I am working on the plans for additional phases of the Sunstone
development. It is important for our planning purposes and the
financing of the project to have sound information on the schedule,
and requirements for the improvement of Timerline Road adjacent to
Sunstone. We understand construction in Phase 4 will be limited to 33
building permits and at that time additional improvements to the
arterial will be necessary.
Can you please describe to us what those improvements may include?
Because I am relatively new to the project, I am not certain what
orginal agreements for phasing the improvements were approved.
Acceleration and deceleration lanes from Caribou have been built.
Were they already constructed at the required base and width standards
required for arterials? Are the additions of curb, gutter and
sidewalk the only remaining construction required at these points?
What additional improvements would be required beyond the taper of the
aceleration lane? A simple diagram may help me to understand more
clearly the existing and future street construction.
What has been the street oversizing reimbursement paid to date and
what portion of the required additional street construction would be
eligible for street oversizing?
I appreciate your help and effort to bring me up to speed. With a
better understanding of the street construction, I can manage the
nrojent and work with the City more efficiently. I am available and

This letter is to inform you that the utilities and public improvements on
the City right-of-way have been inspected and initially accepted by the
City of Fort Collins, pending the normal contractor's warranty period.
Please be informed that this letter of acceptance does not relieve the

the building construction.
I have done a preliminary walk-through of the site and have made a punch
list of items that require attention.
1. Paint the fire hydrants.
2. Clean out all inlets (dirt & debris) and grout insides as necessary.
3. Install Type III barricades at the east end of Stoney Creek Drive.
4. Raise water valve box, first one off of Caribou on Stoney Creek Drive.
5. Remove and replace S.W. radius on Stoneridge Court at Caribou where it is
broken and repair broken water valve box.
6. Install erosion control (straw bales as per detail) at outlet to east
detention pond.
7. Install rip -rap east end 18" A.D.S. pipe (outlet) off of Stoneridge Court
east end of pipe at inlet to detention pond.
8. Install rip -rap north end of A.D.S. pipe outlet of detention pond just sout
of Caribou Road.
9. Grout the inside of the two sanitary sewer manholes on Caribou.
10. Straighten hydrants on Summerstone Court, Suncrest Court, 1st one south off
off of Caribou on Stoneridge Drive.
11. Turn hydrant on Summerstone Court.

This letter is to inform you that all public improvements on the City
right-of-aay have been inspected and initially accepted by the City of Fort
Collins, pending the normal contractor's warranty period.
Please be informed that this letter of acceptance does not relieve the
developer or the contractors, lot owners, or their contractors of their
responsibility for the repair of any damage which may occur as a result of
the building construction.
I have done a final walk-through of the site with Mr. Dick Schmidt on
September 26, 1990, and have inspected all of the punch list items. All
of the items on the punch list have been done and are acceptable.
However, after doing a flow test of the curb and gutters, it was discovered
that all areas of this filing have adequate flow with the exception of the
northwest radius at the intersection of Simmmerstone Court and Stoney Creek
Drive. CG&S as well as Schmidt Earth Builders have been informed of the
problem area. The City of Fort Collins feels that this area will require
grinding of the flowline, or possibly removal and replacement of the
concrete at the radius. Since the contractors have been contacted, the
repair should be done within thirty (30) days from the date of this letter
to assure that adequate drainage is achieved before bad weather.

minimal site work is required to correct the drainage swa-le.
between lots 43 and 44. Standardly, this work would be
certified prior to the building permit and again at the
Certificate of Occupancy. With the conditions as they are at
resent, we would prefer that we do this work when the weather
is warmer.
Super Group, Inc. will be responsible for the necessary site
work to be completed as soon as possible. We will also alert
the builder and owners of the work to be done so that they do
not exacerbate the problem with final grading and landscaping.
With this assurance that the work and certification will be
completed, I appreciate your willingness to release the
building permit on 43.

Dear Mr. Wadsworth:
This letter is to remind you of our discussion several months ago concerning the
two areas of curb and gutter that need attention due to drainage problems.
o The southwest corner of Stoney Creek Drive and Summerstone Court to
include the walk, curb and gutter, and crosspan.
o Both corners at the intersection of Stoneridge Drive and Bridgestone
Court to include crosspan and curb and gutter.
These areas will require a survey to determine the flow capability and limits,
if any needed to correct the problem. Due to the length of time that these areas
were first mentioned to you, 30 days from June 17, 1991, will be given to you to
correct the above areas to the standards outlined by the City of Fort Collins.

