Box 1417 Fort Collins, Colorado 80522 Re: Kensington South Subdivisions Dear Rex: Some weeks ago you met with Marc Engemoen and myself to discuss the detention system in the Kensington South 1st Filing as it relates to building permits. In our meeting you indicated the remaining improvements to the detention system would be completed as soon as possible. In turn, the City agreed not to withhold building permits in the Kensington South Subdivisions because of the drainage system. To date the City has released building permits for homes on Hastings, Canterbury and Knottingham streets. However, work towards completing the drainage system has not yet started. The City has operated in good faith towards its portion of the agreement and now requests the drainage system be completed. In addition, after the pond's completion a letter from your engineer to the Storm Drainage Utility, certifying the drainage system has been constructed to the lines and grades shown on the Kensington South 1st Filing Utility Plans as approved by the City Engineer must be submitted. If the drainage system is not completed by July 31, 1983, the City Engineer's office will withhold all building permits in the Kensington South Subdivisions. All permits requested from now to the July 31st date will be handled on an individual basis. I regret the inconvenience this may cause you, but the Kensington developments have expanded to the point where completion of the pond is necessary. Apparently the pan is higher than the bottom of the pond. This will result in water standing in the pond bottom, which makes the pond difficult to maintain. You will need to regrade the bottom, perhaps bringing in some fill, before we can accept the pond for perpetual maintenance. I suggest you and your earthwork contractor meet with Dave Stringer at the site before regrading to determine exactly what is necessary. Once the pond is acceptable, the City will take over perpetual maintenance. After talking with our right-of-way agent, the best way to handle this is for you to prepare a warranty deed and send it to us. We will check to see if there are any outstanding taxes, liens, etc. and if not, we will send it to Council for approval and have it recorded. Since ely, Ma c Engemoen Civil Engineer II CITY OF FORT COLLINS DEVELOPMENT SERVICES — ENGINEERING October 14, 1986 Mr. Rex Miller Miller Development Company 3200 Azalea Drive Fort Collins, Colorado 80526 Re: The Square at Kensington South Dear Rex: It has been brought to my attention by the Kensington South Homeowners Association that a sidewalk located at the south end of Canterbury Court and going south to the property line of Rocky Mountain High School has never been installed. After looking into this matter, there is a sidewalk that is shown on the utility plan. The City agrees with the homeowners that this sidewalk needs to be installed inorder to allow access for the students to the high school grounds. On October 13, 1986 I contacted Keith Goosman with the Poudre R-1 School District, Grounds and Maintenance, and he informed me that they have the gate and fence materials on hand and as soon as the sidewalk is complete, they will install the gate to line-up with the sidewalk. Therefore, the City is requiring that the developer install the sidewalk as soon as possible this construction season or no later than November 14, 1986.
