Subject: Alley improvements
The city has required us to improve the alley way that is located in city right of way
adjacent to our property as part of our development of the site. We are prepared to do so.
At the City's suggestion, we surveyed the alley and have found that three large trees are
located within the right of way. Because of there proximity to the neighboring property,
we had requested a 4 foot variance to construct a 16 foot wide alley versus a 20 foot wide
alley. While, the city engineer said they would support this variance, they would do so
only if we made a statement that we deem impossible to make without the city providing
significantly more design and planning that would be required as a standard expectation
when redesigning roads.
In that context we are prepared to do either of the following:
• Cadence Development will remove the trees that are located in the right of way,
and pave the alley to be the standard 20 feet wide as required by code. Since the
right of way belongs to the City, the city will be responsible for enforcing their
right of way if the neighboring owner's object.
Alternatively:
• In the event that the City wants to preserve the elm trees in the alley, Cadence
Development wiI I build the alley at 16 feet wide. We will agree in the variance
that when the City decides that they would like to widen the alley in accordance
with the North College Long term access plan, Cadence Development will pay to
have the trees removed with the City enforcing their right of way.
