PROJECT: Building Permit Review, Enlarge existing single

The property is located in the NC zone, which zone does not allow detached single
family dwellings. The existing detached single family home at 619 S. Lemay is
classified as an existing limited permitted use. The LUC requires that an addition to
such a use that increases the floor area by more than 25% can only be allowed if the
property is brought into compliance with the requirements of the LUC. However,
With respect to Article 3, single family dwellings need only comply with Sections
3.4.7 and 3.8.

short turn around, but the plan appears to be fairly simple and hopefully
it can be reviewed quickly and comments can be returned — thanks)

1. Dedicate additional right-of-way. (Provide a half width of 57.5 feet)
2. Dedicate a 15 foot utility easement behind the new row.
3. Provide any additional easements as necessary.
4. Easements and row can be dedicated by separate document. See attached for process and sample language.
5. No additional driveway cuts will be allowed onto Lemay, the new garages drive will need to connect into the
existing driveway.
6. Need a minimum of 20 feet from the garage door to the new property line.
7. Will need to repair/replace any existing damaged curb gutter and walk and an curb Butter and walk damaged
during the construction process. `

PROJECT: ENLARGE EXISTING SINGLE FAMILY DWELLING
AT 1619 S. LEMAY BY MORE THAN 25%
The property is located in the NC zone, which zone does not allow detached single-family
dwellings. The existing detached single-family home at 1619 S. Lemay is classified as an
existing limited permitted use. Per Section 1.6.5 of the LUC, an addition to such a use
that increases the floor area by more than 25% can only be allowed if the property is
brought into compliance with the requirements of the LUC. However, with respect to
Article 3, single-family dwellings need only comply with Sections 3.4.7 and 3.8. A
similar request for an addition was submitted for review in February, 2002. However, the
applicant did not pursue that. The applicant is initiating a request at this time for a
differently configured addition, but one which still exceeds a 25% increase in floor area.
All comments must be returned to Peter Barnes in Zoning by April 21,
2004. A copy of your comments from the 2002 review is included for
your reference. THIS PROJECT IS NOT IN DMS, SO HARD COPY
COMMENTS WILL HAVE TO BE RETURNED.
