For your information, I just spoke with Monica and Ron Mills ( City's right-of-way agent) regarding the
difficulties in constructing the new aligned Redwood Street to it's ultimate design with the Old Town
Project. As you may not know, the property that the City is purchasing from the State can not official
change hands until the State is ready to move into their new facility. The exact timing of which is unknown
at this time. Because of this unknown. I told Monica that the City would allow a temporary gravel road to
be built in the existing right-of-way. This gravel road would become the developments second point of
access and in my opinion should only service emergency vehicles. However, this can be discussed
further at a later date. Of course there are other options for second points of access but these may not be
available.

This Variance Request is in regards to incorporating non-standard v-pans instead of driveover
curb and gutters in alleys, as presented in the Final Utility Plans, Old Town North, prepared by
Shear Engineering Corporation, dated March 2002. The project is located east of North College
Avenue and north of East Vine Drive.
Guidance for this variance request was taken from Lorimer County Urban Area Street Standards
(LCUASS), Section 1.9.2.A.2, January 2, 2001.
Additional directives have been provided via comments received from the City of Fort Collins -
Engineering Department. These directives include:
• Showing that the 2-year storm water surface elevation (WSEL) remains within the v-pan/
row.
• Provide easements on private property adjacent to the alley to the point where the 100-year
storm WSEL intersects proposed grade.
• No fencing or structure allowed within the above referenced easements.
• Adjacent property foundations shall be a minimum of 1-foot above the 100-year storm
WSEL.
Issue
1. The standards, as taken from LCUASS, to be waived are:
a. Table 7.1, "City of Fort Collins Street Standards - General Parameters," of Section
7.3.1, "Street Classifications for Each Locality,"
b. Section 7.7.6.11, "Sidewalks, Curb and Gutter; Curb and Gutter; Vertical Curb and
Gutter (Type H)," and
c. Appendix A, List of Standard Drawings, Figure 7-12F — "Alley Option (B)
(Drainage to One Side)."
2. The configuration shown on Figure 7-12F includes driveover curb and gutter, and a structure
(fence) located within an 8-foot Access and Utility Easement.

Comparison With Standard
1. As shown in the table and discussed above, the 2-year WSEL is not expected to be entirely
contained and conveyed within the proposed v-pan/ row in all locations. The locations
analyzed were chosen having a maximum contributing area. These locations are immediately
upgradient of an alley -street intersection. Once flows reach the street, inundation limits are
expected to be completely within the street ROW. Therefore, the length of inundation
outside of alley ROW's is limited to locations immediately upgradient of alley -street
intersections.
2. As presented in the table and discussed above, the 2-yr and 100-yr WSEL are expected to be
contained and conveyed within all proposed alley easements.
3. All easements on private property, as legally defined by the plat and shown on the utility
plans, are located outside of the inundation limits of the 100-year WSEL.
4. No fencing or structure shall be constructed within the 8-foot and 17-foot easements defined
and shown on the plans.
5. Adjacent property foundations area minimum of 1-foot above the 100-year storm WSEL.
6. No additional capital and maintenance requirements, or costs would be assumed directly to
the City of Ft. Collins due to the approval of this variance.
Justification
1. The variance will not be detrimental to the public health, safety and welfare.
2. This variance will not cause additional maintenance cost to the City of Ft Collins.
3. This variance will ease vehicular transition from alley ROW's and into and out of parallel
parking spaces located along the alleys.
4. The variance will advance the public purpose by allowing access to the Old Town North
residential development intended as affordable housing.

