Re: Whalers Cove Subdivision
Dear Mr. Gardner:
It has come to my attention that the pavement on Bluefin
Court, in the 1st Phase of Whalers Cove, is showing severe
distress in several areas.
An investigation of these areas revealed that pavement
thickness was one inch. This indicates that the cracking
is due to deficient asphalt thickness, and not to settling
utility trenches.
Therefore, the pavement in Bluefin Court cannot be accepted
by the City of Fort Collins until approved repairs are made.
Please notify this department at least 24 hours before the
start of any repairs.
If you have any questions, please do not hesitate to call.

along the northwest dike from a point approximately sixty (60)
to seventy (70) feet northwest of the southeast corner of the
reservoir. It is recommended that the concrete in this area be
removed and either broken up and reused as riprap or that
riprap be imported and placed at the site. If imported riprap is
used, it should consist of hard, durable rock approved by the
geotechnical engineer. The upstream face of the dam in this
area should by graded on a minimum 2:1 slope. This may be
accomplished by the placement of the riprap.
2. it is recommended that the downstream slope of the dam along
the northwest dike be flattened to 2:1 slopes in areas where 2:1
slopes do not exist. In addition, the abaodcr,cd irrigation
and/or drainage ditch .located at the toe of the slope should be
filled in with a minimum of three (3) to four (4) feet of fill.
The ditch should be filled from the southeast corner of, the dam
where it enters the Spring Canyon Ditch to where the ditch ends
a distance of approximately five hundred fifty (550) feet to the
northwest.
3. All vegetation should be removed from the areas to be filled.
Dead wood, tree stumps, limbs, and other debris should also be
removed from the ditch. Large trees growing on the dike and
along the trench need not, be removed, and the new fill should
be graded around the trees. After vegetation, dead limbs, and
brush has been removed from the area the fill may be placed.
The fill should consist of material approved by the geotechnical
engineer. It is anticipated that material from the bottom of the
reservoir will be utilized for embankment material. This material
should be inspected by the geotechnical engineer prior to its use
to determine its suitability. The fill should be placed in uniform
six (6) to eight (8) inch lifts and mechanically compacted at or
near optimum moisture to at least ninety percent (90%) of
Standard Proctor Density ASTM D 698-78. The fill should be
graded and benched slightly into the --existing slope where
necessary and graded around existing trees to protect them.
Use of timber or stone retaining walls may be required in certain
areas to protect the large cottonwood trees along the dike and
ditch banks. Field density tests should be taken in the thicker
sections of the compacted fill to verify that proper compaction
and placement of fill has taken place. Upon proper placement of
the fill, it is recommended that the filled areas be seeded to
minimize erosion.
4. A small abandoned ditch or channel is located along the toe of
the southwest portion of the Harmony Reservoir dike. It is
recommended that this dike be filled in the Fame manner as
di,uissed above for a minin-,um distance of a;. � roximately fifty
(50) feet beyond the southeast corner of the dike.

It is recommended that backfill behind the existing concrete
slope protection that is... to remain be reworked in areas where
.the backfill behind the concrete has eroded. It is recommended
that additional backfill be placed In the eroded areas to minimize
the potential of future erosion. The backfill should consist of a
clayey material approved by the geotechnical engineer and
mechanically comp%cted in uniform lifts to at least ninety percent
(90%) of Standard Proctor Density ASTM D 698-78.
It is our opinion that if the above repairs are made and the
is kept at elevation 5007 or below, the potential for failure of the
Reservoir dam will be minimal.

RE: Drainage Problem at Whalers Cove
Tom Balland of Kiefer Concrete and I met this morning at the site to discuss the
following problem:
It seems the curb opening inlet and the concrete cross pan on Sandy Cove Lane
were built in the wrong place. The drainage swale located in the open space to
the north does not align correctly with the existing 15" RCP under the street.
The culvert is located at the east edge of the open space and ends directly
behind the walk. The swale runs down the center. Please see the attached
blueline of the grading plan and sketch.
To correct the problem it was decided to construct a manhole behind the walk and
run 15" concrete pipe northwest from the manhole to intercept the existing swale
instead of moving the swale over. If the swale were moved over to the east it
would be too close to an existing house to build the correct cross section
without encroaching onto the property. I advised him that a 4:1 side slope from
the back of walk would be the maximum the City would allow. Therefore if the
culvert is 4' deep as the plans indicate the inlet end of the culvert should be
approximately 16' north of the back of walk.
I talked with Bonnie and she indicated that "as built" revisions to the Utility
Plans will be necessary and I left a message with Kiefer indicating this. We
need to make sure Kiefer provides an engineer to correct the drawings. Please
contact me before approval of the construction is given and I will check if the
drawings have been revised. Or if it is necesary we can have the drawings
revised prior to the start of construction. Please call and let me know.