This letter is written to acknowledge that Geneva Homes, Inc. is committed
to completion of trickle storm drainage pans on the 6th and 5th Filing of the
referenced subdivision.
The contractors cost for the improvements are as follows:
1. 250 feet of 2 foot wide pan at $5.50 per linear foot =
$1,375.
2. One each curb chase at $650.
We have provided an Erosion Control Bond for the 6th filing of Sunstone in
the amount of $3,108. All of the measures have been completed except a $200
sediment trap. The sediment trap, as well as the concrete pans are scheduled
for completion when weather and ground conditions allow.
We would like to continue to obtain building permits in the 6th filing as
buyers for our homes allow. Therefore, we respectfully request that you
place an additional constraint on our erosion control monies currently on
deposit that none of the security is eligible for release from your accounts
until the above mentioned drainage pan improvements have been completed.
If this arrangement is satisfactory with you, please so indicate by
initialing and returning a copy of this letter to our office. Please call

I am writing you this letter on behalf of Super Group, Inc.,
which has contracted to buy approximately twenty acres that will
become the fifth filing of Sunstone Village in Southeast Fort Collins.
Super Group does not yet own the ground; it hopes to close the
purchase of it in early 1990.
These twenty acres are part of what was known as Parcel G when
an Agreement was made among the City and various landowners, back
in 1977. A copy of that Agreement is enclosed with this letter.
Also enclosed with this letter is a copy of a letter written to
my client on December 6, 1989, by Brian Hahn. As you will see, Mr.
Hahn states that Super Group must pay the entire $25,833.19 allocated
by the 1977 Agreement to Parcel G, before receiving any building
permits.
Paul, our objection is to the imposition of the entire cost
allocated to the eighty acres, when Super Group's ground is only
about one-fourth of Parcel G. The 1977 Agreement clearly requires
apportionment of the cost, as development occurs in phases, rather
than triggering the entire charge for a parcel when the first
development occurs within the parcel. See the language at pages 3 and
4 of the Agreement which specifically sets forth a plan of payment

in phases, based upon the ratio of developed land. The relevant
language spans the bottom of page 3 and the top of page 4 and spells
out the fact that nothing is due until development occurs, and then
only to the extent of such development. The critical language appears
at the top of page 4: "As the Developer's lands are developed, payment
of the Developer's share of the cost of the line shall be made to
the City with such payment to be the same percentage of that Developer's
cost as the percentage of his lands developed." As I mentioned
above, the parties could have agreed to trigger the entire obligation
when any development occurred in a parcel, but that repayment format
was not adopted.
The unfairness of seeking to impose the entire repayment
obligation on the first portion of a Parcel to be developed is
highlighted by the fact that this Parcel, at least, will soon have
fragmented ownership. All of the owners within this Parcel will
ultimately benefit from the sanitary sewer, and the burden should
not be placed just on one owner.
Paul, I realize that you may wish to discuss this matter with
Mr. Hahn and, perhaps, with Mike Herzig, the engineer involved, to
get the full background, particularly on the exact acreage involved.
The explicit language of the Agreement, however, mandates the
portioning out of this obligation. I would appreciate your giving me
a call on this matter at your early convenience.