Proposed Alternate Design
1. Three proposed alley typical sections are included in the project design. The Street Typical
Sections (Interior) sheet as taken from Final Utility Plans, Old Town North, is included with
this request and available for immediate review.
2. All three proposed typical sections propose a v-pan conveying drainage along one side of the
alley.
3. Four alley locations were analyzed for the 2-year and 100-year storm events to determine the
respective WSEL's inundating the alleys. Each location was chosen based as a "worse case"
situation; these locations consider the maximum upgradient drainage contributing area for
each alley. These WSEL's were then related to proposed grades located horizontally at the
8-foot easements and ROW's along both sides of the alley.
4. The following table summarizes the four alley WSEL inundation locations analyzed:

All elevations are relative to the flowline of the v-pan.
Left and Right Sides are relative to the v-pan located along the left side of the alley.
5. Several instances are anticipated where the 2-yr WSEL is expected to be higher than the
proposed ROW grade elevations. These locations are: Alley O left ROW; Alley S-2 left
ROW; and Alley U left ROW. The remaining ROW's are expected to contain the drainage
flows.
6. In all instances as shown in the table above, the 100-yr WSEL is lower than the proposed
easement grade elevations. Therefore, all drainage flows are expected to be conveyed within
the limits of the easements.

This letter is in response to the variance request, received April 8, 2002 and dated March 4, 2002, to use a v-pan
in lieu of the drive -over curb and gutter that is required for alley option (B) per Detail 7-12F of the Larimer
County Urban Area Street Standards (LCUASS) and for the variance request dated January 7, 2002 for reduction
in the centerline radius requirement for Redwood Street.
The variance request to use a v-pan in lieu of the drive -over curb and gutter that is required for alley option (B) is
granted with the following conditions:
1) Drainage easements are provided as necessary to accommodate the 100 year water surface elevation.
2) No fencing or structures shall be placed within the above mentioned easement areas and landscaping within
the easement areas shall be limited to items that do not impede stormwater flows.
3) Finished floor elevations be a minimum of 1 foot above the 100 year water surface elevation.
4) The entire alley section be concrete.
The variance request to reduce the centerline radius for Redwood Street is not needed. It was determined upon
further review that Redwood Street does not need a variance granted as it meets the design requirements, cross
section and functionality requirements for a minor collector street.
This variance request does not set a precedence or change the application of our design standards in other

Dear Ms. Sweere:
After our telephone conversation Monday, I reviewed the latest comments from the Final
Compliance review process. I believe you have also received these comments by now. In
addition, the status of your project was discussed at our weekly Growth Management Lead Team
meeting on Tuesday. This meeting involves department heads and service area directors from
CPES, Transportation and Utilities.
I understand your concerns about having to go through another round of review in order to
complete the Final Compliance phase and proceed to construction. However, it is also important
that the designs and other components of the Final Compliance submittal be adequate to insure
proper construction.
During the time between the Planning Approval and the first Final Compliance submittal
(approximately eight months), we were surprised by some significant design changes made by
you and your design team. The overall site elevation was changed by about a foot, which has a
dramatic effect on drainage and flood control features. Also, new construction phasing lines now
create long dead-end alleys which will require temporary turnarounds or temporary additional
access points out to the street system. These changes could impact some of the building lots.
Later, twenty additional plan sheets were added to the construction plan set between the first and
second final compliance rounds, indicating that the plans needed quite a bit more work. It is my
understanding that these included detailed grading plans and some of the specific stormwater
calculations. This important data was only just received on March 19, 2002, with the second
submittal of the final compliance plans. Of course, these new plan sheets also generated more
comments.
On a more positive note, I feel that we are on the way to solving the pedestrian connection issue
out to College Avenue. However, I also understand that there are several easements that have
not been provided yet. Also many comments that we shared months ago that needed to be
changed on the plans have not been addressed. These are just a few of the more noteworthy
items that must be addressed on your next submittal.

