The purpose of this letter is to clarify the obligation to construct a public sidewalk along
the south side of Harmony Road between the east property line of the Comfort Dental
P.D.P. (Current Planning Project File #19-02) and Hogan Drive. This sidewalk would
adjoin property owned by the Poudre Fire Authority and be considered a public sidewalk.
This sidewalk would be 360 feet in length and seven feet in width and is considered to be
an important pedestrian connection to serve the development of the Comfort Dental
P.D.P.
The cost of constructing this walk will be borne by the City of Fort Collins Street
Oversizing Program and Poudre Fire Authority. The cost sharing arrangement is that
.Poudre Fire Authority will contribute $4,500 for the "local share" of the sidewalk and the
Street Oversizing Program will pay for the "oversized share" so that the walk meets the
standard for a major arterial street. It is the City's desire to have the sidewalk constructed
by the time the Alpine Dental Clinic receives a Certificate of Occupancy.

To whom it may concern
I am writing this letter to inform you that NextMedia Outdoor, Inc. recently purchased property along
Harmony Road east of South College Avenue (Lot 2, Replat of Part of Tract B, Fairway Estates Third
Filing) on 8/27/07 formerly belonging to Joseph M. and Ingrid Y. Simpson.
At the time of purchase we had an existing lease agreement in place for our sign located on the
northeast comer of this property. Since purchasing this property we have become aware of a Deed of
Dedication for Easement granted to the City of Fort Collins by the former owners Joseph M. and Ingrid
Y. Simpson. This easement appears to occupy ground underneath our sign. This particular deed was
executed on 7/11/07 prior to purchase of the property. In order for this deed to be valid per our lease,
notification or cancellation would have been required. Further at the time of purchase the seller (Joseph
M. and Ingrid Y. Simpson) warranted that there were no formal executed agreements or encumbrances
jeopardizing the existence of our sign.
In closing, we are amicable to working with all parties to clear up this matter. Please note we are open
to allowing the sidewalk for the betterment of the city as long as it does not interfere with our sign.

Dear Dan:
The City has had the opportunity to review projected construction costs required to paid in -lieu of
construction pertaining to future Harmony Road widening and construction of sidewalk east of your
project as provided by your contractor Heath Construction (attached for your reference). Please be
advised that the City has approved of the estimates indicated in the attachment with the added cost of
$10,000 for the acquisition of an easement along the NextMedia property. These costs are broken down
below:
• $24.301.19 for Harmony Road widening abutting the project
+ $5,000.00 for sidewalk along the NextMedia property
• $10,000.00 for the City's costs to acquire an access easement for the installation of the sidewalk
along NextMedia property
The total of the above referenced costs is $39,301.19. Please note that upon the City's receipt of
$39,301.19 the sidewalk offsite your property is no longer required to be constructed by the first
certificate of occupancy.
Should you obtain the access easement along the NextMedia property and construct the sidewalk along
said property, a refund in the amount of $15,000.00 will also be issued to you. This dollar amount is only
required to serve as a fund available to the City in the event that the City assumes the sidewalk
construction (and easement acquisition) responsibility along the NextMedia property as a result of you
being unable to complete these items prior to the first certificate of occupancy on your site.

Attached are two checks in the amount of $24,301.19 and $15,000.00 which pertain to the Fort Collins
Supportive Housing Subdivision project and are intended to satisfy obligations of the development for
certain public improvements. The check in the amount of $24,301.19 is intended to satisfy the developer's
obligation towards certain Harmony Road improvements abutting the site, which is further explained in
paragraph II.D.3 of the development agreement for the project. The check in the amount of $15,000 is
intended to satisfy the developer's obligation towards certain sidewalk improvements along Harmony Road
east of the site which is further explained in paragraphs II.D.4-5 of the development agreement. These
specific portions of the development agreement are attached for reference.
It is conceivable that the funds provided may be returned to the developer if certain improvements are
constructed by the developer; however it is also as likely that the City or a third party would construct these
certain improvements and then be reimbursed by these funds.
Given the unique nature of this, let me know if I need to provide additional documentation, information, or
any other questions or concerns you might have.

Accessible Space is proposing to build a 23-unit apartment located at Harmony Road and
Hogan Drive. The project provides "independent living" opportunities for very low income
individuals with physical disabilities and will be 100% affordable.
Therefore, the project qualifies for Priority Processing and a 100% waiver of the City's
Development Review Fees. Please implement Priority Processing procedures for this
project.

Subject: Harmony sidewalk
John Mulligan and Bob Poncelow have agreed to pay $4,500 for PFA's local share of the 7'
sidewalk along the south side of Harmony Road from Hogan to 360' west. This will relieve the
Dentist development from these offsite sidewalk improvements because Street Oversizing will pay
the oversized sidewalk in this 360'. 1 have left a message for Mr. Gallenste!n.
Cam, please have Engineering staff get with Bob Poncelow for the PFA account for these funds
and work with him on the easements or rights -of -way issues for the sidewalk.

and Figure 8-5, the design right -turn lane length is 435 ft, including a 200 ft bay taper, for
a highway design speed of 50 mph.

Justification for the Variance:
The Standards right -turn lane length of 435 ft is based on approaches to stop sign
controlled and signaled intersections, allowing appropriate vehicle storage and
deceleration lengths. The proposed right -turn lane into the Fort Collins Supportive
Housing development is mid block, does not occur at a stop sign controlled or signaled
intersection and vehicles will be able to enter the site without completely stopping.
Additionally, Delich Associates, the traffic engineer for this Project, noted that while the
435 foot right -turn length would be standard for the 50 mph design speed for this
location, at the actual posted speed of 45 mph, the 420 foot right -turn length would only
require a 375 foot length. Delich Associates concluded that the current design of a 420 ft
right -turn lane will function efficiently and will not be detrimental to the public health,
welfare, and safety. The 420 foot length design also will not cause additional
maintenance costs.
We look forward to your response and approval of this proposed variance for the Fort Collins
Supportive Housing.

site development review process, the city of Fort Collins brought to our attention the sign on your property that
wilt be in conflict with the proposed walkway to be built out to Hogan. After looking at the sign, the city has
determined it is not an allowed sign and they have asked us to notify you that the sign is to be removed and that
it cannot be moved to another location. If you have any questions or concerns in the matter please contact Mr.

The easement in question had not been filed at the County while you
owned the property. The City isn't in a position to declare the
easement "void and non -binding", I believe an attorney would need to
formulate an opinion on this. Hope this helps.

Good Morning Peter:
It was nice meeting you yesterday! Ingrid has spoken highly of you for
some time and it was nice to put a face with the reputation.
I got to thinking after I left your office, that it would be good for us
in the future if we had a letter that stated that the Easement had never
been filed (or what ever it is called?) while we owned the property.
Therefore, as you told me, the Easement is void and non -binding on the
purchaser since the property has been sold. Or in your words, "It's a
restart'.
