Home Federal Savings has been involved in the development
of Regency Park in Southwest Fort Collins since we squired
the property via foreclosure in early 1987. At present,
work on the project is substantially complete. We do however
have a number of items to complete that are fronting on
adjoining property. For this reason we do not have completed
costs schedules to apply for reimbursement agreement with
landowner through city. Is it possible to gain extension of
time to file for a reimbursement? We should complete all
work in the next 30-60 days and substantiate all costs at
that time. For your information, streets and utilities were
accepted January 11, 1988. Please call if I may be of any
assistance.

To Whom It May Concern:
Several weeks ago while driving through the Regency Park development, I
noticed several areas where the asphalt pavement was beginning to collapse.
Upon further visual investigation, the cause of the pavement failure
appeared to be a result of trench settlement, either water and/or sewer.
While monitoring of these areas for approximately 2 weeks, the settlements
are increasing in size. In addition, the settlement at Regency Court has
created a void under and along the crosspan. The depth of this void and
its extent is undetermined, yet appears to be quite extensive.
Please be informed that the size of these settlements is such that warning
lights and signs are needed to warn motorists in this development.
FUrthermore, this development is under contractors and developers warranty.
The City will not accept any public inprovements in this development until
the cause of these failures has been determined and the necessary repairs
have been made to our satisfaction.

performed by the contractor for Poudre R-1 School District. It is my
understanding that the construction of the listed items was the
responsibility of the Regency Park Development, but was constructed by the
school district's contractor to expedite their construction.
I believe the changes are self-explanatory and appear to be fair. However,
if you have any questions, please contact Mr. Jay Davis of Parsons &
Associates for further clarification.

Re: Regency Park street settlement and drive approaches
Dear Mr. Schuster:
As you are aware, prior to the Regency Park replat the existing development
was platted multi -family and in the construction process driveway
approaches were installed at numerous locations throughout the development.
These were to serve as single points of access for the cluster units.
However, with the replat from multi -family to single family units, many of
the existing driveways do not fit the new lots, creating depressed curbs in
mid lot or some area other then at the driveway location. This type of
situation creates a pedestrian hazard which needs to be corrected. Also,
if a property currently has a depressed curb which does not line up with
the proposed driveway and a property owner elects to install a new drive
approach, this then depresses the curb a greater distance which will cause
drainage problems as well as create a pedestrian and traffic hazard.
While driving through the development, I noticed two houses currently under
construction where the above driveway condition exists. one of these homes
is on a lot that has access restrictions and driveway approaches are
required. Therefore, I must ask that all existing driveway approaches
which do not function as they are intended when the new structure is built,
are to be removed and replaced with straight curb, gutter and walk. This
requirement must be completed prior to the release of the Certificate of
Occupancy for that building.
I regret the inconvenience this requirement may pose. However, there is a
safety issue with the potential conflict between an existing drive approach
and a newly constructed one. It is important that driveways which are not
going to be used are closed.

Another problem which is causing me concern, is that of additional street
failure over the utility trenches. As I was checking the drive approach
situation, I noticed another street failure on Hilburn Drive at
approximately lot 3 block 1. As you are aware, this is another of several
sections of street which are exhibiting street failures over utility
installations constructed with this development. Based upon the number of
failures which have already occurred, I question the integrity of the
backfill and compaction work in the utility trenches throughout this
development. With this in mind, the City will not accept this project
until the adequacy of the backfill and compaction has been determined to be
satisfactory. Please be informed that your firm, as the developer, is
responsible for providing the City with information showing the present
condition of the utility trench backfill and to make any corrections as may
be necessary. In addition, the size and type of settlement does pose a
safety hazard, and warning for motorists is necessary immediately.
Based upon the condition of the streets in this development, we can only
assume the worst. Therefore, we feel non-destructive testing is required
to determine the adequacy of the pavement and subgrade structure. Please
call us to set up a meeting so we can discuss the City's requirements for
this nondestructive testing.
Please contact me as soon as possible on what decisions and actions you
intend to take which will address our concerns regarding the streets and
settlement problems in this development.

