This letter is a follow-up to our February 6, 2004 meeting and February 12 phone conversation
regarding the vacation of a portion of the casement along Cambridge Avenue.
On behalf of Imago Enterprises, Inc., BHA Designs is in the process of preparing an amendment
to the Harmony Technology Park O.D.P. to include in the O.D.P. the three (3) properties owned
by Imago Enterprises at the south end of Cambridge Avenue. The addresses are 4800, 4804 and
4909 Cambridge Avenue. These three currently residential tracts, plus 4708 Cambridge Avenue,
comprise the property of the City -initiated enclave annexation scheduled for the Citv Council
approval in March. 2004.
As you know, the right-of-way dedication is in place and the final engineering is approved for the
new alignment of Cambridge Avenue (to be renamed) from Harmony Road to Rock Creek Drive.
In that the Imago three (3) properties will be added to the adjoining approximately 65 acres
owned by Imago and part of the Harmony Technology Park O.D.P., it makes sense to include the
to -be -abandoned 30 ft. right-of-way on the west side of these three (3) properties as part of the
amendment. It also make sense to include the right-of-way in front of the formerly two (2) tract
south of 4808 Cambridge that is now part of the O.D.P.
Attached is a Tract map showing all the initially -created residential tracts in the county along
Cambridge Avenue. The area for vacation is indicated. The frontages are:

unnecessary amendment would be required in the future.

Dear Gloria:
The developer's engineer for this project, J.R. Engineering has requested that the City of
Fort Collins endorse their request to be relieved of the asphalt overlay requirement in
connection with the striping revision at the rebuilt intersection. It is our understanding
that CDOT requires a 2 inch overlay prior to apply revised striping on State highways.
We are also told that CDOT may waive the overlay requirement if the State has a
maintenance project scheduled within six months of the new striping application. The
developer's request to be relieved of the overlay requirement in this case is acceptable to
the City. We do, however, recommend that the developer be required to apply a
pavement sealcoat in place of the overlay prior to application of the new striping plan.
Given that the striping will be temporary pending maintenance, this should provide for
adequate visibility.

General Comments:
l . CDOT's approval block has been removed.
2. The cross sections of Harmony, on Sheet 35, have been adjusted to reflect the interim
paving.
3. The cross walks have been adjusted to run perpendicular to Harmony.
4. Handicap ramps have been added to the north side of the intersection of Hannony
and Cambridge, including a painted crosswalk running east west along the north
side of Iannony.
5. The pedestrian refuge has been removed.
6. The stenciled bike logos for the bike lanes and signs have been removed. We
have striped off the bike lane for the interim use. Additionally we have added
phase I construction language to the cover sheet.
7. The side swales along Cambridge have been design with a 1.0% longitudinal
slope. This is now Labeled on grading sheets.
8. A note was added to Sheet 8 stating the median is to be hardscaped with stamped
concrete.
9. Attached is an exhibit of the turning movements for a truck and trail entering and
exiting the existing private drive from Cambridge Ave.
l o. The storm pipes have been adjusted to provide the most cover available. We have
added a note to the appropriate sheets regarding an adjusted section of asphalt
over these sections of pipe. An addendum to the original drainage report is
attached.

Re: Improvement of Cambridge Avenue
Dear Marc:
The City of Fort Collins approved the Second Filing of the Harmony Technology Park, which plans
were submitted by the Hewlett-Packard Company for on approximately 800,000 square foot office
park adjoining the west side of Cambridge Avenue. A major design element of this Second Filing
was the engineer ng for Cambridge Avenue from Harmony Road to Rock Creek Road. Hewlett-
Packard did not proceed with the development of this project and has no plans to do so in the
foreseeable future.
Separate from the planning and engineering review process for the Second Filing, Hewlett-Packard
submitted to the City (for informational purposes) a copy of the June 25, 2001 Reciprocal Land Use
and Improvement Reimbursement Agreement (the "Agreement") between Hewlett-Packard and
other private property owners in the area. This agreement identifies offsite infrastructure
improvements beneficial to the parties (i.e., water and sanitary sewer line extensions, storm sewer
and streets), the cost sharing arrangement, and method by which a party to the Agreement can
become the "constructing party" for any of these improvements. Most of these improvements have
already been installed pursuant to the Agreement. Cambridge Avenue and the Harmony Road/
Cambridge Avenue intersection still need to be completed.
Pursuant to its rights under the Agreement, Imago Enterprises, Inc., a party to the Agreement now
wishes to improve Cambridge Avenue and the Harmony/ Cambridge Avenue intersection.
Accordingly, Imago submitted to the City modified plans for the improvement of Cambridge
Avenue. These plans would allow Cambridge Avenue to be constructed as a "stand alone" project,
independent of any other improvements contained in the Second Filing.
To the extent required by the City, Hewlett-Packard consents to the use of Second Filing
engineering to produce a "stand alone" design for the improvement of Cambridge Avenue and
the intersection. Imago Enterprises, Inc. is proceeding under the authority of the Agreement, arc
Hewlett-Packard assumes no responsibility for these improvements other than those contained in
the existing Agreement.

A number of staff members have requested a set of the concepts for the Harmony Technology Park that we
reviewed with you this week We contacted HP to have permission to release the concept plans for your
review. Since HP is a large employer in the City, there has been much curiosity and media coverage of the
Greeley plant closing and the Harmony Technology Park site. Since we have not yet formally submitted plans
to the City, and are looking at conceptual plans at this time, we do not want these plans to be widely
distributed. But in the spirit of the Pilot Process, we want to share as much information with the City as
possible to facilitate the review process.
I've attached l lxl7 versions of the Concept Plans GA and G.2. Please feel free to call with any questions,
and we look forward to working with you on the City Pilot Process for this project.

