March 15, 2006 Sheri Wamhoff City of Fort Collins Engineering 281 North College Avenue Fort Collins, CO 80524 Fax: 221-6378 (3 Sheets) Re: Tract B, Fox Meadows Business Park, Request for Variance — Driveway Spacing Dear Ms. Wamhoff: The following is a request for variance from Table 7-3 — Fort Collins Technical Design Standards — Distance Between Driveway Edges for a Local Commercial street classification in the "Larimer County Urban Area Street County Urban Area Street Standards, October 2002". This site is presently in the City's development review system as the Colorado Health and Fitness Center. The project is going to change to a mixed -use building, but the general layout is going to remain similar to the previous submittal (8%2" x I I" drawings are attached). This project will take access off of the south side of Bighorn Drive (west of Timberline Road) with a single drive. There is an existing detention pond on the east side of the site. In order to maximize the buildable site area and not encroach into the pond, the center of the proposed 30' driveway has been positioned approximately 10' east of the center of an existing 30' drive on the opposite side of Bighorn Drive. Moving the proposed driveway west will eliminate both parking and building area, and moving to the standard 30' edge to edge distance will encroach significantly into the existing detention pond. I have discussed this driveway layout with Matt Delich and he offered the following observations: The Health and Fitness Center Report indicated that north/south traffic between the two drives was nominal. There is not significant traffic and both drives are in a stop condition for exiting traffic, so any traffic going between the two properties should be traveling at very low speed. He does not expect that the change in use will significantly impact the trip generation. The proposed offset is in the positive direction with respect to traffic on Bighorn turning into either property. There is no conflict for lefts off of the Street. Traffic turning out of both properties may have a slight conflict, but the traffic study for the property to the north indicated that there are very few lefts out (to eastbound Bighorn). Because of the drive widths (30') vehicles should be able to avoid each other easily. Based on the low traffic volumes expected between the two drives, and the low number of vehicles traveling from the property to the north into the Fox Meadows neighborhood, it is not anticipated that this variance from the above Standards will compromise the public health, safety and welfare. We are in the final compliance re -submittal phase. Because of some confusion early on with whether this was a minor amendment or final compliance, we resubmitted with the last submittal $1000 on 3/22/07 for the TDR fee, receipt number 120477 but I discovered we had already paid the final compliance fee on 6/21/06. We have not paid the plat fee of $2000 + $250/acre. Per your comment we can apply the $1000 we over paid for final compliance to the plat fee. The gross acreage is 4.29 sot fee still owed is $2000 + $250(4.29) _ $2000 + $1072.5 = $3072.50 $1000.00 = $2072.50. Please confirm this is correct.