Re: Street and traffic signs in the Regency Park
Dear Mr. Developer:
My office has been informed by Dick Wartenbe of the City Traffic Department
that the signs installed in the Regency Park Development are substandard
and do not meet the City's criteria for signs. Dick has talked with your
sign contractor, Rocky Mountain Safety Services, and was not satisfied with
their response. Therefore, as the developer of this project, it is your
responsibility to the City that your sub -contractors provide acceptable
products and work. Please be informed that until such time as the signs
are brought up to the City standard, Certificates of Occupancy will not be
issued for any structure within this development.
If you have any questions regarding specific corrections to the signs in
this development, please contact Dick Wartenbe at 221-6815.

Dear Mr. Stringer;
Please find enclosed the following:
1) Copy of 3 bids and summary page of the individual bids
from Coulson Excavating, Sterling Companies and Flatiron
paving.
2) Letter of credit in favor of the City of Ft. Collins in
the amount of $125,524.50.
The amount of the letter was determind via multiplying 1.5 times the
average bid amount of $83,683.66.
The above are being submitted in order to temporarily honor our
commitment of the Land Development Agreement for Regency Park, as
another developer is presently pursuing development of the land
adjoining the effected section of .Harmony Road.
The term of the letter is one year and should hopefully bridge any
reasonable period to completion. Should the pending applicant not
be successful in the approval process, please contact me so that we
might make the necessary arrangements for the completion of the
Harmony improvements or continuance of the letter, as you require
pursuant to the existing development agreement.

Dear Mr. Jensen:
Late last week one of our inspectors, Craig Farver, notified me of your
concerns regarding the sand and small rocks which were found in the water
system at 1500 Hilburn Drive. Like you, I was concerned that the debris
was a result of irproper installation procedures during the tie of t'_.,
initial water line installation. However, after checking with the City
Water Department and Water Quality Control Laboratory, there have not been
any other instances where this problem has occurred. Once this situation
was found to exist, City crews flushed the main lines and found no further
indication of debris in the line. Additionally, the water system in this
area of town was flushed by City crews during their routine maintenance
procedures in August of 1988.
It is my opinion based upon what has transpired in the months before and
after this occurrence that the dirt and rocks are a result of improper
installation by the plumbing contractor during the construction of this
home, or the debris was inserted into the system by persons unknown during
the construction phase. With this in mind, I do not feel the City was
negligent at the time of the initial installation of the main line system
and is not responsible for paying the plumbing bill submitted by Holter
Plumbing and Heating. However, you do have the option of filing a formal
claim with our Risk Management division. These claim forms can be obtained
at 256 West Mountain.

RE: Regency Park P.U.D. (Lot 23, Block 1)
I have received your electronic message that the storm drainage
basin fee, in the sum of $1,014.73, for Lot 23, Block 1 of
Regency Park P.U.D., has not been paid. You have inquired as to
whether the City could impose a lien on the lot to enforce col-
lection of the fee, and it would be my opinion that you may do so
in accordance with the provisions of the City Code.
You also inquired as to whether the City could withhold future
building permits for lots in Regency Park P.U.D., that are owned
by Progressive Living Structures (the party in default on Lot
23). I have examined the Regency Park P.U.D. file in the City
Clerk's office and found an amendment agreement which indicates
that the development was originally proposed and approved within
the City as the "Village of Harmony West P.U.D., First Filing,"
and subsequently went through several name changes to become
Belair P.U.D. and finally Regency Park P.U.D. I have examined
the development agreement for the Villages of Harmony West
P.U.D., and found in Paragraph 1(h) that:
The Developer shall pay storm drainage basin fees in
accordance with Chapter 93 of the City Code.
I have also found in that development agreement at Paragraph 3(e)
that:
The City may withhold such building permits and cer-
tificates of occupancy as it deems necessary to
ensure performance hereof.
Based upon the fact that the development agreement runs with the
real property as described therein and authorizes the City to
withhold building permits to ensure performance of the agreement,
it would be my opinion that you could do precisely that. I would
recommend, however, that you record a notice of prohibition on
the issuance of building permits on those lots that are owned by
Progressive Living Structures in Regency Park P.U.D., in order to
give public notice of the prohibition. This will prevent any