Dear Mark:
I am writing in regard to the street geometry proposed for the potential first phase of Harmony
Technology Park (HTP) as we discussed in our meeting of June 5, 2000. Attached you will find
three cross sections that reflect our understanding of the modifications deemed acceptable to the
City of Fort Collins. In addition, I have included a summary of items relating to the onsite
streets.
The HP design team is in the process of preparing Schematic Design level plans for submittal to
the City on June 22, 2000 based on the following understanding.
• Cambridge Road will be classified as a "Modified Collector". All design criteria for a
standard Collector roadway shall be in effect with the exception of a wider parkway (I0-feet)
and sidewalk (6-feet).
• Cambridge Road may deflect a maximum of 10 degrees off of Harmony Road, in accordance
with current City criteria, in order to accommodate the shifting of right-of-wav onto the HP
property.
• Raised landscaped medians may be used internally, even though they are not shown on the
standard City street sections for these categories. Technology Parkway may be considered a
"Modified Collector" due to the potential addition of said raised median.
• Design lane tapers shall be based upon the ws2 /60 formula in lieu of a straight ratio. The
design speed for Cambridge shall be 40 mph, not 35 mph, per your follow up phone message.
• Access to the east off of Cambridge Road just south of Harmony Road shall be considered
temporary in nature until such time as a roadway may be realigned with the proposed HTP
access to the west.
• Outfall curb and gutter around the raised medians will be acceptable as long as "Bubbler"
irrigation is utilized rather that "spray" irrigation.

County Road 9 shall be designed as an Arterial roadway from Harmony Road to the
southwest corner of the HTP property. The City will modify their Master Streets Plan
accordingly.
Per my phone conversation with Mike Herzig, the two east -west cross streets proposed with
Option G.2 are to be classified as "Modified Commercial Local". The modification relates to
the elimination of on -street parking and the potential addition of a 6-foot median as shown on
the attached section.

As we have discussed by phone, several of the major property owners and developers
south of the Harmony Road/ Cambridge Avenue intersection wish to initiate the
improvement of Cambridge Avenue between Harmony Road and Rock Creek Drive.
These include Chateau Development (developer of Morningside Village), Village Homes
(developer of Observatory Village), and Imago Enterprises, Inc. that owns 70 acres on the
east side of this portion of Cambridge Avenue, which property is part of the Harmony
Technology Park Overall Development Plan.
This one-half mile stretch of Cambridge Avenue has approved final engineering as part
of the Hewlett-Packard's Harmony Technology Park O.D.P. Second Filing. Mike Brake
with JR Engineering and I have met recently with City staff, including Cam McNair,
Basil Hampton, Lave Stringer and Mark Verata to discuss reformatting the engineering
for Cambridge Avenue into a stand alone improvement and completing the A -line and
permitting process with CDOT.
We have received comments that the City intends to rename Cambridge Avenue and that
you are responsible for coordinating the renaming process. Having an agreed upon name
for this important. roadway is important for the engineering revision and CDOT
application processes. This letter serves as a formal request that you begin the process for
determining a permanent, new name for Cambridge Avenue. I understand that this
process will invo'dve meetings with the neighboring property owners and final approval
from City Council. Therefore, we request that you begin as soon as possible. We greatly
appreciate your efforts, and I look forward to hearing from you with a projected schedule
and timeframe.

We have prepared this submittal package for the above referenced
project on behalf of Hewlett-Packard (HP) for your review of the
Schematic Design phase through the pilot program of the City. The
submittal package contains the requisite information for this level of
review by City staff. Attached to this letter are seven copies of the
submittal, which include those items required in the PLC document. Our
design team has prepared drawings to illustrate the site plan for the
multiple buildings to be included in this PDP. In addition, we have also
prepared conceptual designs for the parking, detention, utility services,
grading and landscape, which provides the City with the major objectives
for development of this site. We have also included a copy of the current
updated master plan for the entire Harmony Technology Park for your
information.
As you know, the HP design team has met with the City staff on several
occasions regarding this project. The Schematic Design kick-off meeting
was held on 24 May 2000 and subsequent meetings have been held with
City staff including transportation and engineering. We have also met
with representatives of the Colorado Department of Transportation and
have received their input on this project. Our goal is to meet with you
and other City staff on 29 June 2000 at 3:00 PM MDT to receive feedback
and approval to proceed into the Design Development phase of the PDP
process. At this meeting, HP will provide direction as to the intent to
continue with the pilot process or to proceed under the traditional City
process for a PDP and FCP for the project site.
As a part of this submittal, we have included our understanding of issues
that have been discussed with City staff over the past several weeks.
Several of those issues require an agreement from the City that our
interpretation is correct and that we can rely upon the design direction we
have shown for our continuation of work on this project. The first issue is
that the design of Cambridge Avenue will be based upon the classification

as a collector street. The design for this street cross section is modified
to reflect the fact that 100% of the roadway dedication and utility
easements are on HP land. Conceptual road cross -sections have been
forwarded to City staff for review and are included in this submittal. The
second issue is that this master plan for the Harmony Tech Park site is
conceived as an arrangement of buildings in a campus setting. With this
planning direction established early on with input from City staff, we have
attempted to provide parking under the newly adopted guidelines that
allow for increases to the base parking ratio through incorporation of
certain design features. We have attached to the submittal an example of
a typical site plan for one building that illustrates the parking ratio of 4.5
per thousand square feet of building area based upon premiums earned
through site arrangement of parking in relationship to the building front
door and sides of the building. The master plan also includes no
provision for parking on the street, which also provides a premium to the
base parking ratio. We have proceeded with our design work regarding
the above issues based upon our understanding of the intent of the code
and in discussions with staff. Please advise if this approach is correct.
It is our understanding that at the conclusion of this phase of design, the
City will provide a written approval of the Schematic Design submittal and
based upon this approval, the design team will proceed with Design
Development for this project. Please let us know if this is a proper
understanding of your process under the pilot project process. If you
have any questions during your review of this submittal, feel free to call
me with any questions.

