Horsetooth Rd. Fort Collins, CO. 80526 Dear Mr. Strauss, The City Staff has completed its review of Rossborough, Fourth Filling, and has the following comments: 1. Please provide a letter, submitted by an engineer, that states the replat does/doesn't affect runoff. If any increase is expected it must be addressed. 2. A repay exists on the water line in Horsetooth and Taft. Payment must be made for Rossborough's entire frontage along these water lines before any permits are issued in the 4th filing. 3. The plans do not show an existing side easement on lot #156. Any reloca- tion of existing facilities will be at the developers expense. 4. Mountain Bell requests a 6' easement on the east property line of lots 81 and 102. 5. The development agreement needs to be amended to cover the improvements to Taft Hill and the ,timing for removing the factory. 6. There was a landscape plan which addresses landscape, fencing, and retain- ing walls along Taft Hill and Horsetooth when the project was approved. Please address how this replat effects this plan. We may need a revised landscape plan. 7. There are a couple of streets with out names, please provide the names on the plans. PMT reductions of all plans, color renderings, and 10 full size copies of all plans are due by Monday April 18 1988 All final documents are due by Thursday April 21 1988. The final documents should include the development agreement, signed mylars, and signed landscape covenants. The reason for the replat is to=change the covenants. The impervious ground cover will not change and therefore the storm water runoff is not affected. Roger Strauss will work with the Water Department regarding the repay for the water line in Horsetooth and Taft Hill Roads. The repay should not be required until building permits are applied for on the lots West of Dunbar Avenue. Trend Homes built and paid for the water line on Horsetooth Road from their East property line to Dunbar Avenue. The lots East of Dunbar Avenue included in the Fourth Filing therefore should not trigger the repay. Mike Herzig is taking care of the amended development agreement regarding Taft Hill Road improvements and the removal of the factory. The replat does not affect the landscape plan for Horsetooth Road and Taft Hill Road. The lots do not change. The landscaping has been completed on Horsetooth Road. The fencing on both roads and the landscaping on Taft Hill Road will be done when they finish the improvements on Taft Hill Road. call. President Deve )went Services Engineering Department November 27, 1989 Jeff Strauss Tri-Trend Homes 1800 West Horsetooth Road Fort Collins, Colorado 80526 Re: Rossborough 3rd anda4Filings Dear Mr. Strauss: Earlier this year I wrote a letter regarding the need to complete the storm drainage improvements within the Rossborough developments. In this letter dated April 24, 1989 there were several items noted which need to be cmPleted or the City would withhold all permits until such time as the required work was finished. Consequently, Drexel/Burrell Engineering contacted the City Storm Drainage Department on an occasional basis to inquire about the status of the drainage in Rossborough. It is our understanding that they were acting on behalf of Tri-Trend. However, as of this date the necessary work has not been coupleted nor has the City received any communication from the Engineer or your firm as to what the plans are for addressing the storm drainage concerns. It is my belief that the City has tried to work with your firm in resolving the storm drainage issue and has allowed over three tines the allotted 43 permits for the 3rd Filing as was stated in the Development Agreement for the 3n9 and 4th Filings. As you may recall, all of the storm drainage irprovements east of Dunbar were to be co npleted prior to the release of the 43xd permit, and all improvements were to be completed in the Rossborough developments prior to the release of the 151st permit in the 3rd and 4th Filings. As of this date my records indicate 121 permits have been issued for these filings, which is 30 permits shy of the allowable 151 for those improvements on the west side of Dunbar. Unfortunately, the east side of Dunbar has basically been built without completing the improvements as required, forcing us to demand the corpletion of the storm drainage improvements in order to protect the health and welfare of those living on the east side of Dunbar. ovu �drune avenue • t-.u. box 06U • Fart Collins, CO 80522-0580 • (303) 221.6605 Jeff Strauss Page Two Please be informed that as of December 10, 1989 the City will not issue any additional permits within the Rossborough developments until such time as the east side improvements are completed and/or some arrangements for their completion are agreed upon by the Storm Drainage Department. Additionally, I strongly suggest that the remaining improvements be the develo coacent throughout development. Without the needed iimprovementsaadjacent ed to the irrigation ditch, it is my opinion that your firm and the City are assuming some liabilities that neither of us want should a flooding storm occur. I realize you may feel the City is being harsh, but the storm drainage system for the Rossborough developments have been in a half completed state for several years and probably will not function as intended if a storm should occur. It is our desire that this system be completed and certified that it is properly constructed as designed. Box 580 4840 Pearl East Circle Fort Collins, CO 80522-0580 Suite 114 Attn: Rodney Albers Boulder, Colorado 80301 RE: Rossborough 4th Filing Drainage Amendment 303 442 4338 Dear Rodney: This letter is in reference to grade changes in Kent Court and Kent Way and the effect on the currently approved drainage design prepared by James Stewart & Associates and approved by the City of Fort Collins. The only changes to the existing design were slight changes in the road grade of both roads. Kent Way road grade increased from .48% to .64%. Kent Court road grade increased from 2.45% to 2.64% from Sta. 3+50 to the end of the cul-de-sac. All storm inlets, manholes, pipe grades, size and locations remained the same as in the previously approved design. The increase in road grade results in an insignificant increase in the time of concentration and does not materially change the storm water run-off or capacities. From your letter it is my understanding that the City has performed the necessary testing of the installation and construction of the water mains, sanitary sewer mains, storm sewer lines and facilities, street pavements, street lights and street signs. That these tests have met or exceed the City's requirements and the construction warranty period of one year begins the date of your letter, September 26, 1990 and final acceptance, pending repairs, is September 26, 1991. The streets included are Enfield Court, Lots 86 thru 93, Kent Court, Lots 25 thru 42 and Kent Way, Lots 77 thru 80.
