PROJECT DESCRIPTION:
Request to vacate a portion of an existing utility easement on the property located at
252 East Mountain Avenue, more particularly described on Exhibit "A°.
RECOMMENDATION: Staff recommends approval of Resolution AD07-02.
EXECUTIVE SUMMARY:
The applicant has requested the vacation of a portion of the air space over an existing
utility easement for the purposes of constructing a second story building overhang. A
utility coordination meeting was held where no objection to the vacation was raised by
the utility providers that use the easement. The proposed easement, air space vacation
has also been routed to all of the affected utility providers for review with no objections
received. The City will maintain a utility easement in this area that includes 15 feet of air
space above the existing grade.

OF THE DIRECTOR OF COMMUNITY PLANNING AND ENVIROMENTAL
SERVICES OF THE CITY OF FORT COLLINS
VACATING A PORTION OF THE
UTILITY EASEMENT LOCATED ON
252 EAST MOUNTAIN AVENUE
WHEREAS, Section 2.1.5 of the Land Use Code of the City of Fort Collins
authorizes the Director of Community Planning and Environmental Services to vacate
certain easements by resolution or by approval of replats containing notation of such
dedication; and
WHEREAS, the Owner has requested that the City vacate a portion of a utility
easement on 252 East Mountain Avenue, more particularly described on Exhibit "A"; and
WHEREAS, the vacation has been reviewed and approved by the pertinent City
Departments, which departments report no objection to the vacation.
NOW, THEREFORE, be it resolved by the Director of Planning and
Environmental Services of the City of Fort Collins, that a portion of a utility easement on
252 East Mountain, and more particularly described on Exhibit "A", attached hereto and
incorporated herein by this reference, is hereby vacated.
Passed and adopted by the Director of Community Planning and Environmental

at the Office of the Clerk and Recorder, Larimer County, Colorado located in Lot 6,
Block 19, City of Fort Collins, located in the Southwest Quarter of Section 12, Township
7 North, Range 69 West of the 6th Principal Meridian, City of Fort Collins, County of
Latimer, State of Colorado being more particularly described as follows:
Considering the West line of said Lot 6 as bearing North 00°20'13" East and with all
bearings contained herein relative thereto:
All that portion of said utility easement recorded at Reception No. 92008525 to be
vacated being defined by the air space beginning at an elevation of 499 1. 1 feet and