The Pilot Process SD 20% Sign -off meeting was held on June 29, 2000. Bruce Hendee gave a brief presentation to update
the status of the plans. Hewlett-Packard would like to proceed with the Pilot Process for entitlement of six building sites.
HP will pursue longer vesting for the site in order to build the initial phase out over time. The meeting broke out into
group discussions of planning items and utility items. We then reconvened and notice to proceed to the DD phase was
given.

In the course of reviewing my file on the Harmony Technology Park O.D.P., I found the
attached April 24, 2001 memo to me from Gary Diede, former Director of Transportation
Operations for the City of Fort Collins, confirming that the "city of Fort Collins will be
responsible for paying for the cost of design and installation of a new traffic signal light
at the intersection of Cambridge Drive and Harmony Road".
As we have been discussing, the developers on Observatory Village, Morningside Village
an Imago Enterprises, Inc. are considering undertaking the improvement of Cambridge
Avenue between Harmony Road and Rock Creek Drive. Our knowing that the signal is a
city expense, as we had believed it would be, is critical to our decision to proceed, and we
are relying upon Mr. Diede's assertion. Who would be the appropriate city staff for our
engineers to meet with to discuss revising the existing construction drawings to a stand
alone project and pursing A -line approval from CDOT?

Dear Mr. Hendee:
This letter is in response to plans for Harmony Technology Park Overall Development Plan
(Current Planning File #12-97C) submitted on June 21, 2000. Please note that staff reviewed
your plans and the Planning Division mailed a request for comments to several public agencies
and departments. This development proposal is subject to and shall comply with all requirements
set forth in the City's Land Use Code (LUC), specifically: Articles 2. Administration (Development
Review Procedures); Article 3. General Development Standards; Article 4. [Zoning] Districts; the
Harmony Corridor Plan; and, the City of Fort Collins Development Manual.
The City of Fort Collins, Land Use Code (LUC) requires that throughout all land use proceedings,
the burden to comply with all applicable standards rest with the applicant. Staff, after reviewing
materials submitted by the applicant, finds that revisions/re-design to the submitted plans dated
revised June 12, 2000 are warranted to meet the Land Use Code, the Harmony Corridor Plan, and
the City of Fort Collins Development Manual.

Rock Creek Drive and Cambridge Drive. Public access points need to be provided at
660-foot intervals.

K. Current Planning Department:
1) Section 2.2.11 of the Land Use Code requires that an applicant submit revisions based on
this letter within 90 days or the project application becomes null and void. Your response to
the City's concerns is due by October 17, 2000. A 30-day extension to this deadline is
available. Request for an extension should be directed to the Current Planning Director. If
remaining issues do not require plan revisions, a status report verifying continuing efforts
toward resolving the issues is required within the same timeline.
2) As discussed with Angela Milewski on July 12, 2000, the location of all proposed and
existing arterial, collector and connector streets and major pedestrian and bicycle routes,
including major points of access need to be proposed and shown on the plan sets.
3) As discussed with Angela Milewski on July 12, 2000, we need to sit down and discuss the
Alternative Compliance Request as submitted. The request to not comply with street
connections to the east across the Fossil Creek Inlet Ditch is compelling; however, the
elimination of street access designations into that portion noted as Webster Property is not.
In addition, in order to comply with 2.3.2(H) there is the need to provide additional street
connectivity on the north boundary 660 feet east of Cinquefoil Lane.
4) In order to Comply with 2.3.2(H) connectivity standards need not reference private access
points, but are to be more public in their connectivity designation on the Overall
Development Plan. Subsequent project development plans, will most likely be mechanism
in which potential access drives will be evaluated based on project parameters and
conformance to more specific City standards.
5) The Cambridge Drive Access Detail notes that Cambridge Drive is dedicated with a
seventy-six (76) foot street right-of-way and a nine (9) foot utility easement. It appears that
the nine- (9) foot utility easement is on private property, are these property owners
dedicating this easement? Please elaborate.
6) The legend needs to be revised to more clearly delineate property and overall development
plans boundaries.
7) Note on sheet 2 of 4 references that the site will receive water and sewer services from the
Fort Collins Loveland Water and Sanitation District, is this correct?
8) On May 26, 2000, the City Council approved a number of road changes within the City.
Please note that County Road 36 is Kechter Road, County Road 9 is Ziegler Road and
County Road 7 is now Strauss Cabin Road.
9) The plan needs to comply with all limitations imposed by the Land Use Code including
Land Use Standards of LUC Division 4.21.
Additional comments and the required number of revised plans may be forthcoming as the various
departments including the Current Planning Department and reviewing agencies continue to review
this request.
Please provide a written response to each of the above comments with the submittal of plan
revisions. In addition, a revised site development plan drawn to scale which is clearly dated and
labeled shall be submitted to address the above.

The discussion today was to determine what would be required of the developers for circulation roads
from the sites towards the west out to County Road 9. We decided a 36 foot width of Rock Bridge to
County Rd. 9 with Westbrooke and or Brookefield Hp could build Tech Parkway south to Rock Bridge or
their interior street south of Celestica out to County Rd. 9. If the Brookfield and/or westBrooke
development choose to use Cinquefoil then it must be right in / right out and the developers must build it to
CDOT access standards without waivers. Cambridge was left as you indicated. It will be the first
signalized when it meets warrants.
Marc and Mark will relay this information back to the developers consultants with hopes that they will have
prepared information for a meeting with Tess and Staff on 9/21/00 at 1:15 in conference room A.
Mark this on your calendar but it is tentative based upon the consultants ability to provide us information.

