Re: Sand Creek Village P.U.D.
In response to the building permit releases requested on June 8, 1981
the storm drainage engineer has agreed to release permits for 612, 616
and 620 Agape Way. The construction of the storm drainage systen is to
be completed prior to the release of any further building permits as
stated in the subdivision agresTbent for Sand Creek Village P.U.D. dated
July 28, 1980.
In addition, before the City will release certificates of occupancy
for these three units the following items are to be completed:
IP Willox Lane - curbs, gutters, sidewalks and street pavement from
Redwood Street east to 100' southeast of the intersection at Agape Way.
• Agape Way - curbs, gutters, sidewalks and street pavement to end of
street limits.
Street sign, i.e. traffic control, street name.
• Utilities - telephone, gas, electric, water, sewer and storm sewer.
Street lights.
• All other improvements required as a condition of approval of the plat.
If the above itans are not completed, monies can be escround either by cash
deposit or an irrevocable letter of credit as approved by the City Attorney's
office.

Dear Mr. Pickett:
On Wednesday, June 25, 1981, Bob Smith, Mauri Rupel and I met
with Assistant City Attorney Paul Eckman to discuss your problems
regarding the Saul Creek Village P.U.D.
As you requested alternatives were discussed in order to allow more
building permits and certificates of occupancy. For the units on
Agape Way the City Engineering Division will release eleven (11)
additional building permits and a total of fourteen (14)
certificates of occupancy provided the following conditions are met.
• Monies escrowed for your pro rata share of the overall
Greenbriar storm drainage improvements that service
your property.
• A temporary retention pond is to be built in the north east
corner of Willox Lane and Bramblebush Road.
• Willcx Lane is improved with curb, gutter, sidewalks and
asphalt pavement from Redwood Street south east to fifty
(50) feet past the southern parking area entrance off Willox
lane (a solution to the power pole removal in Willox lane east
of REYdWO)d must be resolved).
• Agape Way - curbs, gutters, sidewalks and asphalt pavements
to end of street limits.
• Street Signs - i.e. traffic control and street names.
• Utilities - telephone, gas, electric, water and sewer,
storm sewer as necessary for the required temporary
retention porn.

Driving through your subdivision I noticed a large area of
street settlement adjacent to the catch basin on Agape Way.
From the amount of settlement which has already taken place
it is apparent the backfill material was not properly con;oacted,
Therefore, before the City will accept the street improvements
for this phase of Sand Creek P.U.D. the settled area must be
recompacted and the street surface restored.

TO WHOM IT MAY CONCERN:
On October 14, 1982 David Pickett, the developer of Sand Creek P.U.D., was
contacted by the City of Fort Collins' Engineering '_vision. Mr. Pickett
was notified of the need for minor street repairs in the first phase of
the Sand Creek Planned Unit Developmnt.
Since the City requires a developer to construct public improvements
to established specifications and standards prior to their acceptance
by the City, Mr. Pickett was informed that the City would not accept
the street imTprovements (Agape Way) until such time as the necessary
repairs had been made.
The following repairs are necessary:
I. Remove the collapsed portion of street and backfill material
adjacent to the storm water inlet.
2. Replace and recompact the backfill material.
3. Replace the asphalt street section including subbase, base
and asphalt pavement.
I have since received a letter from Mr. Pickett dated November 10, 1982
informing the City that the Sand Creek P.U.D. and Sand Creek Townhomes Ltd.
a Co -=do Ltd. Partnership is in federal bankruptcy court, Case No. 82B03106C.
In addition, he stated all correspondence should be directed to your firm.
This letter is to inform the United Bank of the City's request regarding
the street repairs on Agape Way. These repairs are to be completed prior
to the acceptance of this street for maintenance by the City of Fort Collins.
Developers are responsible for the necessary repairs to all public improvements
installed during the construction of their developments during the normal
warranty periods. When repairs are necessary, the developer generally
contacts the responsible contractor and requests the defective work be corrected.
In addition, the City requires contractors who work within the public
right-of-ways to be licensed and bonded. This in turn helps the developer

when repairs are necessary. However, if the developer cannot correct
the situation himself, then the City will contact the responsible
contractor's bonding ccapany and request their assistance in the matter.
As to the needed repairs in this developmnt, the City will not accept
the street i:rprovements until the necessary repairs have been coinpleted.

