This letter is on behalf of Uniprop for their proposed Dry Creek Minor Subdivision, First
Replat in Fort Collins, Colorado.
Overall, we feel we have worked to keep within the spirit and the intent of the LCUASS. The
requested variance is as follows:
Private Drives draining directly to a Public Road
Issue
Larimer County Urban Area Street Standards Section 9.4.11 states that storm water
runoff from property adjoining the right-of-way shall not be discharged across the
sidewalk. These flows must be directed elsewhere or directed to a sidewalk chase
where storm water may pass under a sidewalk section. This issue would occur at all
connections from private drives to public roads if there was sidewalk on both sides
of the public road. However, in this case there is only sidewalk on one side of the
public roads, so it only arises at the intersection of Newaygo Dr. & Mackinac St. and
Winamac Dr. & Bannock St.
Alternate Design
One alternative is to make the streets in this development either all public or all
private. The current configuration of public and private streets was decided on much
earlier in the planning process and decisions were made Qt,+ e,�lvt\,+ie--1-
Another alternative is to build a sidewalk chase through the curb return. This would
have to be —built around the ramps and would affect the property of the adjacent land
owners.

establd. ere is very little that can be done to prevent storm drainage runoff
from wrap ing around the curb return from a private drive to public road. This
would not an issue if the two streets were both public considering the
intersections constructed and currently function similar to public road standard

requirements. Based on current knowledge, it is my opinion the existing condition
will not be detrimental to the public health, safety and welfare, and will not reduce
the design life of the improvement nor cause the Local Entity additional maintenance
costs.
