HomeMy WebLinkAboutRIGDEN FARM KANSAS DRIVE - Filed RV-ROW VACATION - 2008-03-261W M ORDINANCE NO. 071, 2007 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING A PORTION OF RIGHT-OF-WAY AS DEDICATED ON THE PLAT OF RIGDEN FARM, FILING ONE WHEREAS, on the plat of Rigden Farm, Filing One, certain rights -of -way are dedicated to the public, including rights -of -way for future street extensions; and WHEREAS, the City's Administrative Hearing Officer has approved a project development plan for a project entitled "Rigden Farm, Twelfth Filing Brooklyn Park Row Houses" (the `Brooklyn Park Row Houses PDP"), which plats certain property abutting said rights -of -way; and WHEREAS, the approval of the Brooklyn Park Row Houses PDP necessitates the vacation of a portion of the original right-of-way dedicated on the plat of Rigden Farm, Filing One, since that portion of right-of-way was intended to accommodate a future street extension that is no longer needed under the Brooklyn Park Row Houses PDP; and WHEREAS, pertinent City agencies and private utility companies have been contacted and reported no objection to the proposed vacation, provided that utility easement be reserved unto the City; and WHEREAS, the right of the residents of the City of Fort Collins will not be prejudiced or injured by the vacation of said street right-of-way. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the portion of street right-of-way, more particularly described on Exhibit "A", attached hereto and incorporated herein by this reference, is hereby vacated, abated and abolished. The proposed vacation is 1883 square feet in size, and is located along the west side of Kansas Drive approximately 250' north of the intersection with Custer Drive. As you know, this property was originally platted as "Tract S" of the Ridgen Farm Subdivision. At that time, there was a small area of ROW platted to accommodate an entrance into Tract S. I believe this was done under the assumption that a public street would eventually be developed at this location. There was not an actual project proposed for Tract S at that time, so this action was somewhat speculative. During the review and approval of the preliminary site plan, it was determined that a public street in this location was not desired by either the developer or the City. The project has proceeded to approval with a private access drive at this location. The ROW is simply no longer needed. The project as proposed provides adequate ROW and easements along Kansas Drive. Enclosed please a legal description and drawing showing the proposed vacation. We appreciate your expeditious review and approval of this request.
