CERTIFICATE OF OWNERSHIP AND DEDICATION
KNOW ALL PERSONS BY THESE PRESENTS that the undersigned, McCreek, LLC, a Colorado limited
liability company, being the owner(s) of that part of the North Half of the Northeast Quarter of Section Nine
(9), Township Six (6) North, Range Sixty-eight (68) West of the Sixth Principal Meridian, Larimer County,
Colorado, being more particularly described as follows:

November 15, 2000 as Reception No. 2000078405 of the Records of Larimer County, located in the North 1 /2
of the Northeast 1/4 of Section 9, Township 6 North, Range 68 West of the 6th Principal Meridian, County of
Latimer, State of Colorado, and being more particularly described as follows:
COMMENCING at the Northeast Comer of Section 9 and assuming the North line of the NE 1 A of Section 9 to
bear South 88°28'48" East, a distance of 2656.31 feet, with all other bearings herein relative thereto;
Thence South 00°09'07" East along the East line of the NEI A of said Section 9 a distance of 50.02 feet to the
POINT OF BEGINNING; thence South 00°09'07" East along the East line of the NE 1 A a distance of 1265.98
feet to a point of departure from the East line of the NE 1/4; thence North 88°26'41" West a distance of 1218.43

to the POINT OF BEGINNING.
Said parcel of land contains 41.86 acres, more or less (t), and is subject to any rights -of -way or other
easements of record or as now existing on said described parcel of land.
Have by these presents caused the same to be surveyed and divided into lots, blocks and tracts, to be known as
McClelland's Creek PD & PLD SECOND FILING and do hereby dedicate and convey to and for public use
forever hereafter the streets as are laid out and designated on this plat, and do also reserve perpetual easements
for the installation and maintenance of utilities and for irrigation and drainage facilities as are laid out and
designated on this plat, and do hereby dedicate and convey to the Fort Collins -Loveland Water District and/or
South Fort Collins Sanitation District ("District"), its successors and assigns, forever as laid out and designated
as such, on this plat, for the installation, construction, maintenance, inspection, operation, replacement or
removal of one (1) or more domestic water lines for the transmission and distribution of domestic water, and/or
one (1) or more sanitary sewer lines for the collection and service of sanitary sewer and wastewater, and all
underground and surface appurtenances thereto, including metering stations and other fixtures, in, over, across
and upon said Easement. The Undersigned further grants, conveys and covenants to the District A) the right
and privilege to grade the Easements for the full width thereof in such manner as the District may reasonably
determine to he necessary or advisable; B) all rights necessary and incident to the full and complete use and
enjoyment of the right of way and easement for the purposes herein granted; CO the ground elevation of the
easement shall not be diminished or substantially added to; D) the Undersigned shall be responsible for
maintenance such as, but not limited to, mowing;
The Undersigned shall not erect or place any permanent building, structure, improvement fence, sidewalk, tree
or other landscaping on the Easements except as approved in these drawing. In the event of the placement of
such obstacles, the District shall have the right to require the undersigned to remove such obstacles from the
Easements and, in the event the undersigned fails to do so upon request, the District may remove may remove
such obstacles without any liability for repair or replacement thereof The Undersigned shall have the right,
without the consent of the District, to plant grasses and other ground cover and small shrubs upon the Easement
areas that are usual and customary for the full use and enjoyment of the property. However, the District shall
not be responsible for repair or replacement of any "exotic" plantings, ornamental trees, or similar landscaping
other than usual and customary ground covering and shrubs.

Note
Sight Distance Easement- The sight distance easement is an easement required by the City at some
street intersections where it is necessary to protect the line of sight for a motorist needing to see
approaching traffic and to react safely for merging their vehicle into traffic flow. The following are
requirements for certain objects that may occupy a sight distance easement for level grade:
(1) Structures and landscaping within the easement shall not exceed 24 inches in height with the
following exceptions:
(a) Fences up to 42 inches in height may be allowed as long as they do not obstruct the line of sight
for motorists.
(b) Deciduous trees may be allowed as long as all branches of the trees are trimmed so that no
portion thereof or leaves thereon hang lower than six (6) feet above the ground, and the trees are spaced
such that they do not obstruct line of sight for motorists. Deciduous trees with trunks large enough to
obstruct I ne of sight for motorists shall be removed by the owner.
For non -level areas these requirements shall he modified to provide the same degree of visibility.
