This letter is to confirm in writing that the electric vault in the
detention pond at Silverplume Estates may remain at its present
location (approximately 6 — 10 feet north of the existing bank near
Swallow Road). The bank around the vault must be blended with the
existing contours in a manner which will allow easy access for mowing.

RE: SilverPlume Estates Bridge Construction
Dear Mr. Pitner:
Last fall your firm received a letter from the City stating our desire to have
the monies held in escrow with Home Federal Savings for the construction of the
SilverPlume Estates bridge transferred to the City's account. Additionally, you
attended several meetings in the City's Engineering office to discuss the
construction of the bridge instead of transferring the escrow account. At the
last meeting you indicated you were going to solicit bids from several
contractors and, if the bids were acceptable, construct the bridge.
It has been almost a year since the letter and our last meeting. To date, the
bridge has not been completed, nor has the escrow been transferred to the City.
The bridge question is still unanswered. The time for action has come.
The intent of this letter is to demand that you escrow with the City the sum of
$61,171.50 plus the amount of interest it would have earned if the monies would
have been in our account as of May 6, 1987. At such time as the escrow has been
established in the City's account, your obligations as described in the Agreement
dated August 27, 1986 will be fulfilled. The City will then accept full
responsibility for the construction of the bridge.
Hopefully, this matter can be resolved quickly and without further action
becoming necessary. Please contact me at your earliest convenience to confirm
an acceptable interest amount and arrange the transfer of funds to the City's
account.

Re: Escrow Silverplume Estates
Dear Mr. Pitner:
As we discussed in recent weeks, the City does request that the
funds currently being held in escrow for the Silverplume Estates
bridge be transferred to its account. I now have the adjusted
figure for the construction costs as determined by Matt Baker of
our office. Matt has given me the sum of $75,189.97 as the amount
to be escrowed with the City for the Swallow Road bridge in the
Silverplume Estates Development. Matt calculated what he feels is
a "reasonable and prudent" charge of 5.00 % simple interest per
annum over the 55 month period from May 6, 1987 to December 6, 1991
on the $61,171.50. This translates to $75,189.97.
Hopefully, this figure is agreeable to you and the escrow currently
with Home Federal Savings can be transferred to the Citys, account.

Dear Mr. Pitner:
For several years now the City of Fort Collins has been working with you to
resolve the issue of a box culvert over Spring Creek in the Silverplume Estates
Development.
As we have discussed throughout the past years, the City requires that funds
currently being held by Home Federal be placed into the City's account. In fact,
my letter to you dated January 7, 1992, states that $75,189.97 was the amount to
be transferred into the City's account by your firm.
As you may recall, last winter the City was in the process of figuring out what
the total amount would be based upon an inflation factor. At that time your
request to us was to allow you to sign over the account to the City in order for
you to avoid some type of tax issue. Then you would make up the difference
between what is in the Home Federal account and the inflated amount. Based upon
this information you were allowed to sign off on the account and the letter dated
January 7, 1992, was sent to you. However, I have not received any response from
you regarding this matter and it is now time to get it resolved.
I am requesting that you contact me by October 5, 1992, at 221-6605 to discuss
and resolve this issue. Your prompt attention to this matter is appreciated.

Per Exhibit "A" of the Development Agreement for Silverplume Estates dated
June 29, 1983, the City is hereby requesting that you construct the bridge
for Swallow Road across the by-pass channel in Tract "A". According to the
agreement this is to be completed within one year from the date of receipt
of this letter. Another option that is available to you, per City Code, is
the option to escrow funds with the City to cover the costs of construction
of the bridge plus a contingency. If you desire to use the escrow o tion

Dear Dick,
This memo is to clarify the City oversizing portion of the
bridge on Swallow Road. In the development agreement for
this subdivision, the City agrees to repay the developer
for oversizing the bridge from local street width to collector
street width.
Our policy is to repay the developer for the center 14-feet
of a collector street. (See attached diagram) The City,
therefore, would pay for the center 14-feet of the bridge.
When you submit your itemized invoice for repayment,
please include unit prices as much as possible to help
me in checking how you calculated the oversizing portion.
If you have any additional questions, please feel free