I just learned that there was a meeting held today to discuss the access issues along Harmony Road as
part of the Harmony Technology Project. I was surprised to have not been invited to this meeting since I
have attended prior meetings on this project/issue as well as due to my role in updating the Harmony
Road Access Control Plan.
Dave and/or Tess, could you please let me know what the outcome of your meeting was? I'm concerned
that it be consistent with what we have come up with so far on the Access Plan update, particularly the
sequencing of the future signals at Technology Parkway vs. Cambridge. Which is to be installed first? I
thought we were trying for the one at Cambridge first to at least get 1/2 mile spacing for a while before
installing the signal at Tech Pkway. What was decided today?

Following our meeting of September 7th, I had agreed to write up the understanding between the City and
HP regarding the signalization at the intersection of Technology Parkway and Harmony Road. the
following is my understanding of the results of that meeting. If anyone has a different recollection of the
outcome, please let me know. We are still attempting to set up a meeting with CDOT to let them know our
desires on this issue.
1. The City will "push" for the installation of a traffic signal at the intersection of Technology Parkway and
Harmony Road with the first phase of HP's new development. It is likely that the peak warrant warrant will
be satisfied to justify the traffic signal.
2. HP will not be required to extend Technology Parkway southward to the future Rock Creek at this time.
Also. HP will not be required to provide an east -west connection to Ziegler Road.
3. HP will be required to build a public collector between Technology Parkway and Cambridge.
4. For safety reasons, in the short term, Cambridge will become a 3/4 movement intersection. The
movement will allow for eastbound and westbound left turns into Cambridge and the older HP site,
respectively.
5. Willowbrooke will be required to extend Cambridge to Harmony and Rock Creek to Ziegler Road.
6. All improvements to Harmony Road, as agreed upon with Celestica will be completed with the
connection of Technology Parkway to Harmony Road.

SUBJECT: Street Improvements for the Hewlett Packard, Brookfield, & Willow Brook
Project Development Plans
Gentlemen:
This letter is intended to clarify the City's position on traffic and connectivity related issues
regarding the Hewlett-Packard and Brookfield project development plans within the Harmony
Technology overall development plan and the Willow Brook project development plan within
the Willow Brook overall development plan. The primary confusion for these projects is
defining their individual impacts as project development plans in the context that each will
contribute to the street network within the same mile section. Therefore, this letter will be
formatted to focus on the requirements that dictate certain street improvements for each
project development plan. Please note that CDOT approval is needed for many of the items
that the City supports below and that certain aspects of design have not been thoroughly
explored with this letter. Concerning the latter issue, the City is meeting with CDOT on
November 22, 2000 to discuss these issues with the intent of a coordinated response. The
street design issues should be discussed in more detail with the project engineer for each
project development plan.
Hewlett-Packard:
♦ The City is supportive of a traffic signal at the intersection of Technology Parkway and
Harmony Road with the first phase of Hewlett-Packard's new development.
♦ As a part of phase 1, the City will not require that Technology Parkway be extended
southward to Rock Creek Drive. In addition, the City will not require an east -west
connection from Technology Parkway to Ziegler Road. However, Technology Parkway will
need to be extended to the east -west connection mentioned below.

Technology Parkway and Cambridge Drive.
♦ The City will require that Cambridge Drive adjacent to Hewlett-Packard's new development
be constructed for safety reasons with a % movement intersection at Harmony Road. The
movement will allow for eastbound and westbound left turns into Cambridge Drive and the
older Hewlett-Packard site, respectively. However, left -out movements will be restricted on
both sides of Harmony. In addition, Cambridge Drive will have to be fully constructed adjacent
to Hewlett-Packard site.
♦ All improvements to Harmony Road, as agreed upon with Celestica will be completed with
the connection of Technology Parkway to Harmony Road.
Brookfield:
♦ The main issue with Brookfield has always been providing at least two points of access
from the existing public street network with one of the connections providing an adequate
improvement to the city's Improved Arterial Street Network, as described in Section 3.3.2(F) of
the Land Use Code. As one connection, the City will require the connection of Rock Creek
Drive from the site to Ziegler Road. The basis for this decision is primarily in the interest of
providing adequate allocation of traffic to the full arterial network with the emphasis of not over
burdening Harmony Road. In addition to that connection, the City will support the connection
of Cambridge Drive from the site to Harmony Road. Ultimately, CDOT will have the final
authority regarding the connection of Cambridge Drive to Harmony Road. With the connection
of Cambridge Road to Harmony Road, the City will require that the intersection be constructed
for safety reasons with a % movement intersection. The City would be receptive to other
connections provided that Rock Creek Drive is one of the connections. One alternative has
been Cinquefoil Lane. The City would support the connection of Cinquefoil Lane to Harmony
Road if Rock Creek Drive and Cambridge Drive were constructed first to Ziegler Road and
Harmony Road, respectively. In addition, the City agrees with CDOT that no waivers be
granted for the connection of Cinquefoil Lane at Harmony Road. This would mean full
construction of acceleration and deceleration lanes and any other related improvements,
including the correction of the sight distance problem at the Cinquefoil Lane/ Harmony Road
intersection.
Willow Brook:
♦ The main issue with Willow Brook has always been providing at least two points of access
from the public street network with one of the connections providing an adequate improvement
to the city's Improved Arterial Street Network, as described in Section 3.3.2(F) of the Land Use
Code. The difference between this project and Brookfield is that it has frontage on Kecther
Road. Therefore, the improvements necessary depend on the phasing for this project.
If the development begins construction on the north property line as was discussed in the
Willow Brook ODP Planning and Zoning Board meeting on September 21, 2000, the City will
require the connection of Rock Creek Drive to Ziegler Road to meet Section 3.3.2(F) of the
Land Use Code. The basis for this decision is primarily in the interest of providing adequate
allocation of traffic to the full arterial network with the emphasis of not over burdening Harmony
Road. The second point of access could either be provided through the development or with
the construction of Cambridge Road.