bona fide purchaser from purchasing a lot from Progressive Living
Structures without notice of the prohibition. I have done this
once before with regard to some lots in Foothills Park Re -
subdivision and Gary Diede signed the notice which was recorded
with the Larimer County Clerk and Recorder. If you could ascer-
tain which lots are presently owned by Progressive Living Struc-
tures, I would be happy to prepare such a notice of prohibition
with respect to those lots. You may need some help from Ron
Mills in finding out which lots are owned by Progressive Living
Structures.

Re: Letter of Credit No. 1990-1, Regency Park P.U.D.
Dear Mr. Zahn:
In January of this year an irrevocable letter of credit was submitted by Home
Federal to the City of Fort Collins in the amount of $45,000. The intent of
these monies was to insure the completion of the remaining public improvements.
It has recently come to my attention that the public improvements in the Regency
Park Development have not been completed and the letter of credit expired on July
10, 1990.
It is my obligation to inform you, as developer of this development, that the
uncompleted improvements are to be constructed this season. As you are aware,
there are many occupied homes in this area. Therefore, it is important to the
City that the remaining improvements be completed.
Please be informed that if work has not started by September 17, 1990 the City
will hold all building permits in the Regency Park development until such time
as the work is completed. I understand this time frame may create a hardship,
however, the construction season is rapidly coming to a close and the work must
be completed prior to the winter season.

Dear Mike,
Thank you for making available the opportunity to resolve the Development
agreement issue prior to P 6 Z approval May 18, 1987.
The amended Development- Agreeement of record now allows unit density ,of 72
,f units prior to any offeite improvements to Harmony Rd. We anticipate this number
11dJ(1 of permit releases remaining the as=. There are currently 9 unite built which
x leaves the project with 63 remaining unite before requirements of Harmony off -
sites are required.
In talking with George Galida the construction manager for Poudre School
District R:1, the completion of Wake Robin In. will be completed from Regency Dr.
East to Shields St. before the end of the summer. We have two points that we
would like to bring forth in light of the construction of Wake Robin Lane.
h Wake Robin Lane will give the second point of access to the project. We
1 would like to ask that a variance be granted to the req+afrement of the immediate
second point of access. We feel limiting sales to only those lots within 660'
'of the point of access to be too limiting to marketing and sales in light of the
fact Wake Robin Lane will be built within the year `1987._; When weighing this
request please remember -that Regency Dr. is built to collector standards which
provides additional width at the ingresslegress.
We don't think it is practical to take dawn a portion of the brick fence
contiguous to Harmony Rd., build a second point of access from Harmony to,,Hilburn
Dr. when the school districts summer construction schedule includes the construction
of Wake Robin In.
We would, if the variance is granted, agree to construct a second point of
access if Wake Robin Lane is not constructed by yearend 1987.
The second point to discuss is that because of the construction of Wake
Robin Ln. to Shields and in light of the number of- permits allowed by the Develop

