This existing sanitary sewer main is no longer in use and the new sewer main is in service. Therefore, since the conditions mentioned on the plat have occured, I believe that the existing utility easement is abandoned. If you have any questions or comments, please call me at 221-6681. PZ92-15 OF THE PLANNING AND ZONING BOARD OF THE CITY OF FORT COLLINS VACATING A UTILITY EASEMENT LOCATED IN THE HIGH POINTE P.U.D. WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the Planning and Zoning Board to vacate certain rights -of -way, by resolution or by approval of replats containing notation of such vacation; and WHEREAS, the City of Fort Collins Utility Services Water and Wastewater Division, City of Fort Collins, Larimer County, Colorado, has requested vacation of a utility easement on a portion of Lots 15, 16, 17, and 18 and a portion of Tracts C and D in the High Pointe P.U.D.; and WHEREAS, said easement is no longer necessary and the vacation request has been reviewed and approved by the pertinent City and private utilities and they have no objections. NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City of Fort Collins that the utility easement more particularly described per Book 2233, Page 1790, recorded August 22, 1983 at the Larimer County Clerk and Recorder, State of Colorado, be and is hereby vacated.
