This letter will verify our telephone conversation of this morning
regarding the outfall storm sewer for Wagon Wheel subdivision.
I mentioned that we have not retained a consultant to design the out -
fall as we had planned. We are adding an engineer to our staff, and
propose to have that individual complete this design. It is still
our intention to construct the storm sewer this summer.
I understand that the subdivision agreements for the first and second
filings of Wagon Wheel Subdivision require the completion of the cut -
fall storm sewer prior to the issuance of a certain number of building
permits or certificates of occupancy. As I have indicated in the past,
Inasmuch as you do not have any control over the construction of this
storm sewer and the project has been delayed well beyond our original
schedule, the City will not refuse to grant permits because the out -
fall has not been constructed. However, this does not waive the
requirement of installing any on -site drainage improvements within the
specified time frame. Internal storm sewer should be installed and
detention ponds roughly graded as per approved plans.
I hope this clears up any remaining questions concerning this matter.
I'll try to keep you informed of any progress we make on the outfall.

Dear Dave,
In response to your letter dated June 28, 1983 regarding the condition of
the streets in Wagon Wheel Subdivision and our phone conversation of July 7, 1983
Melody Homes agrees to repair the damaged asphalt in as timely a manner as possible.
We expect to begin work by July 15, 1983.
Repairs are to be a combination of 5" patching, reconstruction with 22" mat,
and overlay. The areas to be repaired in each of the above manner will be determined
by agreement between myself and your inspector as work progresses.
In return for this agreement, the City of Fort Collins will issue Certificates of
Occupancy on Lyman Street, Laredo Lane, S rps Street and Nez.Perce with no delay.

Re: Wagon Wheel, 2nd Filing
Dear Gary:
It has come to my attention the water service trenches installed by
R&M Construction in the recently constructed portion of Wagon Wheel,
2nd Filing, have not met the City's compaction requirements.
The City's Construction Inspectors have spent many hours testing these
trenches for the contractor and have not recorded any acceptable tests.
It is our opinion the contractor's equipment and workmanship were not
adequate to obtain the necessary results.
Please be informed that the City Engineer's office will not allow any
further street construction on Casa Grande, Sioux Boulevard, San Houston,
Sweeney, Boone, Bowie and Ottawa Streets until such time as the required
state of compaction has been obtained in all of the service trenches in
the above streets and rights -of -way. In addition, if your general utility
contractor chooses to use R&M Construction for the required work, he is to
insure the quality of equipment and workmanship of his subcontractor is
such to obtain the City's requirements for compaction. The City does
reserve the right to not allow R&M Construction the opportunity to work
in our community if their work methods and equipment are not sufficient
to meet our requirements.
I regret the inconvenience this may cause your firm, but I'm sure you
understand the need for stable soil conditions under streets, gutters
and sidewalks.

Melody Construction Co. was required to have a second point of access
for Wagon Wheel Filing No. 2 as a condition of the approval of the plat.
Because of the fact sales were so horrible, resulting in our temporary
closure of the project, followed by the subsequent re -opening at a furious
rate of sales, we overlooked this requirement.
Please accept this letter as Melody's assurance that this oversight will
be rectified by construction of at least the west half of Bowie from our
North property line to Swallow by May 15, 1984, weather permitting.
Additionally, if you are able to work out the details with Pavlakis, we
are willing to construct the east half of the same stretch of road. At
this time, the details have not been worked out with Dan Jensen for construct-
ing his portion of Bowie now, although I anticipate no problem in this regard.
I understand from our earlier discussions that this letter will be sufficient
to enable Melody to obtain building permits and continue it's construction
program.

Re: Bowie Avenue Extension at Swallow Road
Dear Gary:
Per our meetings regarding the extension of Bowie Avenue by Melody Homes
from the north property boundary of the Wagon Wheel development to
Swallow Road, I list the following:
- The existing fire hydrant at the southeast corner will be relocated
by the City Water Department. This work is to be completed by
July 26, 1985.
- The existing curb and gutter radii on Swallow which do not match
the street alignment of Bowie are to be completely removed.
Melody will be reimbursed the cost of the new installation of
these radii and crosspan by the City.
- This construction of Bowie will satisfy the Wagon Wheel developments
access requirements as per the subdivision agreement.

Dear Steve,
In response to your concern for the combination curb, gutter and
sidewalk installation along the front of your property at 3218 Gatlin St.,
this letter is being written to document the meeting which took place at
4:30 p.m. on June.17, 1981 at your residence.
It was acknowledged at this meeting by Mr. Pat Walker of the Flatiron
Company that the sidewalk was installed incorrectly with a reverse slope
or flat condition. This condition has been identified to the Ft. Collins
City Engineering Dept. and Melody Construction Co. At that time, it was
agreed by all parties that, based on the lateral drainage in the section
of the street, we leave the installation as is rather than risking further
problems resulting from re -work.
Mr. Pat Walker identified that an extended warranty of three years,
in addition to the required two years, was provided by Flatiron Company
(copies attached) and so documented with the City.
It was also agreed at this meeting by all parties that a continued
surveillance of any problems resulting from this installation would be
monitored and corrective action, if required, would take place.
It is the responsibility of Melody Construction Co. to deliver good
homes to its customers, which includes the sidewalks, streets and all
other applicable services related to the homes. I would like to further
assure you that we will join you in monitoring this sidewalk installation
and any corrective action which might be required. We are also confident
that the Flatiron Company will assume full responsibility for their
portion of this agreement.