Dear Lin:
Thank you for meeting out at the site of bike path Thursday to discuss the details
of the new construction with Mr. Dale Miller of Connell Resources. The purpose of
this letter is to establish an understanding of the construction of the bike path
known as the Sunstone Channel Bike Path (path) located next to residence of Lin
Johnson (homeowner), contracted by The Group, Inc. (developer). The work is to be
performed by Connell Resources (contractor) with assistance by Landmark Engineer-
ing (engineer) and supervised and inspected by the City Engineering Department and
the City Stormwater Utility (City). This improvement is being constructed as part
of the P.U.D. requirements of Sunstone Village 4th Filing. Based on our conversation,
the following represents a summation of our discussion:
I. You (homeowner) will remove the pickets and rails of the side yard fence
beginning at the easternmost section and proceed back to the west as far as the first
post that supports the sideyard gate. The post and gate are to remain at this time.
However, it is agreed by all the parties that if there is a critical design constraint
in path construction due to the remaining fence and gate, then the gate and fence
will be removed only as far back to the west as necessary to accomplish the con-
struction. The City and/or contractor will assist in this removal. The decision to
further remove the gate and its posts will be made in the field with the consulta-
tion of the homeowner.
2. The City will remove the posts that, because of concrete, are impossible for the
homeowner to dismantle. The City will store these posts on the homeowner's prop-
erty in a location that is acceptable to the homeowner. The homeowner agrees to
allow the City's fence crew to enter the property to store the posts.
3. The City agrees to reimburse the homeowner for any expenses incurred to
replace the posts and subsequent concrete. This reimbursement shall be made by the
Stormwater Utility upon receipt of paid invoices.
4. In order to facilitate construction of the bike path in the storm drainage tract,
the homeowner agrees to remove, or hold harmless all other parties, the existing
underground lawn watering sprinkler system. Only that portion of the underground
sprinkler system that encroaches onto the storm drainage tract will have to be
removed or indemnified.
5. It is agreed that Landmark Engineering will accurately stake the affected side
property line for purposes of establishing the true boundary of the property.
6. It is acknowledged by all the parties that homeowner's gate and supporting
posts are very important structures to be undisturbed to the best extent possible. It
is also acknowledged that not removing the gate will cause the contractor to exercise
a certain level of caution and decreases the flexibility of the available equipment
that typically is involved in a project of this nature. Consequently, the homeowner
will work closely with the contractor and offer assistance wherever needed to
contribute to the preservation of the gate and posts.
7. It is acknowledged by all the parties that the path, upon rising up out of the
channel and achieving the grade of the street, will curve to the south to intersect
with the existing attached sidewalk along Caribou Drive. The purpose of this curve
is to discourage potential cutting across the homeowner's property. In addition,
there will not be a ramp at Caribou Street. The existing vertical curb will remain.
This will also discourage cutting across the yard.
8. In response to the homeowner's request that the riprap that is surrounding the
culvert, that is scheduled to be removed, be placed adjacent to the homeowner's
front yard, the Stormwater Utility must decline. The idea of removing the riprap is
to keep it out of the channel and to remove the temptation for youngsters to throw
the rocks into the channel. Placing next to the front yard does not effectively
remove this temptation. The riprap will not be available for use adjacent to the
homeowner's yard.
9. The homeowner and the City acknowledge the presence of a roof drain system
that outlets into the channel. Since it is likely that the path construction will
affect this system, the homeowner must consult with the Stormwater Utility for a
re -design that does not negatively impact the path or cause soil erosion along the
banks of the channel. The homeowner acknowledges the urgency of this re -design
and relocation due to the construction schedule of the path.
10. The City and the homeowner acknowledge the fact that it is difficult to
visualize the location of the path and the grade of the slope toward the home-
owner's property. The parties acknowledge that the grade of this slope is critical
for purposes of minimizing soil erosion and for long term maintenance of ground
cover by hand mowing. Consequently, the City reserves the right to use the area of
the drainage tract that is not devoted to the path to grade in such a manner to
accomplish effective soil erosion and long term maintenance. It is further acknowl-
edged that such erosion control may take the form of a retaining wall if proper
slopes cannot be established.
Il. It is acknowledged by all parties that for reason of bicycle safety, there must
be an absolute minimum of three (3) foot separation from the back of the path to
any fence. Any distance greater than this minimum is preferred.
12. It is acknowledged by all the parties that the design objective is to establish a
safe, functional, attractive bike path that will become an asset and neighborhood
amenity. In order to accomplish this objective, the grade on the path should not
exceed the grade of a typical handicap ramp. This grade is 12%.

Construction is scheduled to begin the week of April 23, 1990. Landmark Engineer-
ing will begin with surveying and staking. Connell Resources will be responsible for
grading, forming, paving, and finishing the concrete. Connell Resources will also
remove the riprap from the culvert area. Landscaping will be done by Bath Lands-
caping at a later date.
Lin, I hope you find these points to be an accurate summary of our discussion.
Please call me immediately if you have a different interpretation. It is our sincere
hope that the construction does not cause any inconvenience on your part. Glen
Schlueter will be available during construction should any issue need further
discussion.