Dear Mr. Walker:
The intent of this letter is to clarify the City's position with regard to
certain inccanplete improvements within the Regency Park First Filing and
Belair P.U.D.'s as discussed in our meeting of September 17, 1990. The
following items were discussed as follows:
• Concrete pan through bottom of swale adjacent to Harmony Road west of
Regency Drive is to be deleted as per Susan Hayes.
The grass swale adjacent to Harmony Road on the east side of Regency
Drive is to be eliminated as per Susan Hayes.
• The regional detention pond requires minor regrading and seeding which
applies to disturbed areas only. The majority of the pond is acceptable
per Susan Hayes.
• Install the gravel subdrains as shown on the utility plans.
0 The investigation for the granting of the drainage easement on the east
side of Regency and north of Wakercbinn Lane is to be performed by you.
• The channel on the east side of Regency and north of Wakercbin is to be
completed, including final grading, concrete trickle pan, rip -rap, and
seeding.
• The drainage improvements adjacent to
Seneca fronting the
junior high
school are not
a requirement of Regency
Park P.U.D. since
the drainage
facilities were
completed by the school

• The pedestrian access ramps will be installed at Wakercbin and Regency
Drive intersection.
• Delete the sidewalk on the east side of Regency from the south ply
line of the detention pond south of Wakercbin at the Platt property to
Harmony Road.
• Sidewalk on the west side of Regency is required. You agreed to
determine how the bank was selling lots, i.e. - builder or bank
responsible for installing sidewalk and let me know who is responsible.
• Sidewalk on the east side of Regency Drive adjacent to detention pond is
required to be installed by Regency P.U.D.
• Sidewalk of the east side of Regency Drive adjacent ch to the channel north
of Wakercbin Lane, may be required dgmnding upon tt
the dwuiel.
• You were to work with G.T. Land Ccupany to determine the best means of
installing Type III barricades at the west end of Seneca Street with the
installation of the barricade as soon as possible.

Dear Susan,
As per our discussion pertaining to the Revised Exhibit 'B' for
Regency Park PUD, I am submitting an adjusted exhibit adding an admin-
istrative fee. After reviewing the draft of the amended development -
agreement and better understanding the bid process which we are to
conduct I felt a fee would be appropriate.
I have noticed in the draft you are requesting we obtain permission
from the adjacent landowner to construct such improvements. I have
called numerous times over to Dave Williams office without a return phone
call. Dave represents the Savings and Loan whom foreclosed on the adjacent
land in the Pineview Subdivision. I would suggest that you or the city
attorney contact the owner of the property through Mr. Williams to arrange
the purchase of the property. We have done what we can as far as researching
property title to find the correct owner. I don't feel it is warranted to
make the suggestion in the development agreement that we obtain permission
to do such work when in actuality the city should be doing the negotiations
to purchase the land in question.

appreciate that detail being cleared up. Dave Williams of Ft. Collins
has represented the S & L through the foreclosure.

RE: Regency Park P.U.D., Detention Pond No. 1 ( aka Bellaire P.U.D.)
Dear Leo,
This is in response to your letters of June 4 and June 11, 1987 in which
you provided a cost estimate for the completion of Detention Pond No. 1,
and referred to the ownership issue of that portion of the pond not yet
purchased by the City.
The cost estimate you provided, including the administrative fee, will be
incorporated into the Amendment to the Development Agreement. The total
estimated amount eligible for reimbursement is $23,397.00
Your June 11, 1987 letter expressed concern over our requirement that you
obtain permission from the adjacent landowner in order to complete
Detention Pond No. 1. Your efforts to locate the current owner are greatly
appreciated. I have spoken with Stan Venable of Stewart Title and he has
indicated that he will be able to provide me with the name of someone to
contact regarding purchase of the land. At that time we will begin
negotiations to purchase the property.
Our requirement that you obtain permission from the landowner is not meant
to place a greater burden on you. We anticipate that by the time you begin
work on the pond we will own it. However, at this time we are not the
legal owners of the entire pond, and our legal council insists that we
include this clause in the Development Agreement based on existing
conditions. You are not required to obtain the permission prior to the
signing of the Development Agreement, but we will require you to add a note
to the Utility drawings indicating that permission must be obtained from
any third party owner before work can commence on the pond. We will proceed
as soon as possible on the purchase of the remaining portion of the pond.
