EASEMENT FOR CONSTRUCTION AND MAINTENANCE OF PUBLIC UTILITIES
Reorganized Church of Jesus Christ of Latter bay Saints, hereinafter referred to as 'the
Grantor", of the County of Lorimer, State of Colorado, does hereby grant and convey to the City
of Fort Collins, Colorado, a municipal corporation, its licensees, successors and assigns,
hereinafter referred to collectively as "the Grantee", in consideration of the payment by the
Grantee of the sum of $10.00, and other good and valuable consideration, receipt of which is
hereby acknowledged, a right-of-way and easement for the installation and continued operation,
maintenance, repair, alteration, inspection, and replacement of the public utilities of the
Grantee, (including, without limitation, cable television) in, on, under, across, and above the
following premises, belonging to the Grantor in Larimer County, State of Colorado, in the
following location;
Beginning at a point which is 3 feet South of the Northwest corner of Lot 24,
Block 131 of the City of Fort Collins, County of Larimer, State of Colorado;
thence South 10 feet; thence East 10 feet; thence North 10 feet: thence West
10 feet to the Point of Beginning;
Together with all rights of ingress and egress necessary for full and complete use, occupation,
and enjoyment of the easement hereby granted, and all rights and privileges incident thereto,
including the right, as becomes necessary, to cut, trim, and remove trees, brush, overhanging
branches, and other obstructions which may injure or interfere with the Grantee's public utility
system. The Grantee shall be responsible for the reasonable restoration of the Grantor's
property upon completion of installation or otherwise compensate the Grantor for damage done
during construction or subsequent reentry for repair or reconstruction purposes. The Grantor
states that it is the lawful owner in fee simple of the real property described herein; that it
has a good and lawful right and authority to grant, sell, and convey said property or any part
thereof and that it warrants the title of said property.
Grantee will be responsible for the consequences of its own negligence and that of its
employees, agents, contractors and invitees, and will hold Grantor, Grantor's successors,
assigns, agents, and other representatives harmless from any and all demands, claims, causes of
action, fines, damages (including consequential damages), liabilities, judgments, and expenses
(including without limitation reasonable attorneys' fees and court costs) resulting from or
arising out of (1) the negligence of Grantee or any person claiming under Grantee or the
employees, agents, contractors or invitees of Grantee; or (2) any breach, violation, or
nonperformance by Grantee or any person claiming under Grantee or the employees, agents,
contractors or invitees of Grantee of any term, covenant, or provision of this easement or any
law, ordinance, or governmental requirement applicable to Grantee.