If this development begins construction adjacent to Kechter Road, then it will have to construct
Kechter Road to Ziegler Road to meet Section 3.3.2(F) of the Land Use Code. In addition, the
two points of access to the development could be satisfied with an adequate phasing plan.
However, at some point, as this project develops to the north, Rock Creek Drive will have to be
constructed from the development's eastern property line to Ziegler Road to distribute the
traffic impacts generated from this development to the arterial network.
I hope this letter clarifies the City's position on traffic and connectivity related issues regarding
the Hewlett-Packard, Brookfield, and Willow Brook project development plans. If there are
questions, please direct them through the City's Development Review Engineer assigned to
your respective project.

I met with Eric Bracke this morning along with Bob Almirall to discuss what
we currently have proposed for Harmony Road improvements between Technology
Parkway and Cinquefoil. Eric was fine with our ultimate design horizontal
layout. When I asked him what we need for vertical he said he would not
require anything for the Ultimate design. He did suggest that I discuss the
vertical aspects of the ultimate design with you. I would propose that our
Ultimate design does not include vertical design but is rather a horizontal
design only. Our design is for the acceleration of vehicles exiting
Cambridge and is not for the vehicles exiting or entering Cinquefoil. I
would suggest that vertical design is completed for the Ultimate layout of
Harmony Road from Cambridge to the Interstate when the intersection of
Harmony Road and Cinquefoil will be constructed and designed with its
respective project. Our project will do an interim design of Harmony Road
which will address the vertical between Technology Parkway and Cinquefoil.
However, it is for the interim only and not for the Ultimate.
After you have had some time to think about our proposition regarding the
vertical design of the Ultimate layout of Harmony Road please feel free to

This letter is from JR Engineering on behalf of Hewlett Packard, Fort Collins, for the purpose
of retaining the right to create easements across your property. The easements are for the
installation of storm drain and sanitary sewer. The storm drain will be extended from the
Fossil Creek Reservoir Inlet Ditch (FCRID) to a connection point at the future intersection of
Rock Creek Drive and Cambridge Avenue. The sanitary sewer will connect to the north end
of the Willow Brook development (south boundary of your property) and extend to a
connection point at the future intersection of Rock Creek Drive and Cambridge Avenue.
Currently the storm drain and the sanitary sewer main are being designed as part of the
Willow Brook development and are planned to be entirely within the City of Fort Collins
public right-of-way. This letter assures the City of Fort Collins that if the development of
Harmony Technology Park precedes the development of the Willow Brook project, you
intend to grant easements for storm drain and sanitary sewer service across your property.
This assumes, as mentioned, that Harmony Technology Park will require approval prior to the
creation of the public right-of-way and the construction of the sanitary sewer and that the
Harmony Technology Park Amended O.D.P., as approved by the Forc Collins Planning and
Zoning Board, is executed by all involved property owners.
This letter is a requirement of the City and will be provided to them in our plan submittal

It is my understanding that you are preparing to submit a Preliminary Development
Plan on behalf of Hewlett-Packard with regard to their development of a portion of
the Harmony Technology Park. In connection therewith, you have requested that the
Electric Equipment & Engineering Company Employee Profit Sharing Trust, as the
owner of neighboring property, confirm its intention to negotiate for the dedication of
certain easements serving the Hewlett-Packard property.
The specific easements in question relate to storm drainage extending east from
Cambridge Avenue to the Fossil Creek Inlet Ditch, and sanitary sewer extending east
from Cambridge Avenue to the approximate location of Cinquefoil Lane. Both
easements would be located within the area of the proposed public right-of-way for
Rock Creek Drive. It is my understanding that the easements will not be required to
be in place until such time as Hewlett-Packard submits its Final Development Plan for
their property. It is also my understanding that the granting of any easements will be
at no cost to the Trust.
It should be noted that both the Trust and Hewlett-Packard are parties to a Reciprocal
Land Use and Improvements Reimbursement Agreement, which should be executed in
the near future. That Agreement further sets forth the obligation of the Trust to
provide the dedication of the Rock Creek Drive right-of-way, which would in turn
incorporate the requested easements. In the event the development of the Harmony
Technology Park precedes the dedication of the Rock Creek Drive right-of-way, this
letter shall confirm our intention to continue negotiations for the dedication of the
necessary easements prior to submittal of the Final Development Plan for the Hewlett-
Packard property.

Responses
General Comments:
1. Letters of intent are included with this submittal for the easements required for
stormwater and sanitary sewer service from the east and south east of this project.
This letters of intent are only required if the developments to the east of this project
have not been approved prior to this project.
2. We are requesting that radius style approaches be used for the approaches to
buildings "A" and `B" and the east approach to buildings "D" and "F" and the west
approach to buildings "C" and "F". You will note that all other approaches are
standard flared drive approaches.
3. You will note that with this submittal there is considerable additional design work
included within the Harmony Road and Melody Road (Cambridge Avenue) plan set.
Additional design has also been completed for the other streets within the
development, such as street cross sections and more detailed profiles and utility plans.