13th and left a detailed message. I again called and left another message this morning. I did relay

Oversizing Requests / Reimbursement Requests / Cash in Lieu
Dear Mr. Baker,
This report is a summary of the quantities and cost estimates associated with our intent to
request street oversizing cost reimbursement, the project's street cost responsibility for streets
not being constructed with the project, as well as reimbursement requests from adjacent
property owners.
Street oversizing will be requested for the following:
• Jerome Street, which is classified as a collector with the North College Avenue Access
Plan
• Redwood Street
Reimbursement requests will be made for those properties adjacent to street improvements
being made with this project:
• Two (2) properties adjacent to Jerome Street, between existing Vine Drive and the Lake
Canal
• Several properties adjacent to Redwood Street between existing Vine Drive and the
southernmost east entrance into Old Town North
The development will pay cash in lieu of actual street improvements for:
• Future re -aligned Vine Drive
• That section of Redwood Street not being constructed adjacent to Old Town North due to
its proximity to the existing Dry Creek floodway
• The existing Vine Drive right turn lane improvements
Reimbursement will be requested for the entire cost of each of the Lake Canal box culverts.

Oversizing Requests / Reimbursement Requests / Cash in Lieu
We have attached a copy of the bid tab from Hall -Irwin to document the unit prices used with
our request estimates. We have also provided plans and exhibits in an effort to ease the
review of the information provided. Exhibit data for those properties for which we will
request reimbursement, are noted on the Jerome Street and the Redwood Street plan exhibits.
The pavement section used in estimating the cost for the existing Vine Drive right turn lane
was the same pavement section used for the existing Vine Drive improvements done by the
City of Fort Collins in 2002. This pavement section was provided to us by Erika Keaton with
the engineering department during our existing Vine Drive improvements coordination effort
in 2002. You may verify this pavement section with Erika.
We are also tracking all engineering fees associated with the Vine Drive re -alignment design
and the street oversizing request and documentation involvement. We will track and
document all engineering fees. We realize that some of these fees are negotiable. Our fees to
date associated with the re -aligned Vine Drive design and the oversizing request and
documentation involvement is as follows:
• Re -aligned Vine Drive design / cost estimate / documentation: $ 5,700.00
• Oversizing request / documentation $ 4,400.00

Easement Request
Dear Ms. Kolz,
This letter is written in an effort to answer all of your questions directed to Monica Sweere in
your letter to Monica dated May 7, 2003 concerning our easement request as it relates to Old
Town North. I am including plans and pictures that may provide you better understanding of our
request and its impact to your property.
In association with the Old Town North drainage system design, the outfall system for the
detention pond consists of a storm sewer that daylights into the Lake Canal ditch at an existing
old irrigation structure that is located within the Lake Canal. The old irrigation structure is also
located directly in the flowline path of the Dry Creek drainageway and floodway. The location of
the proposed storm sewer is also within the Dry Creek drainageway and floodway. Please refer
to the picture provided. The picture was taken on the west side of the Lake Canal and the
existing structure. The Lake Canal and the old irrigation structure are on the westernmost limit of
your property. We estimate that there may be a maximum encroachment onto your property of
approximately 6', including through the wall of the existing irrigation structure.
I have attached a copy of Sheet 77 of 88 of the Old Town North plan set. This is the Floodplain
Plan. This plan demonstrates the storm sewer outfall to the Lake Canal Ditch System. It also
represents the current defined Dry Creek floodway as defined by FEMA taken from FIRM map —
Community Panel number 080102-0004-C; dated March 18, 1996.
I have also attached is a copy of the Larimer County Shops subdivision plat. I have drawn in the
location of the structure and the Old Town North detention pond outfall storm sewer to relate the
minimum impact of this improvement on your property. Also to note the relativity of the Lake
Canal easement defined with this plat.
The following is a specific answer to each of your questions noted in your May 7, 2003 letter to
Monica.
1. The entire easement is within the limits of what would be a ditch easement if this property
were platted today. It is in the area of the current ditch limits.
2. The proposed improvement will not require that the existing ditch be widened or otherwise
modified.

