the Council of the City of Fort Collins; and WHEREAS, the Council does hereby find and determine that it is in the best interests of the City to annex said area to the City. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the following described property, to wit: A PARCEL OF LAND BEING PART OF THE SOUTHWEST QUARTER (SW 1/4) OF SECTION FOUR (4), THE SOUTHEAST QUARTER (SEI/4) OF SECTION FIVE (5), AND THE NORTHWEST QUARTER (NW 1/4) OF SECTION NINE (9), ALL IN TOWNSHIP SIX NORTH (T.6N.), RANGE SIXTY-EIGHT WEST (R.68W.) OF THE SIXTH PRINCIPAL MERIDIAN (6TH P.M.), COUNTY OF LARIMER, STATE OF COLORADO AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT THE WEST QUARTER CORNER OF SAID SECTION 4 AND ASSUMING THE WEST LINE OF SAID SW 1/4 AS BEARING SOUTH 01 "45'54" EAST, BEING A GRID BEARING OF THE COLORADO STATE PLANE COORDINATE SYSTEM, NORTH ZONE, NORTH AMERICAN DATUM 1983/92, A DISTANCE OF 2553.31 FEET WITH ALL OTHER BEARINGS CONTAINED HEREIN RELATIVE THERETO: THENCE SOUTH 88°53'29" EAST ALONG THE NORTH LINE OF SAID SW 1/4 A DISTANCE OF 30.04 FEET TO THE EAST R.O.W. LINE OF SAID LCR #9; THENCE NORTH 01 "45'54" WEST ALONG THE EAST R.O.W. LINE OF SAID LCR #9 A DISTANCE OF 626.10 FEET TO THE TRUE POINT OF BEGINNING. SAID DESCRIBED PARCEL OF LAND CONTAINS 156.249 ACRES, MORE OR LESS (±) AND IS SUBJECT TO ANY RIGHTS -OF -WAY OR OTHER EASEMENTS AS GRANTED OR RESERVED BY INSTRUMENTS OF RECORD OR AS NOW EXISTING ON SAID DESCRIBED PARCEL OF LAND. be, and hereby is, annexed to the City of Fort Collins and made a part of said City, to be known as the Annexation. Section 2. That, in annexing said property to the City, the City does not assume any obligation respecting the construction of water mains, sewer lines, gas mains, electric service lines, streets or any other services or utilities in connection with the property hereby annexed except as may be provided by the ordinances of the City. Section 3. That the City hereby consents, pursuant to Section 37-45-136(3.6), C.R.S., to the inclusion of said property into the Municipal Subdistrict, Northern Colorado Water Conservancy District. Introduced, considered favorably on first reading, and ordered published this 5th day of February, A.D. 2002. and to be presented for final passage on the 19th day of February, A.D. 2002.
