City of Fort Collins Engineering Department
Lance Newlin
281 North College Avenue
Fort Collins, CO 80522-0580
Subject: Maple Hill Phase 1 Public Improvements
Dear Lance:
As you are aware, there were two original Letters of Credit in place with the City of Fort
Collins covering the estimated cost of the public improvements for the Maple Hill Project
Phases 1 and 2. L.O.C. #040010 was in the amount of $1,055,558.00 for Phase 1.
L.O.C. #040011 is in the amount of $647-466.00 to cover the Phase 2 improvements
This letter is making two requests regarding the Maple Hill Project and the relevant
L.O.0 's mentioned above.
1) Reduction of Phase l L.O.C. #040010 to $205,918.00.
This requested reduction is due to continuing work and completion of Phase
1 public improvements. The original LOC amount was reduced by $576,114
last month for work then completed and an additional $273,526 has been
completed and inspected since that time. The remaining amount of $205,918
will cover the final phase 1 work yet to be finished which consists of
approximately $60,000 of concrete work and $150,000 of street paving.
Included with this letter is a spreadsheet which details the work completed to -
date.
2) Release / Reduction of Phase 2 L.O.C. #040011 to $0.00.
At the time of the issuance of the Development Construction Permit for this
project. J2 Development was working with Dave Stringer on a revision to the
project phasing plan. The estimate of public improvement costs and
inspection fees for each phase was based on the new proposed phasing, which
is what is current basis for actual construction and which is now being
finalized with Katie Moore. At the time Dave's thought was to issue the DCP
and collect LOC's and inspection fees for Phases 1 and 2 to ensure that there
was adequate financial coverage since the phasing was at the time a
unfinalized, "moving" boundary.
J2 Development would like to now take down the Phase 2 Letter of Credit
since the phasing is final and our construction schedule is such that we will
not begin construction on Phase 2 until sometime in 2005. We fully
understand that the DCP would no longer be in effect for Phase 2 and that we
Sent By: J2 Development/Management; 7208900118; Oct-18-04 11:34AM; Page 3
will have to re-establish the LOC in the full phase 2 amount prior to
continuing with any work outside of the Phase 1 area.
A Request for Amendment or Release of Letter of Credit form is also included for each
of the above requests which would need to be completed and signed by the appropriate
City personnel.
Please let me know if you have any question or require any additional information. Your
assistance in completing these reductions in as quickly a manner as possible would be
greatly appreciated.
Sincerely,
Brad Lenz