improvements in a portion of the Whalers Cove Development. The

building permits for lots 19, 21-24, 26, 41-45, 45A, 109 and 116.
However, these lots requiring the construction of handicap ramps and
sidewalks will be required to have these improvements installed prior to
issuance of certificates of occupancy. Also, all lots with damaged

Dear Jay,
Recently there have been inquiries from local builders as to the status
of the Whalers Cove P.U.D. for building permits. After much discussion
with our attorney we have been advised not to issue any further permits
until the storm drainage requirements have been fulfilled.
Our legal staff's interpretation of the Whalers Cove utility agreement
is that all storm drainage facilities were to have been completed in
conjunction with the street paving of Blue Fin and Harpoon Courts and
Seaway Circle. As you are aware, these streets have been completed
yet the storm drainage facilities are only partially constructed.
The intent of this letter is to inform you that no further building
permits will be issued for the Whalers Cove P.U.D. until the remaining
storm drainage facilities are complete. This includes berms, fine
grading, seeding, riprap, associated concrete work and all other
requirements as shown on the approved Whalers Cove utility plans;
In addition, the Storm Drainage Division will need a letter from your
engineer verifying sizes and elevations.

I am in receipt of your June 15, 1984 letter pertaining
to the above -referenced matter. In confirmation of that letter
and our earlier telephone conversations, I appreciate your having
taken immediate steps to complete the storm drainage require-
ments as outlined by Dave Stringer.
I recognize your concern that building permits be issued
to builders in the Whaler's Cove P.U.D. As I had indicated
to you over the telephone, I will speak to Dave Stringer on
a case by case basis with regard to these building permits
if, and when, requests for issuance of building permits are
presented to the City. If such a request should be presented
to the City, and if substantial on -site activities have been
conducted by Osprey toward completing the storm drainage facil-
ities, then I suspect that Dave would be amenable to the issuance
of such a building permit. I doubt that he would be amenable
to the issuance of a building permit if it did not appear
to him that the storm drainage facilities were proceeding rapidly
toward completion.

When you and our Inspector Matt Baker met on the job site on
July 15, 1980 he was informed that your firm intends to use
Boardwalk Drive and Whalers Way as the main access roads to
service the other areas under development. He stated at that
time that all stub outs had to be pressure tested and approved
prior to the placement of the asphalt mat. The reasons for this
are to avoid cutting into a newly surfaced street or possible
contractor conflicts in the event the utility contractor should
change before the completion of the project.
When your contractor pressure tested this line he elected not
to test these stubs in conjunction with the twelve (12") main.
He was at this time informed each stub out would have to be
tested individually before any street paving.
In order to avoid any conflict at the time you have scheduled
the street improvements, I ask that you make sure all the necessary
testing and approvals have been taken care of prior to the
placement of base course and asphalt materials.

I have been asked by Carl Nelson of your firm for an update on the status
of the public improvements in the Whalers Cove Planned Unit Development.
The intent of this letter is to relay this information as it concerns
Lots 19, 21-24, 26, 41-45, 45A, 109 and 116.
The water and sewer mains with services, streets, curbs, gutters and
those installed portions of sidewalk, major storm drainage improvements
and appurtenances have been inspected and accepted by the City of Fort Collins.
The following items will not affect the issuance of building permits but,
their completion will be required prior to the issuance of Certificates
of Occupancy:
Existing sidewalks appear to be in good repair with the exception

In accordance with Paragraph 3, Exhibit "A" of the agreement for
The Pier Condominiums at The Landings, PUD dated October 16, 1979,
please be advised that the City is hereby notifying you that
improvements for Harmony Road, as it abutts The Pier Condominiums PUD,
are currently being installed under Lemay-Harmony SPECIAL IMPROVEMENT
DISTRICT #78. The cost for these improvements is being borne by the
City's Street Oversizing Fund. The City will be expecting Osprey, Inc.
to reimburse the Oversizing Fund in compliance with City Code 99-6(F).
As soon as final costs are reported by the contractor and verified by
the Project Manager, we will send you a detailed statement of these costs.
If you have any questions concerning this notice, please feel free
to call on me. I will be away from the office from October loth through
October 19th and October 26th and 29th.