Dear Ms. Wamhoff.
This Variance Request is in regards to the proposed alignment of Future Redwood Street as
presented in the Final Utility Plans, Old Town North, prepared by Shear Engineering Corp.,
submitted January 7, 2002. The project is located east of North College Avenue and north of
East Vine Drive. Future Redwood Street intersects with the north side of East Vine Drive
opposite Linden Street. The proposed Future Redwood Street connects existing Redwood Street
to the north.
Guidance for this variance request was taken from Larimer County Urban Area Street Standards,
Section 1.9.2.A.2, January 2, 2001.
Issue
1. The standard requested to be waived is the "Horizontal Curve Radii," Section 7.4.1.A as
described in the above referenced street standard. Table 7-3, City of Fort Collins Street
Standards — Technical Design Criteria, of the standard dictates that the minimum
centerline radius (with no super -elevation) for a major collector be 600 feet.
2. The design constraints for the proposed Future Redwood Street (Major Collector) are:
a. Matching the western gutter of Linden Street, with the western gutter of proposed
Future Redwood Street,
b. Matching existing Redwood Street alignment, and
c. Remaining within the existing ROW owned by the City of Ft. Collins.
3. The City of Ft Collins had acquired the Redwood Street ROW based on previous street
standards. Horizontal street design criteria were different than those now in use. This ROW
extends from East Vine Drive north to existing Redwood Street.
4. ROW widths for Linden Street and the proposed Future Redwood Street are equal and align.

3. The storm sewer will be placed at the existing grade to tie into the existing ditch structure.
Refer to attached picture. Also refer to the attached Sheet 21 of 88, the Detention Pond Storm
Sewer Plan and Profile.
4. In my opinion, there will be no impact on your property.
5. In my opinion, there will be no impact on the ditch. The concept has been reviewed and
approved by the Lake Canal Company. Approvals have been obtained from the Lake Canal
Company.
6. As well as the other documents referenced, I have attached a copy of the City GIS map
showing your property and the proposed improvement location relative to an aerial view of
actual existing conditions as of the date of preparation of this aerial. Property boundaries are
represented on this map.
I hope this explanation and the attachments help you understand the nature of our request and the
impact of the requested easement on your property. As you can see, the dedication of the
proposed easement will not have any impact whatsoever on your property.

Dear Lawrence and Judy,
Based on our phone discussion on Tuesday, July 15, I am attaching revised easement dedication
documentation based on our previous discussions and understandings. The actual Old Town
North storm sewer outfall design intent is to encroach further onto your property to provide the
ditch overflow weir on the east side of the existing Lake Canal irrigation structure and to install
rip rap at the dry creek channel flowline east of, and below the east irrigation structure wall.
We have revised Sheet 21 of 88 (the Detention Pond Storm Sewer Plan and Profile) to accurately
represent the existing Dry Creek flowline grade at an elevation lower than the top of the east
irrigation structure as you saw in previous digital pictures.

for the Old Town North development. The following are comments, information and changes
we need for these documents before they can be accepted and filed, and thus before the utility
plans can be signed and the plat filed for this project.
Emergency access easement:
• We will not accept the easement with an expiration of May 31, 2005. This easement
needs to be valid for as long as the project is a valid project and should be stated as such
in the document.
• In the last sentence of the document I believe it should be harm, not hard.
• The revised document will need to be signed by you with a notary of your signature as
the easement binds you to some things.
• The attorney certification needs to be redone with the new signing of this document and
we will not accept an attorney certification that is dated before the date of the signing of
this document.
The drainage easement:
• Since this document was signed four (4) months ago and is not current, we need a letter
from the attorney verifying that the ownership of the property on which this deed is being
dedicated on is still owned by Kolz.
Two additional easements are needed as well for this project:
1. The emergency access easement is only for the dedication of an emergency access
easement on Lot 2, of Block 1, Will Subdivision. An emergency access easement is also
needed across Lot 1 of Milan Minor Subdivision.
2. A drainage easement from the County for the box culvert under Redwood Street that will
extend onto their property.