4. As we have discussed since the last submittal, the first phase of this project will
construct a temporary all weather surface from the east end of Imagination Drive to
the existing asphalt surface of Cambridge Avenue. This connection will allow the
residents along the east side of Cambridge Avenue to access Imagination drive and
proceed to Technology in order to take advantage of the traffic signal at the
intersection of Harmony Road and Technology Parkway. However, if the resident
will continue to prefer to use the intersection of Harmony Road and the existing
Cambridge Avenue, only a right turn, east bound, will be allowed. As Melody Road
(Cambridge Avenue) is constructed and put into service, temporary all weather access
points will be created at the future roads entrances along the east side of Melody
Road (Cambridge Avenue). This will be done in order to reduce the number of
standard drive approaches along the major street. Regarding the sight distance
concern, Melody Road (Cambridge Avenue) is attempting to match existing ground
as near as possible while meeting street design criteria. The drainage of the existing
Cambridge Avenue is to the south and east. Therefore, the new street should not
introduce any additional runoff to the existing road or lots.
5. You will notice that the proposed utility easement between the section line and the
east property line of Melody Road (Cambridge Avenue) on the previous submittal has
been shown as additional right-of-way dedication on this submittal. The intention of
this is not to create and narrow lot the width of the previously proposed easement and
the length of Melody Road (Cambridge Avenue) between the two future streets to the
east of this development. This follows the direction of the first alternative in your
comments to Mr. Steve Olt.
6. As can be seen on the interim design sheets for Harmony Road, a % movement has
been included for the intersection of Harmony Road and Melody Road (Cambridge
Avenue). As the intersection is signalized the median will be removed to allow full
movements within the intersection.
7. You will note that pedestrian refuges have been added through out the development.
The refuges match the minimum design standards as shown in detail 16-7 of the
proposed Larimer County Urban Area Street Standards.
8. Sign easements have been established for the two large signs located along the south
side of Harmony road. The easements are depicted on the plat. The easements have
been located outside of all other easements which parallel Harmony Road.
9. Handicap ramps have been added to the on -site development allowing pedestrian
traffic to cross between medians.
10. You will notice in the phasing drawings for Melody Road (Cambridge Avenue) that
the turning movements for the northern most future street to the east have been
addressed. The phasing drawing initially allows full movements at this intersection
while the Melody Road (Cambridge Avenue) and Harmony Road intersection is

restricted to'/4 movement. Upon signalization of the intersection, the intersection of
Melody Road (Cambridge Avenue) and the future street to the east will be restricted
to right in - right out only. You can also see from the phasing drawings that various
striping and median schemes will not allow the prohibited movements.
Plat:
I. A public access easements has been added to the plat to encompass the sidewalk
south and parallel to Harmony Road. In addition, a 15 feet wide utility easement has
been added to plat south of Harmony Road in addition to other easements requested
since the previous review.
2. The previous firelane access easement has been revised on this plat to be an
emergency access easement and drainage and watermain easement where applicable.
Utility Plan:
1. Additional detail has been added to on -site grading plans. In addition to spot
elevations contours at a 1-foot contour interval have been added in order to reflect the
drainage patterns.
2. Curve information has been added to street plan and profiles and median plan and
profiles.
3. Intersection detailing has been included with this set of plans. The detailing is per D-
18 and D-19 of the Fort Collins standard details.
4. Curb style has been called out on the appropriate median, street and onsite grading
sheets. Details of the various styles of curb are also included in the detail sheets for
this plan set.
5. All medians are a minimum width of 7-feet with the exception of the temporary glue
down median used to control the 3/4 movement at the intersection of Harmony Road
and Melody Road (Cambridge Avenue).
6. A note has been added to the plan set specifying that the "areas between the lip of the
gutter at drive approaches and the back of walk must be concrete (typ)". This note is
a typical note shown on all street sheets.
7. The flowline profile of the portion of Technology Parkway that disappears was
actually in the drawing. However, due to the poor quality of the reproductions, the
flowline was not visible.
8. Stormdrain information has been included in this plan submittal. This information
was missing in our previous submittal.

11. After our last Pilot Process review meeting it was my understanding that Eric Brake
said the enhanced walks were allowed. However, the City of Fort Collins would not
maintain the walk and that it was the sole responsibility of the property owner.

Dave,
I would like to echo Bob's apology. It is certainly not the norm for me to
lose my cool in a meeting. This meeting was an exception, and for that
apologize. In particular I would like to apologize to Marc Virata, and Matt
Baker who happened to be sitting at the same end of the room together when I
vented my frustration.
We began discussions about this segment of Harmony roadway with CDOT and the
City on June 5th of last year. It has now been under discussion for 8 months
and, as of last week, we still have significant new issues surfacing. My
frustration is in the cumbersome interface with CDOT, and the lack of
ability to obtain clear direction, it is not with the quality of people. I
understand the City has gone to great lengths to assist HP in trying to get
solutions from CDOT.
I have great respect for all that work with the City, and I hope you will
agree, that BHA has always tried to represent both sides of issues as fairly
as possible. We try to maintain integrity in all of our work, and we often
support the City perspective in meetings with our clients.
This project is very significant for the people of Fort Collins. Other
communities are vying hard for base level employment jobs and will go to
extraordinary efforts to attract companies such as HP (We recently witnessed
the City of Greeley approve a project for Con Agra in 45 days, we saw
Loveland approve an application for Con Agra in 30 days. We also witnessed
Johnstown approving a development application for a desired new client in 60
days). If we were to lose HP it would represent a significant loss to Fort
Collins. HP is a great benefit to the entire community. The jobs they create
fuel much of the rest of our economy, and they contribute extensively to
charitable organizations. I want to make sure we do all we can to ensure
they continue their commitment to our City. When the challenges get too
tough for corporations, they look elsewhere. I do not want this to happen.
Again, my apologies. There were certainly no personal attacks intended on
anyone's integrity or professionalism, only on the lack of ability to get to
a solution. If this was so construed, it was not intended.

