[5110/051 This item was not included in the variance request as stated In the responses to
comments. It still needs to be addressed, either by reducing the radii on the plans or
requesting a variance.
[3/18105] The standard radius for the driveway onto Lemay is 20', not 25'.

[5/10/051 The variance request letter still does not address all of the required elements
needed to justify the variances. Please review LCUASS 1.9.4 and include all required
elements. Mike Herzig will be glad to meet with you to further explain what is needed. One
key item is that you, as a PE, need to explain why, in your professional opinion, the variance
request should be supported, and if it has any effects on public health, safety, and welfare,
City maintenance costs, and design life. It is not enough to say that certain City staff thinks
it is ok, therefore it is ok. It is fine to reference outside materials (i.e. the letter from the
planner regarding the sidewalk), but the engineer must still provide analysis and a
recommendation.
Also, please remove the setback item - it is a planning item and is not covered in LCUASS.
[3/18/05] The variance request for driveway separations on Lemay needs to be rewritten - it
NEEDS TO ADDRESS OAK RIDGE to the north, and the church driveway to the northwest,
which is very close to this proposed drive cut. Safety, health, and welfare of the public
needs to be addressed as well, and the request needs to be stamped. It might be helpful to
review LCUASS 1.9.4 for the items needed in a variance request.
It is the City's intent to grant the variance once the revised request is received.

(5/10/051 It appears that the proposed offsite easement will overlap an existing structure.
This is not permitted. Please revise the easement.

[5110/05] Please explain why holes are proposed in the metal coverings for the sidewalk
culverts.
Number: 55 Created: 5/13/2005
[5/13/051 The letter of intent for the offsite easement and the revised variance requests
must be submitted no later than June 2nd.

Topic: Drainage
Number: 12 Created: 3/18/2005
[3/18/05] Approximately 25% of the site is shown to drain to the driveway to Rule and over
the public sidewalk onto the street. This is not allowed. The water must be diverted,
perhaps to an under -walk drain, so that it does not cross the walk. Does this water need to
be treated?
Number: 14 Created: 3/18/2005
(3/18/05] Please use the standard under -walk drain from the pond onto Rule - straight
chase (no bends) and only 2' wide unless otherwise approved by Stormwater. Also, the
metal covering should extend from 2' behind the walk out to the curb, per the detail.
Number: 15 Created: 3/18/2005
[3/18/05] The offsite work shown northeast of the project - are there existing easements to
accommodate this? Please show/label/include the reception number of these easements,
or provide a letter of intent from the adjacent property owners to dedicate needed
easements.
Topic: General
Number: 2 Created: 3/18/2005
[3/18/05] The sidewalk along Lemay should be located at the back of the ROW, as opposed
to meandering in the middle of the parkway. Also, the new street trees should be located in
the ultimate parkway, approximately S from the edge of the walk when it is placed against
the ROW.

[3/18/051 The proposed 10' utility easement on Lemay still needs to be approved by XCEL.
Number: 6 Created: 3/18/2005
[3/18/051 The portion of the sidewalk on Rule that is located outside of the ROW needs to
be placed in a public access easement on the plat.
Number: 7 Created: 3/18/2005
[3/18/05] Parking setbacks (LCUASS Chp 19) need to be met from both Rule and Lemay.
On Lemay, the first parking stall should be no closer than 75 feet from the Lemay flowline.
On Rule, the first parking stall should be no closer than 50' from the Rule flowline.
Number: 8 Created: 3/18/2005
(3/18/05] On the site plan, please label existing ROW widths for Lemay and Rule, and
proposed parkway widths.
Number: 18 Created: 3/18/2005
[3/18/05] The standard radius for the driveway onto Lemay is 20', not 25'.
Number: 19 Created: 3/18/2005
[3/18/05] Driveways should be concrete to ROW line. If the concrete is extended beyond
that, an expansion joint should be provided at the ROW line.
Number: 21 Created: 3/18/2005
[3/18/05] Please see redlines and utility plan checklist for any additional comments.
Number: 22 Created: 3/18/2005

(3/29/05] It appears that a segment of the proposed stormwater line offsite (northeast
corner) is not within an existing easement. Please provide a letter of intent from that
property owner prior to scheduling a hearing, and the completed deed must be submitted
prior to mylars.
Number: 28 Created: 3/29/2005
[3/29/051 Please see redlines for any additional comments.

Topic: Grading
Number: 13 Created: 3/18/2005
[3/18/051 The grades in the ROW and across the sidewalk appear to be too steep to meet
ADA for the sidewalk (2% cross -slope) and the slope requirements for 2' each side of walk
(2%). The maximum slope in the ROW is 4:1. Anything above that would require a
retaining wall, which would require an engineering variance, which would not be looked
upon favorably.
Number: 16 Created: 3/18/2005
[3/18/051 Offsite grade lines should be shown for at least 50' offsite.
Number: 17 Created: 3/18/2005
[3/18/05] Please provide vertical detail(s) of retaining walls.
Topic: Plat
Number: 9 Created: 3/18/2005
[3/18/05] Please use most current plat language (see attached). The language shown is
several years old.
Number: 10 Created: 3/18/2005
[3118/05] The emergency access easement should be dedicated only in the drive aisle and
no parking areas/landscaping/curb/etc. should be within that easement.
Number: 11 Created: 3/18/2005
[3/18/05] Please show all easements on the plat.
Topic: Utility Plans
Number: 20 Created: 3/18/2005
[3/18/05] Show approximate street cuts and add note: Limits of street cut are approximate.
Final limits are to be determined in the field by the City Engineering Inspector. All repairs to
be in accordance with City street repair standards.

(5/10/05] The intersection at Lemay Avenue and Rule Drive along the front of your site
indicates directional ramps, which are to standard, that align with radial ramps to the south
and west. This creates an awkward maneuver and could be mitigated by moving the
directional ramps closer together to reduce the offset currently created.

[5/10/05] 1 received a draft of an easement (for detention pond installation and
maintenance- a temporary construction easement and a permanent maintenance/repair
easement), a sketch of a proposed easement (for a "storm sewer easement" which doesn't
seem to be included in the previous easement language), and a legal for that easement (but
titled as a "construction easement"). To go to hearing, a letter of intent from the adjacent
property owner(s) stating that they intend to dedicate the necessary easements for this
project to go forward, is still required. Also, please provide all the exhibits referenced in the
draft easement so that we can understand what is being proposed. This offsite easement
will need to be public, too. I have attached the City's standard deed of dedication for an
easement (with P and Z acceptance). Please use this language for the offsite easement.
[3/18/05] The offsite work shown northeast of the project - are there existing easements to