We have also not yet received the dedication of a drainage easement on the property to the south
of Tract III, of which you were acquiring. As per the language in the draft development
agreement, no construction work including overlot grading can be done on this property until an
easement is dedicated to and accepted by the City.
It is also my understanding that the eminent domain proceedings for the property owned by Lyle
Carpenter, needed to construct Redwood Street. have not occurred. This will need to be
completed in order for your project to go forward and construct the roadway improvements
needed in that area for your second point of access. Please have your attorney contact Matt
Baler when you are ready to proceed forward with the condemnation proceedings.

The following are the dollar amount estimates that Matt Baker put together for your contributions for your
frontage of relocated Vine Drive, Redwood Street and the portions of Osiander Street and Blondel Street
that you can not construct at this time.
Due to the way the estimates were done I rearranged the paragraphs to correspond to which streets were
a part of each estimate. I will forward a copy of those once they have been reviewed by the City Attorney
- I did not change the intent of the language.
Total amount for Vine Drive, Osiander Street and Blondel Street is $883,172.93. Once divided into the
two amounts it will be payments of $ 441,586.46 and $ 441.586.47.
Total amount for Redwood Street is $ 315,029.03. Once this is divided into two amounts it will be
payments of $ 157,514.51 and $157.514.52.
The emergency access easement You provided me:
I need to receive a check for $26 made out to the Larimer County Clerk and Recorder so I can process
the acceptance of this.
The Utility Plans:
They are with Cam McNair for signature.
The Plat:
We are waiting for revised copies of the plat to be resubmitted in. The plat was returned to the surveyor
last Tuesday or Wednesday after being reviewed. The last time we had seen the plat was over two years
ago and the comments that were made at that time had not been addressed, thus the plat needed to be
revised and updated.
Filing:
Once we have the development agreement signed and the plat returned and in acceptable format we can
have the plat filed.

as we discussed on the phone today, here is the information on the Lemay Channel, a Dry Creek Basin
stormwater master plan improvement, which would be located along the south side of the realigned Vine
Drive. The master plan improvements (assume all master plan recommended facilities are in place with
developed conditions - which differ from just the Dry Creek flood control project only) recommend a grass
lined trapezoidal channel with an approximately 32 foot wide bottom width at 5 feet deep and 4:1 side
slopes. The master plan also recommends for the Lemay Channel six 4' X 10' RCBs under Lake Canal
and another six under Lemay Avenue. The master plan Lemay Channel is sized for 975 cfs. If you just
assume only the Dry Creek Flood Control project is constructed (not all master plan improvements), the
flow for the Lemay Channel would be higher; however, I do not have a flow for this area at this time (we
did not do a developed condition - full build out - for the Flood Control project).

We have completed our cost estimates for the cash deposit requirements for Blondel Street,
Osiander Street, a portion of Redwood Street and re -aligned Vine Drive. We have split up the re-
aligned Vine Drive cost estimates as they relate to actual Phasing.
We have added subgrade stabilization costs to re -aligned Vine Drive and Redwood Street. We
have removed engineering and contingency costs from Blondel and Osiander since engineering
for has been completed and has been paid for. We have removed the Dry Creek Master Drainage
Plan box culverts from the Blondel estimate. But we have added storm improvement costs that
would normally be the responsibility of the developer. This in accordance with Stormwater
policy which is similar to your street oversizing policy. We have maintained engineering and
contingency costs for re -aligned Vine Drive.
Please review these numbers or have Quentin review them. They are specific to developer
responsibility for the local street section. Call if we can be of assistance during review so there or
no misunderstandings as to the purpose of these estimates and decisions and agreements made in
the past with other staff members. Our goal is to finalize the development agreement. However,
after one more review by you, we would like to meet with staff (you, Sheri, Cam, Monica and
me) to finalize everything. We have again attached exhibits for clarification of the actual