Dave, I apologize if anything I said was construed as being an attack on any
of the City staff. I have nothing but respect for the personal efforts that
are routinely put forth by virtually every staff member I have encountered
at the City of Fort Collins. Our frustration often comes from the
conflicting messages we receive from the various departments and agencies,
and the Pilot Process has provided a mechanism to move toward a true team
approach.
The only thing that caught me by surprise at the meeting was Marc's comment
about having not known about the Harmony design until we submitted it. We
had the meeting where Tess told us we could leave the crown, then Pete
Graham told us we "absolutely" had to remove the crown. I then called Tess
and she verified that the State wanted the crown removed. I was under the
impression, and John Tufte has assured me that he personally told Marc what
CDOT was requiring and that we were designing the section to remove the
crown. In hindsight I should have asked John to send an e-mail to all
concerned about the decision that was made, especially to Matt Baker. Dave,
you'll have to take my word that we never thought we were blind -siding the
City with this design.
I would be more than happy to discuss this with you in more detail, but rest
assured I find no usefulness in assigning blame as long as we are all
working toward the same goal.

I got a voice mail from Pete Graham of CDOT yesterday
telling me that he and Dave Martinez had talked and they want the ultimate
section that your firm proposed at our meeting Thursday was what CDOT wanted
to see constructed.
I will call Pete on Tuesday (Monday is a holiday) and
discuss this in further detail. Obviously, the City and State are going to
have to come to some consensus as the City is not willing to pay for this
improvement, maybe the State as some funds. If the State insists upon this
design and they are not willing to participate or have the authority to
require the improvement as a result of their approval then it's my opinion
that the cost for construction will rest with HP. I'll let you know what
comes of this just as soon as I can.
On another issue. I want you to know that I did not
appreciate your comments regarding the City's lack of responsiveness and
cooperation regarding the Harmony Road issue. You both know II that this
submittal was the first time we had seen anything regarding the Harmony
design and it was less then desirable. In addition, it has been explained

This letter is regarding the February 14, 2001 City of Fort Collins review comments
received for the referenced project. This letter will attempt to address all the comments
in your letter and plan set redlines. I will respond to the questions or comments as they
are listed in your letter.
Responses
General Comments:
1. To date there have been two meetings with the City of Fort Collins and CDOT
representatives to discuss issues such as typical street cross section and Right-of-way.
The City and CDOT both want the warped section, but the City does not want to pay
for it. Hewlett Packard is looking at costs associated with the design and construction
of the interim design.
2. Letters of intent are included with this submittal. The letters are from Poudre School
District for the property to the south of Harmony Technology Park, Imago
Enterprises, Inc. for the property to the east of Harmony Technology Park and from
Hewlett Packard for the property outside of the plat boundary owned by Hewlett
Packard.
3. Offsite easements will not be required for the acceleration lane on Harmony Road
east of Cambridge. The improvements are within the existing R.O.W.
4. We asked for a variance from the City (in the last submittal) to use the radius style
approaches to be used for the approaches to buildings "A" and "B" and the east

BHA Design is submitting the formal request for the approach style variance.
6. We did not address this comment because at this time the street name is
undetermined.
7. We changed the street names to maintain consistency with the existing street names.
8. As explained in the previous submittal letter it is understood that the property owner
will be responsible for any repairs that might occur on the enhanced crosswalks.
Notes have been added to the architectural site plan.
9. This access and cul-de-sac will be built in conjunction with phase I.
10. In this submittal the phasing plan is more explicit. A portion of Harmony will be
constructed east of Cambridge Avenue. In addition, there will be a meandering
sidewalk along HP's property fronting Harmony Road.
11. We have addressed this and made the road width 36' in accordance with 3.3.2(F).
This is shown as a phase I detail in the Harmony Road/Cambridge Avenue plan set.
12. These easements will be addressed by separate document.
Utility Plan (onsite):
1. This was taken care of by re -grading several drive approaches. However, there were
several other approaches that grading still must be completed to limit runoff flowing
over the sidewalks. Alternatives such as sidewalk culverts and inlets will still be
looked at to resolve this issue.

I just got off the phone with Larry Hass from CDOT. He has agreed to subsidize up to $97,000 for the
traffic signal at Mulberry/Lemay for the new CDOT standard. Whew!
On the down side, he also informed me that with the new redesign of Harmony Road with the HP project,
CDOT will be expecting the new signal standard applied at Harmony and Technology Parkway. HP may
want to know about the increased cost since they are paying for the entire signal.

I am writing you on behalf of the Hewlett-Packard Company, Village Homes Northern
Division, Chateau Development, and Imago Enterprises to respectfully request your
assistance in facilitating CDOT's review process for the above -referred improvements. In
that submissions to CDOT regarding this project were apparently lost by CDOT and have
been resubmitted, we would appreciate both your involvement in assuring that they are
under review and your estimated timeframe for completion. The following is a summary
of what has transpired.
On May 20, 2004 a conference call to Tess Jones, your predecessor at CDOT, was
initiated by David Simpson and Mark Verata with the City of Fort Collins, Michael
Brake with J.R. Engineering, and myself to discuss the A -line and permitting process and
the signalization approval process. Pursuant to that discussion, the applicant prepared the
agreed -upon permit requests and an update to the traffic analysis completed in 2002 in
connection with H-P's proposed development at the southwest comer of the intersection.
J.R. Engineering submitted both the A -line and access permit applications to CDOT on
June 28, 2004 to the attention of Bob Grube, Right of Way Manager. In that the
applications did not involve an appraisal of real estate values, we expected an
annroxi mate] v t'vee-month review time as Indicated by Tess Jones and confirmed b
Bob Grube Oa October 14, 2004 Mr. Grube phoned Mr. Brake to mtorm film [Fiat by

misplaced the applications but promised to complete his review of a resubmission by
November 15, 2004. Mr. Brake mailed a second set of applications to Mr. Grebe on
October 15, 2004. Towards the end of November 2004 Mr. Brake phoned Mr. Grube to
check on the status of the application. Mr. Grube informed Mr. Brake that he was
submitting the application for federal approval and that we could expect the completed
application by the end of December 2004. We are now into the new year of 2005 and
have not received the approved application. Could you please inform us to the status of
the approved A -line application?
Regarding the signalization approval process, the applicant hired traffic engineer Matt
Delich to meet with the City and to prepare the required impact analysis update. In that