Re: Lemay Avenue Sidewalk at Whalers Cove PUD
Gentlemen:
Prior to the approval of the Breakwater Estates development just north
of the Whalers Cove PUD, they were required to install a seven (7) foot
sidewalk adjacent to Lemay Avenue. This development is currently in
the process of completing the required public improvements including
the Lemay Avenue sidewalk. Therefore, it is in the City's interest
to require Osprey as the developer of the Whalers Cove development,
to install the seven (7) foot sidewalk adjacent to Lemay as designed
on the Golden Meadows, 2nd Filing, utility plans.
The construction of this sidewalk should begin immediately as the
weather permits and is to be completed by April 30, 1986.

Dear Reid:
Several months ago I wrote to Landings Limited requesting the installation
of the seven (7) foot sidewalk on Lemay Avenue adjacent to the Whalers Cove
Planned Unit Development. At the time of my initial correspondence it was
suggested that this work be completed by April 30, 1986. However, the City
was never informed of your firm's intent and as of this date the sidewalk
has not been installed.
Once again I must request that this sidewalk be installed as originally
designed. Even though the construction season is quickly coming to a
close, there are a few weeks of good construction working weather for the
completion of the work this year.

Re: Requested Drainage Easement from the Archdiocese of
Denver
Dear Mr. Horan:
Yesterday, I met with a representative of the developer
of the Landings, Ltd., in Fort Collins and his attorney
relating to a drainage easement which the developer has been
unable to obtain to adequately drain storm water from his
development.
As I believe you are aware, the master n_lan for storm
drainage of the entire area has already been approved by the
City of Fort Collins and provides that the storm drainage,
in following the historical and natural drainage pattern,
would flow in part across the southerly portion of property
in the area owned by the Archdiocese of Denver.
It is my understanding that the developer, on his own
and through his attorney, Jack Vahrenwald, has made contact
with representatives of the Church, including yourself, in
attempts to gain a drainage easement in that area.
It is further my understanding in talking with the City
Engineers that the granting of this drainage easement would
make it very easy for the Church, upon development of its
property in that area, to comply with the Citv drainage require-
ments. The Church would, as a part of the development of the
property, have to submit to the City a drainage plan and the
drainage plan could encompass the use of the drainage channel
which will have been placed across the property by the developer
of the Landings, Ltd. The alternative to this would be that
the Church would independently have to meet all of the City's
storm drainage requirements, conceivably including a large
det
en on facility on the Church property.

At this point then, it is our opinion, first, that a
drainage easement is necessary and required across the southern
forty feet of the property owned by the Archdiocese of Denver
in order to comply with drainage requirements imposed by the
City for the Landings development. Secondly, it is our opinion
that, in providing such a drainage easement, the Church will be
benefitted because it will allow the Church to comply with all
drainage requirements of the City at such time as the Church
property develops.
For these reasons, we would request on behalf of the City
that the Archdiocese of Denver agree to provide a drainage
easement for a drainage channel with the understanding that the
developers of the Landings will complete the construction of
the drainage channel at the same time as the other drainage
facilities included on the overall master drainage plan are
completed.
I would appreciate being advised as soon as possible of
the Church's position.

It has recently been brought to my attention that the storm drainage swede
which serves Bluefin Court has not been completed.
Upon my field investigation of the channel, several items which are
unacceptable to the City were noted. Following is a list of these items:
I The entire channel from Bluefin Court to detention Pond C is mat
constructed per City approved utility plans dated March 30, 1979
1 The swale appears to be outside of its easement
Telephone pedestals were installed in the bottom of the existing swale
I An earth dam has been constructed at the south end of the Swale
I The eastern portion of detention Pond C is not complete.
As you are aware, your firm agreed to construct this swale along with the
eastern portion of detention Pond C at the completion of improvements for
Bluefin and Harpoon Courts. I feel the City has been more than cooperative
up to this point. There are numerous hones built on both cul-de-sacs.
Most of these hones were issued building permits and certificates of occupancy
prior to or during the initial construction of the existing swale.
After much discussion with the development and storm drainage engineers it has
been decided that the City will not release any further building permits or
certficates of occupancy in this area until the items noted above have been
corrected. When this detention system is constructed to the lines and grades
shown on the approved utility drawings, the City will then accept this system.