Proposed Alternate Desien
1. The proposed Future Redwood Street has two horizontal radii of 550 feet, as shown on the
Final Utility Plans, Old Town North.
Comparison With Standard
1. The variance requested reduces the proposed Future Redwood Street horizontal radii for the
two curves from 600 feet to 550 feet.
2. No additional capital and maintenance requirements, or costs would be assumed directly to
the City of Ft. Collins due to the approval of this variance.
3. It should be noted that discussions have been extensive between Shear Engineering Corp. and
the City of Ft. Collins Engineering regarding this issue. A meeting held with the City of Ft
Collins and Shear Engineering Corp. was held December 18, 2000. Those attending were:
Mr. Wally Muscott, Mr. Dave Stringer, and Ms. Sheri Wamhoff (City of Ft Collins); and Mr.
Mike Cole and Mr. Michael Rohlfs (Shear Engineering Corp.). The following items were
discussed and agreed upon:
a. Centerline of the proposed Future Redwood Street and Linden Street will be
approximately 9-feet offset, with Redwood to the east
b. The shift would put the back -of -walk of the proposed Future Redwood Street near the
easement line,
c. Western gutters of Linden Street and proposed Future Redwood Street should be
designed as to align horizontally.
d. Future widening of Linden Street would be to the east. This would effectively move the
Linden Street centerline eastward. The Old Town North project shall design for
centerline —to -centerline alignment of future Linden Street and proposed Future Redwood
Street.
e. Due to the constraints of tying proposed Future Redwood Street into Linden Street, and
existing Redwood to the north, a variance would be required due to the non-standard
radius curves of proposed Future Redwood Street. Mr. Stringer stated he saw no problem
in obtaining this variance.

Lance Newlin, Matt Baker and myself met this morning to discuss the Old Town North Project and go thru an internal
status check on the project.
Here are the Items that came up. Overall the project is looking pretty good.
Building permits will be released as conditional. Each lot will need to provide certification that the foundation is
poured in the correct location before a full building permit will be released.
The 52nd building permit will be flagged as there are additional funds that need to be provided to the City at that
time before additional permits will be released.
Lance will work with you to put the site under warranty (excludign the Lyle portion of the property - as we can not
accept this as a public road until we own the proeprty) and reduce the letter of credit to that needed for the warranty
work plus additional funds to cover the park trail and portion of Redwood Street on the Lyle property.
Construction of the park trail needs to be completed and the easement for this trail needs to be provided. Security to
cover this will be kept until that is done.
Lyle property - Row and easements need to be dedicated to the City for this property. I forwarded you the
information and forms for this previously. Please be aware that if these are provided after ]an 1, 2006 that a
processing fee of $250 for each document will be charged in addition to the filing fees that are needed.

As was discussed at our meeting on site on March 10, 2006 a variance request to Figure 16-1 Vertical and
Horizontal Clearances for Sidewalks to allow for the installation of an 18 inch high rock wall with a one foot
setback from the back of sidewalk was approved with the following conditions:
The rock wall is to be composed of large pieces of stone of adequate mass that the walls are unlikely to
slough. (Requiring only 1-2 pieces to achieve the 18 inch height).
The effective height of the wall will be reduced as the effective height of the building foundations can
be reduced. As was discussed in the field the further away the buildings are from the pond (moving
north) the lower the effective height of the foundation would be and as such the effective height of the
walls would be lowered.

We met with Jeff Hill of the City of Fort Collins Water / Wastewater Department on Monday,
March 18th and work-sessioned on the Vine Drive water line coordination issues. We discussed
your comments of March 5 and incorporated some fairly lengthy construction notes that we hope
will accommodate the City and ELCO when the Vine Drive water line installation occurs.
We were advised that the proposed Vine Drive paving project by the City of Fort Collins
Engineering Department, will include widening Vine Drive to 36' feet with two (2) travel lanes
and two (2) bike lanes. We have also been advised to install the water line at the proposed future
ultimate Redwood Street location (the existing Linden Street intersection) at this time.
Please review the sheets noted to see if our approach as it relates to ELCO facilities is
satisfactory. Also scan through all sheets to see if there are any sheets that should have an ELCO
approval block added, and if there are any sheets that should have an ELCO approval block
removed. I noticed we put an ELCO approval block on Sheet 18, We are removing it. We have
an ELCO approval block on the Redwood Street Ultimate and interim Plan and Profile sheets.
That may or may not be appropriate since they are street plan and profile sheets.