Dear Mr. Miller,
Recently you contacted me concerning what alternatives might be considered by
the Storm Drainage Division regarding drainage improvement requirements at the
above referenced development.
As you are aware the existing development agreement for Sandcreek Village
specifically states that no more than 2 building permits and certificates of
occupancy (CO's) will be issued for that portion of Greenbriar P.U.D. draining
to the west detention pond prior to the construction of the outlet facillities
for that pond. All of Sandcreek Village is designed to route storm water to the
west pond and there are currently 3 units constructed on Agape Flay. The existing
development agreement further states that no more than 22 building permits and
CO's will be allowed within that portion of Greenbriar P.U.D. which drains to
the east detention pond prior to the construction of the outlet facillities for
that pond.
During our meeting on October 4, 1983 you indicated that it would be financially
impossible to construct the outlet facillities for the west pond at this time
due to the limited amount of additional units you wish to build at Sandcreek
Village. From what I understand your alternate proposal was to regrade the
existing site to route the runoff into the eastern detention pond and thus be
able to conform to the development agreement and construct additional units. In
order to reduce the additional volume of runoff to the eastern pond your
proposal was to add an additional floor to the proposed buildings therefore
decreasing the amount of buildings (impervious area) but at the same time
keeping the amount of units at a profitable level. Finally because there is no
outfall to the eastern pond at this time you proposed to construct a pond onsite
to temporarily retain the runoff generated by the additional development.
After considering your proposal the theory sounds feasible for the Sandcreek
Village development however we are concerned with the additional area east of
Bramblebush Street that would also have to be regraded to drain to the east
pond. Since the east pond is already constructed its existing volume would not
be able to handle the additional runoff from this area. In order to drain this
area additional detention ponds would have to be constructed or a storm drainage
outfall would be required to route runoff to the west pond. This would create
serious problems for future developers and would also radically change the
current drainage plan for Greenbriar P.U.D.. Because of this we cannot accept
your proposal to change the routing of the runoff from Sandcreek Village. The
ultimate outfall of runoff from this site must be the west detention pond as
stipulated in the Greenbriar P.U.D. drainage report.

Your proposal to temporarily retain runoff onsite however is acceptable.
Attached please find a copy of a letter dated June 29, 1981 from Dave Stringer,
Chief Construction Inspector to Mr. David Pickett, previous owner of Sandcreek
Village. This letter indicates that prior to the construction of the outlet
facillities for the west pond the City Engineering Division will allow eleven
(11) additional building permits to be released provided that a temporary
retention pond be built in the northeast corner of Willox Lane and Bramblebush
Street. In order to be consistant with requirements placed on the previous owner
we are willing to honer this condition of the letter at this time. The first
condition of the letter concerning monies to be escrowed will not apply as you
will be paying a Storm Drainage Basin Fee that will cover your share of the
Greenbriar storm drainage improvments. Any remaining conditions may or may not
apply depending on additional requirements stipulated by other departments.
As far as the Storm Drainage Division is concerned you can construct up to
eleven (11) additional units making the maximum total of units at Sandcreek
Village fourteen (14) provided you construct a temporary retention pond to
retain the storm water runoff generated by the maximum amount of development.
Please contact other reviewing departments to determine any additional
requirements you will need to address.

Dear Mr. Hiller,
The Storm Drainage Division has completed review of your preliminary submittal
for the proposed Sandcreek Village project received by us on January 6, 1984. It
was noticed that the extent of development is substantially larder than what was
previously considered in September, 1933. From what I understand you are now
proposing to develop the entire parcel and route storm drainage runoff to the
proposed Greenbrlar Pond imd West Detention Facility designed by Resource
Consultants, Inc. in. 1979. Also includes with your submittal was a preliminary
drainage report prepared by Was H. Stewart and Associates, If lc. :fated January
5, 1984. The report indicated the detention land and store: drainage inlet and
outlet works are to be constructed in conjunction with the Sandcreek Village
project. This new concept in the drainage plan raises various; issuses that nced
to be addressed prior to final approval.
First of all the Plan for the proposed detention pond designed by _Resource
Consultants, Inc. is now obsolete. In Feburary, 1981 Engineering Professionals,
Inc. prepared for the City the Evergreen Par: Basin h1jor Storm Drainage Study.
This study recerr..ends a smaller detention land located in and serving the same
area as the pond designed by Resource Consultants, Inc..The outtall fro:', the
pond as recommended: iIl the ,study ties into the existing Greenbriar pond to the
east Which is planned to Cutfall into the Greeloriar Drainage Basin Outlet alcng