Re: Bridge over Trend -Cedar channel at West Swallow Road
This memorandum serves as a response to your inquiry concerning the proposed
bridge over the Trend -Cedar channel at West Swallow road. I have researched
numerous files related to this by-pass channel to determine the role of the
Stormwater utility in the construction of the bridge. The following
information has been collected:
- The Silverplume Estates Subdivision development agreement states that a
by-pass channel for off -site flows through the area will be constructed
in coordination with construction of Rossborough second filing storm
drainage facilities. This channel, as stated above, is the Trend -Cedar
channel. It was constructed as part of the Cedar Village sixth filing
development in coordination with the Rossborough facilities. The
constructed channel extended approximately to Swallow road along the west
property line of Cedar Village sixth.
- The Cedar Village sixth storm drainage report states that the channel was
designed for a one hundred year storm discharge of 464 cfs. A freeboard
allowance of 33% was included, bringing capacity to 617 cfs. The report
references a Rossborough storm drainage report by Stewart Engineering for
hydrologic -and hydraulic information. This study was not found in
Stormwater or Engineering files.
- In 1986, the Trend -Cedar outfall was constructed to provide a means to
transport the above discharge to Spring Creek. The Stormwater department
paid for the project. The Engineer involved was Bobbi Dunham. The project
extended the existing open channel to the north and connected it to a new
box culvert which outfalls at Spring Creek. Both sections were designed
for a capacity of 397 cfs.
- The development agreements for both the Cedar Village 6th and Silverplume
Estates state the responsibility of the developer involved to construct
the bridge in question over the by-pass channel by the end of calendar
year 1986 or to deposit funds into an escrow account for construction at
a later date.
- The total amount to be deposited in the bridge account is $61,171.50
(150% of $40,781, the estimated cost of the bridge without oversizing).
The funds are currently being held in account 010186363 at Home Federal
Savings in Fort Collins. The current balance is $56,342.71. The city is
under obligation to utilize and expend these funds in a reasonable and
prompt manner upon receipt of the total sum by the bridge account.

Dick Pitner received a memorandum outlining the monetary responsibility of
the city should Swallow road be used as a collector street. The inference
here is that possible oversizing of the bridge would be due to requirements
of city departments other than Stormwater.
Dave Stringer did mention to me that Bobbi Dunham was closely involved with
the set-up of the escrow account. However, I have found no documentation
that the Stormwater department was intended to manage the bridge
construction and/or pay for oversizing.

RE: Trend - Cedar Channel Bridge Cost Estimate
I nave reviewed the plans prepared by RBD in :?83 (Revised
1986) for the Silverplume Estates tor try to determine the
sl-ze, type and cost of the proposed bridge at the west end cf
Swallow road.
After cursory review of the plans and related cost estimates
from recent, similar bridge projects (ie. LaPorte bridge), I
believe the proposed precast box culvert will cost nearly
$95.000, including a 10% contingency.
Background:
Plans were prepared in 1983 for the subdivision that included
a Twin Tee structure and revised in 1986 to substitute two
4-sided 4'>c10' precast box culverts for the Twin Tees. I
assumed the precast for- estimating purposes. The overall
dimensions are about 24 x 60' very close to the overall
dimensions of the LaPorte bridge. Direct similar line item
costs for construction of the LaPorte bridge were taken from
the contract (low bid) with the contractor and summed with a
li3Y, contingency. Other costs reviewed are as follows:

The attached correspondence was received in addition to the
plan drawings, explaining the funds available and the division
of responsibilities for the construction of the bridge. The
funds available are $56,342.71, with s61,1T1.5J expecte .
Note the agreement does not include an "oversized" bridge.
The width of the proposed bridge is a little less than 60 feet
with 4'6" walks and parapet walls on both sides, or Sii1 feet
flow line to flow line.

Dear Mr. Pitner:
This letter is to clarify the City's position concerning the Swallow Road
bridge construction in the Silverplume Estates Planned Unit Development.
In our earlier conversation we discussed the need to transfer the bridge
from Home Federal Savings to the City's escrow account. As you are aware,
monies were required to be escrowed prior to the release of each building
permit in lieu of constructing the bridge. With the issuance of the last
building permit for this project, we had to decide if the bridge should be
built or have the escrowed monies put into the City account. After
discussing this situation with the City Stormwater Utility Department, it
has been determined that the bridge should not be constructed at this time.
Therefore, we request the transfer of the funds escrowed with Home Federal
Savings to the City escrow account.
In reviewing the Silverplume Estates Development agreement with the
Director of Engineering, we found the amount to be placed in escrow as of
May 6, 1987 to be $61,171.50. Using the $61,000 figure with interest rates
of 7 to 8.5 percent per year, we have calculated the interest from May 6,
1987 to September 6, 1990 at $18,502.85. The original escrow amount plus
interest brings the total amount to be escrowed to $79,674.35.