I'm sending this out as a heads up for a potential problem as it relates to the Old Town North development
project just east of College Avenue and North of Vine Drive.
I've heard rumbling that the developer, Monica Swear is unhappy with the way the City is processing her
project and that she will probably visit with John about her concerns. My intent is to provide some
preliminary information to you all, so John can be better informed if he is contacted by Monica.
This project is designated as affordable housing that is being proposed on a very difficult site to develop.
The property is in the Poudre River product 6 corridor, the Dry Creek flood plan and is bordered by the
Redwood Street realignment extension through the State Highway Department's maintenance yard on the
east. Consequently, there are many issues that need to be overcome before development can occur.
As a brief overview I will highlight some of what has transpired to date. Staff will provide a more detailed
report prior to next Tuesday's Growth Management Lead Team meeting in which we would like to have a
more indepth discussion about this project.
1. This project came into the system as the last of our Pilot Projects, due to it's complexities.
2. In our initial meetings with the applicant and her staff the major City issues were laid out and
discussed.
3. The applicant and the City worked to get the project ready for hearing.
4. The project was taken to hearing with staffs approval knowing there were still some outstanding
issues. However, we (staff) felt comfortable that the issues could be resolved.
5. About 8 months after the hearing the applicant resubmitted the project for Final Compliance. At this
submittal we found that the entire site had been lowered by a least a foot from what we had previously
seen. Unfortunately, the lowering of the site was not just a matter of dropping everything by afoot. It was
a redesign of the project to adjust the vertical differences. For us the final review become much more
then the normal checking of minor details, and plan clean up, it became a complete new review.
6. Staff has just completed the second round of review and there are still some issues which need to be
addressed before we are ready to sign Mylars.
A. Lowering of the site has created problems with meeting Storm Waters design criteria. The current
pond does not have enough volume for the project. in order to get the needed detention pond capacity
some lots maybe lost.
B. New construction phasing lines now create long dead end alley's which will require temporary turn
arounds or temporary additional access points out to the street system. Either alternative will also create
the lost of some lots or the inability to obtain building permits on these lots until the project is complete.
It's these issues which I believe Monica will use to claim that we are not treating her project fairly. It must
be understood that as the request for additional information was provided to us, staff has been able to
understand more clearly the impact of adjusting the grades has had on the overall site. It is my desire that
John be informed of the potential conflict with Monica and staff not be criticized unfairly, before the
complete facts are presented.

Request to use a v-pan in lieu of the drive -over curb and gutter that is required for alley
option (B)
In accordance with Detail 7-12F Latimer County Urban Area Street Standards an alley that slopes to one
side shall have a drive -over curb on the low side.
The applicant has submitted a variance request to be able to provide v-pan in lieu of the required drive -
over curb and gutter that is required.
Prior to the submittal of this variance I spoke to Shear Engineering regarding concerns with the use of a v-
pan for an alley section that drains to one side. Concerns were the drainage flows that would now be
outside of the public right-of-way and potential impacts on the properties and structures, as a six-inch curb
keeps much of the drainage within the alley section. Shear Engineering has looked at the drainage impacts
and is proposing drainage easements and setbacks for structures and landscaping to prevent impediment
and backing up of drainage flows.
Therefore I recommend approval of this variance with the conditions that the drainage easements are
provided as necessary, no fencing or structures shall be placed within these easements, landscaping being
limited to items that will not impede stormwater flows within these easements, finished floors elevations be
a minimum of 1 foot above the 100 year water surface elevation and that the entire alley section be
concrete. They are currently proposing a all concrete alley section so this requirement will not impact the
