The following variance from City of Fort Collins Design Standards
relating to Streets, is requested on behalf of Home Federal
Savings and Loan Association of the Rockies, in conjunction with
filing a development proposal with the City of Fort Collins, known
as "Regency Park P.U.D. Second Filing".
A variance is requested to allow the placement of a cul-de-sac
(Zahn Court) which would intersect from the south side of a
residential street (Hilburn Drive) less than 200 feet away from an
existing intersection on the north side (Craig Drive). The actual
offset distance proposed between centerlines of these
intersections will be 160.18 feet:
This is a variance to "Design Criteria and Standards for Streets"
as published by the City of Fort Collins, July 1986, Section
1.02.03.e, page 8, which reads.
"Streets intersecting on opposite sides of a residential or
collector street shall be either directly across from each
other or offset by at. least 200 feet between centerlines."
Due to existing constraints, and the configuration of surrounding
development, the location of Zahn Court as proposed, provides the
only reasonable layout for single family lots in the easterly
portion of this project.
No particular problems would be created by this variance. There
will be a maximum of six single family dwellings with access to
Zahn Court, generating a minimal number of vehicle trips at the
Zahn Court intersection. Furthermore, the relationship of Zahn
Court and Craig Drive, is such that there are no conflicting left
turn movements along Hilburn Drive between these intersections.
There are no public health, safety, and/or welfare problems
created by this variance.

VARIANCE DESCRIPTION
** Variances from City standard design criteria:
There is one such variance incorporated into this project. It
is relative to the offset of opposing street intersections
along Hilburn Drive. The distance between the centerlines of
Craig Drive and Zahn Court is 160.18 feet. This is less than
the City's minimum offset requirement of 200 feet.

RE: Regency Park Phase II
Dear Mike:
Pursuant to our ongoing discussions of Regency Park Phase II off -site
requirements, I am writing to update you on our progress. You will
find enclosed a copy of my letter to Mr. Platt of even date. The letter
summarizes the result of my conversations with Mr. Platt. At this point,
Mr. Platt's proposal is to simply sell us his land. He has clearly indicated
his unwillingness to consider anything less. His present posture places
me in a situation where clearly, I need to explore alternative remedies.
To give you something of a historical perspective on our conversations with
Craig, I will summarize briefly. In early December I contacted Craig to
discuss the required easements. Craig explained that he was just leaving for
California and would be gone until the 18th (of December). He said he would
call upon his return. He did not call and I began to try his residence. I
eventually succeeded in leaving a message on his recorder. Craig did call,
by now it was early January, I explained our request and he indicated that he
would like to meet with you to discuss the matter. Craig said he would call
after his meeting with you. He did in fact arrange and meet with you, though
I did not hear back from him. On the 24th of January, I phoned Craig and
arranged a meeting for the 25th with Craig, Dwayne Walker, Don Frederick and
myself. Don Frederick explained in detail the requested easements. Craig
indicated that he would review with his partners and get back with us. The
following week Ron Frank, representing Craig, called on me at my office. The
purpose of his visit was to offer Craig's tract of land to Home Federal for
purchase. I offered that such was not a practicable solution. I believe that
Ron then met with you to discuss the situation. I contacted Mr. Frank and
he indicated that Craig was prepared to offer the tract for sale, but not
prepared to negotiate easements.

This leads us to our present predicament and my most recent conversations with Craig. As
I have communicated, Home Federal is prepared to seek a reasonable solution to the present
situation. At present a negotiated acquisition of the required easements does not appear
likely. We earnestly solicit your ideas to alternative solutions of the present situation.
As noted in my letter to Craig, we would hope for a meeting of all effected parties two
weeks from today, the 22nd. Please advise. Thank you.