Dear Dennis:
As requested I have addressed the potential for water surface
rise in Harmony Reservoir prior to construction of a release
structure incorporating elevation control of the water surface.
I have not made an exhaustive investigation of all drainage plans
that have been prepared for the area. Instead I have relied on
the information you have given me. The assumptions and
calculations in the Master Storm Drainage Report for the
Landings P.U.D. dated January 1979 are accepted as reported
except for one addition.
Approximately 14 acres bounded by Landings Drive, Boardwalk Drive
and the Larimer #2 will discharge to Harmony Reservoir. This
brings the total acreage draining to the lake, including the
lake, to about 90 acres. Hence the 100 year - 3 hour storm under
fully developed conditions would raise the water surface 9-1/2
inches not 8 inches as reported.
From our conversations the issue is the impact on the pond if a
major storm were to occur today. Presently, the lands west of the
Larimer #2 and the lands south of Boardwalk do not drain to the
reservoir. Only Landings IV and the lake itself contribute to the
storm water inflow. This is a 50 to 55 acre basin. Further
Landings IV is less than one half developed so a runoff to rainfall
coefficient of 0.40 or lower is justified. The NOAA Atlas gives
the 100 year - 24 hour precipitation in Fort Collins as 4.75
inches. This frequency of storm is an accepted standard for flood
protection.

Under current conditions the 14 acre reservoir would raise 7 to
7-1/2 inches during a 100 year - 24 hour event.

Attached is a letter to Dennis Donovan from Empire Labs dated September 21, 1983
regarding the recommended repairs to Harmony Reservoir for your information. I
received this letter from Gerry Mayham who is with the Single Family Division of
the Subdivisions Unit at the Department of Housing and Urban Development in
Denver.
I talked with Mr. Mayham last week about what was going on with Dennis Donovan
and Whalers Cove. I didn't find out any new information except that Mr. Mayham
was much more worried about the structural soundness of the reservoir than
Dennis Donovan had indicated. Mr. Mayham did indicate that if the water level
was controlled improvements to the embankment would probably not be necessary.
Mr. Mayham has also talked with a Mr. Degrave and Mr. Eric Wilkerson of the
State of Colorado Division of Water Resources and they both indicate that the
embankment of the reservoir needs work unless the water level is somehow
controlled.
While talking with Mr. Mayham he asked me if we (the City) have any concerns
regarding the reservoir. I indicated that as far as I knew we have not
investigated the embankment in any detail. Should we look into this matter a
little more regarding the condition of the embankment or leave it up to the
State and Federal people to enforce additional work on the embankment if
necessary?

Empire Laboratories, Inc. has reviewed our "Report of a Soils and
Foundat4on Investigation" prepared for Harmony, Reservoir dated September
9, 1980 as well as the additional 'recommendations set forth in a letter
C dated January 5, 1983 to George Alan Holley and Associates, P.C.,
Golden, Colorado regarding the repair of the above -referenced reservoir.
Empire Laboratories, Inc, met with Mr. Dennis Donovan at the site on
September 7 and 14, 1983. At the time of the second inspection, Larry
Intermill from Intermill Surveying was also present. As stated in our
letter of January 5, 1983. It is our understanding that the reservoir is to
be used as a detention facility, and the water level is to be kept at
elevation 5007 or below. The one hundred (100) year flood will raise the
reservoir to elevation 5007.7. The top of the dam is between elevation
5011.0 and 5011.5 and not at elevation 5010 as previously interpreted.
This allows for a normal free board of between four (4) and four and
one-half (4-1/2) feet. Based on the above information, our additional
inspections, and our previous studies, the following amended
recommendations, in our opinion, will be required to ensure the stability of
the Harmony Reservoir Dam:
1. Complete removal of the existing concrete slope protection will
not be required in our opinion since the majority of the concrete
will not be exposed to the water surface. However, a portion of
the concrete slope protection, which is in bad disrepair, is
subject to wave action and water contact and should be removed
and replaced. This portion of the concrete slope protection
extends for a distance of approximately two hundred (200) feet