As per your request for a final inspection on the paving in the above referenced
subdivisions, this letter is to inform you that there are some minor problems
that the City will require to be corrected before final acceptance.
0 At the intersection of Casa Grande and Hickock there is an area between
the sanitary sewer manhole and the water main valve boxes that has settled
and ponds water.
0 At the intersection of Sioux and Sweeney there is a settling area that ponds
water.
0 On Sioux Boulevard, approximately 150-feet east of Gatlin, there is an area
that is settling and ponds water.
0 At the intersection of Nez Perce Way and Sharps Street there is some pavement
damage. It appeared to me that a backhoe's outriggers had punched holes in
the asphalt mat, possibly during the manhole raising operation.
Although these items appear to be minor problems, the City will not accept these
streets until the above items have been corrected. When repairs are completed,
I will accept all streets pending the normal contractor warranty periods.

Please be advised that this acceptance does not relieve the developer

Dear Mr. Peterson:
Mr. Pat Clark of Melody Homes Incorporated has expressed to me your con-
cerns regarding the Public sidewalks adjacent to your property.
When this sidewalk was initially constructed the Concrete Contractors and
Developers informed the City of an error with its installation. Upon much
discussion and evaluation of this problem the City decided to accept those
portions of sidewalk, curb and gutter already constructed.
This decision was based upon:
A. The Foundation height of the proposed structures was such that water
run off would easily flow over the walk and into the gutter.
B. The reverse slope on the existing walk sections averaged one -quarter
inch or less (a large portion of sidewalk was level).
C. Due to the existing terrian all surface water would flow laterially
or transversely across the sidewalk and into the street.
In order to reinforce this decision these sidewalks have been monitored
for the past several months.
It has been noted that when the sidewalks are free of snow the water does
drain. In fact due to the terrian these sidewalks are free of snow run
off sooner than the sidewalks in the flater areas of the subdivision.
It is our opinion that the present sidewalks situation does not nor will
not pose a hazard to pedestrian safety. In response to your concerns re-
garding the freezing of run off water on your sidewalk during the winter
months this is a natural occurrence. In the winter months this happens
throughout the entire city regardless of the type of curb, gutter and
sidewalk.
Ewen though this sidewalk does have a slight degree of reverse slope the
problems you are experiencing with it are not much different than new how
owners in other partially completed subdivisions.

0n Friday May 21, 1982 I meet with Mr. Pat Walker of F & F Concrete construction
Company regarding the combination curb, gutter and walk adjacent to your
property at 3218 Gatlin Street. In my meeting with Pat the areas of water
ponding were discussed,particularly the northwest corner of your lot. In order
to correct this area the only alternative is to replace the curb, gutter and
walk from the north edge of your driveway to the north property corner. In
addition, the curb, gutter and walk at your driveway will be replaced with a
drive approch. The replacement of the concrete at the driveway will allow an
escape for the surface flows from the lot to the south.
The curb, gutter, and walk at the driveway to the south will be replaced with a
drive approch. This will allow for a major portion of the runoff water to exit
into the street prior to reaching your property. The runoff water that will
exit at your driveway will be from the back yards of you and your neighbor, and
a certain amount from the front yard to the south.
This work is to be started some time around the second week of June. The timing
of the construction was discussed and F&F personnel are aware of your situation
and will try to work with you has best they can.
It must be understood that the whole street system is intended to act as a
floodway. This also includes the sidewalk area. The city does reserve the
right to accept any portion or portions of Public Right of Way street
construction which functions as it was intended regardless of its nonconformity
with its design.

Dear Mr. Peterson:
On Friday May 21, 1982 I meet with Mr. Pat Walker of F&F Concrete Construction
Company regarding the water runoff problem you are experencing at 3224 Gatlin
Street. In my discussion with Pat several alternatives were presented on how to
solve your problem as well as Mr. Wolfs.
The best alternative to correct the problem at your lot is to remove the
combination curb, gutter and sidewalk adjacent to your driveway. This area will
then be replaced with a drive approach. The drive approach will allow the
runoff water from the south to exit into the gutter. This will eliminate a
large portion of the water that presently flows behind the sidewalk along the
front of your house. However, runoff from your front yard will continue as it
presently exsists with the exception that it will flow into the gutter at Mr.
Wolf's driveway. Drainage from your back yard will also exit at this point.
This work is scheduled for sometime around the second week of June. If this
time schedule is not acceptable please contact me so other arrangements can be
made. F&F has expressed a desire to reconstruct the sidewalks, curbs, and
gutters at your and Mr. Wolfs' residences simultaneously .
It must be understood that the whole street system is designed to act as a

Re: Wagonwheel Subdivision
I recently visited Melody Homes' Wagonwheel Subdivision and noticed some
concerns which need to be brought to your attention.
One item, which has grown increasingly worse, is that of street surface
abuse by Melody's building contractors and subcontractors. The major
abuse is in the areas presently under construction. The street surfaces
are becoming coated with a heavy layer of mud and gravel debris. As you
know, this does cause drainage problems and greatly contributes to abrasion
and premature deterioration of the asphalt pavements. I also observed
that several areas on Laredo and on Sharps Streets have portions of asphalt
pavement that have cracked in an extensive alligator pattern. These areas
are being used as a main access for the delivery of building materials
including drywall and concrete. Also the surface is coated with mud which
is helping to accelerate the damage by holding in the moisture.
The intent of this letter is to inform Melody Homes that the City will not
assume the responsibility of maintaining those streets or street areas
in need of repair.
Therefore, I would appreciate a response from you or a representative
of Melody Homes as soon as possible. Also; please be informed that
Certificates of Occupancies for the homes on Laredo and Sharps Streets
will not be issued until such time a mutual agreement for the above problems
has been obtained.