RE: Acquisition of easements, Regency @ Harmony
Dear Craig:
Pursuant to my recent conversations with you and your agent, Ron Frank, regarding
drainage and right-of-way easements on your property at the above captioned
address. Over the course of the last two months we have had a series of conver-
sations regarding Home Federal's need to acquire drainage and right-of-way
easements across your property in order to proceed with the development of 16
single family sites just west of your property. As you know, the two specific
easements are 1) A temporary drainage easement along the western boundary of
your property and 2) A right-of-way easement along the southern boundary of
your property to allow for sloping away from a "to be constructed" section of
roadway.
At our meeting of 1-25-90, we met with Dwayne Walker and Don Frederick. Mr.
Frederick explained in detail to you the scope and detail of the proposed
easements. At that time Mr. Frederick provided for your benefit his drawings
of the improvements proposed easements.
As I have communicated, Home Federal is prepared to negotiate the acquisition
of these easements and to pay a reasonable amount for their acquisition. In my
phone call to you of today, I reiterated this fact so that I could be sure that
this had been clearly communicated to you. During our conversation today, you
affirmed your present desire to sell the land to Home Federal and that any
alternative less than this was not acceptable to you or your partners.

To Whom It May Concern:
As per our meeting of May 25th, the following is an
agreement between Arapahoe Farm Inc. and Home Federal
Savings and Loan of the Rockies for the purpose of grading
back a portion of land which is depicted on Page 4 of 9
of the Regency Park PUD Second Filing Grading and Drainage
Plans prepared by Frederick Land Surveying.
The area encompasses an area of approximately 120 ft. X
20 ft. at the location where Hilburn Dr. temporarily dead
ends into the vacant land to the west of Regency II. This
area will be graded back from the street at a 4 to 1 slope
as shown to help prevent further washing of the soil onto
Hilburn Drive.
All costs associated with this grading as depicted will be
borne by Home Federal Savings at the time of the site development
of Regency II.

Re: Regency .Park P.U.D ;second Filing - Hilburn Drive revisions.
Dear Mike;
Enclosed please find a bl.uel.ine copy of sheet 3 of 9 of the
Regency Park P.U.D. Second Filing plans. This sheet includes the
street plan and profile: for the westerly end of Hilburn Drive.
This, plan has been revised to raise the proposed ,grades at the
west, end of Hilburn Drive to lessen the cut necessary along the
north side of Hilburn Drive, are it .affects the existing residence
in this area. Our plan includes a maximum difference of 1.0 fret,
between the north and south curb flowlinns; minimum and maximum
pavement cross -slopes of 2% and A respectively; and no
detrimental affects to the existing fire hydrant on the south side
of Hilburn Drive near it's west, end. This design does require the
removal of approximately 23 L.F. of existing curb -walk on the
south side of Hilburn Drive.
it should be noted that this design will not, totally eliminate
regrading outside of the right-of-way, but will reduce the amount
of regrading required.
Mike, we feel this is the best :available solution to the grading
problem in this area. Please review these revisions and let us
know if you are in agreement with them. Upon your verbal
approval, we will be glad to submit the original mylar to .you for
your signature. Please call with any questions or comments you
may have.

Dear Mike;
On behalf of Home Federal Savings and Loan Association, the owner
of the proposed Subdivision, I am requesting the City's approval
to allow us to eliminate the existing Temporary Cul-de-Sac at the
West end of existing Hilburn Drive at this time.
The subject Cul-de-Sac was constructed with the initial
improvements for Belair P.U.D.. At that time, the layout for this
entire area called for Multi -Family development. Craig Drive was
to be the westerly most intersection along Hilburn Drive in this
development. Since that time, the area north of Hilburn Drive was
replatted into single family lots, and Hilburn Court was added
near the west end of Hilburn Drive. At this time, our proposal
calls for the replatting of the area south of Hilburn Drive into
single family lots, with an additional cul-de-sac to be platted on
the south side of Hilburn Drive, near it's west end, I have
enclosed a copy of our current replat proposal for you reference.
With the addition of the north and south cul-de-sacs near the west
end of Hilburn Drive, we propose that the need for the temporary
cul-de-sac has been eliminated. Please let us know the City's
position on this so we can deal with it accordingly in our
construction plan set.