A heads -up for you and John Fischbach. Mike Bellow and Bruce Hendee called me today. H-P is not
inclined to pay for the southbound dual left -turn lanes, and may go directly to the City Manager over this
issue. I asked them to hold off until later this week, since the costs of the improvements, and the actual
features of the design, have yet to be determined. That is what we need to decide at the Thursday
morning Trans. Coord. Cmte. meeting. Right now, the range of costs being discussed goes from $50,000
to $500,000.
The H-P project team meets Wednesday, and Mike agreed to ask Steve Stiesmer and Will Arduino to
hold off on calling John until at least Thursday afternoon. I promised to call Mike and Bruce at 12:30
Thursday with our decision on design features needed at that intersection.
To help us with the decision, Bruce will send us a drawing showing the existing ROW and physical
features there now, including the trees. We will use this to help with the decision -making Thursday. Gary,
it would help for you to attend if you can in case we cannot reach consent or consensus on this.

The Fort Collins - Loveland Water District and the South Fort Collins Sanitation District have reviewed
the above mentioned project and submit the following comments.
There appears to be vertical conflict with the District's water line and the proposed storm drain
line. Vertical elevations of the utilities need to be potholed and verified during the design phase of
this project.
The water line service to Hewlett Packard at the west entrance is not shown correctly. Water
service is provided by the City of Fort Collins.
District records do not indicate a water line located in the proposed Melody Road. The location of
all existing District facilities shown on the drawings should be checked for accuracy.
The pipe material for the District's existing facilities should be identified. The 3 inch pipe along
the south side of Harmony Road is Asbestos Concrete. Protection of the facilities during
construction over the pipe needs to be addressed.
The District will require the relocation of the existing water lines where the fill over the pipe
exceeds 7 feet (top of pipe to finished grade).
Cambridge Avenue needs to be identified. The District's facilities are not shown at this
intersection. There appears to be vertical conflict with the District's water line and the proposed
storm drain line.
The District's facilities are to be shown on the storm drain profiles.
The District will require another review due to the nature of the above comments.

This letter is intended to document several items discussed during the various review
meetings we have had with Marc Virata (City of Fort Collins), Dave Stringer (City of
Fort Collins), Matt Baker (City of Fort Collins), Pete Graham (CDOT), Russ Hickman
(CDOT), Bob Almirall (JR Engineering), me and you. The three outstanding items have
been the location of right-of-way, the stormwater swale parallel to Harmony Road and
the landscaping adjacent to the road.
The first item, right-of-way location, was confirmed at our meeting on March 29, 2001.
At that meeting it was agreed upon that the right-of-way dedication along the frontage of
Harmony Technology Park, Second Filing would be 25.5 feet from the original right-of-
way line. In other words, the new right-of-way would be 25.5 feet south of and parallel
to the existing line.
The second item, the stormwater swale, was also discussed during the meeting on March
29, 2001. It was decided that the flow line of the swale must be 3-feet below the south
edge of asphalt. The west end of the Swale near Technology Parkway will not have a
defined flow line due to the grading from the end of the curb and gutter. The 3-feet deep
channel must be created within 100-feet to 200-feet from the end of the gutter at
Technology Parkway in order to carry runoff to the site's detention pond. The ground
slope between the flow line of the defined swale and edge of asphalt cannot be steeper
than a 6:1 slope. The flow line of the swale must also have positive slope (1.0%
minimum) to maintain drainage as a grassed swale. It was also agreed upon by CDOT
that the runoff from Harmony Road will be allowed to enter the detention pond for this
development rather than being collected by a separate drainage ditch controlled by
CDOT.

The last item, landscaping, was also discussed during the meeting on March 29, 2001. In
attendance were Bruce Hendee with bha Design and Frank Maple with the City of Fort
Collins. The City believes the landscaping proposed for the frontage of Harmony
Technology Park, Second Filing is acceptable. CDOT also agreed that the landscaping
was acceptable provided trees remained outside the clear zone for the road. The clear
zone is located 30 feet south of the outside stripe for the through lane. In the case of
Harmony Technology Park, Second Filing, the clear zone is 8-feet from the south edge of
the proposed edge of asphalt. The reason it is 8-feet is that there is an accel/decel lane
12-feet wide, a bike lane 8-feet wide (or 6-feet wide) and a shoulder 2-feet wide (or 4-
feet wide).
In summary I believe the issues highlighted by this letter have been resolved. At this
point in time we have submitted plans for Harmony Road based on the decisions
documented by this letter. We will also begin the A -Line process based on the new right-

Re: Cambridge Ave. — Storm Sewer Bond Refund
Dear Marc;
The storm sewer that had originally been planned for installation in Cambridge Ave,,
from Rock Creek Dr. to Harmony Rd., will not be constructed. We would like to get a
refund from the bonding company for that portion of the bond premium that is
attributable to the storm sewer improvements.
The bonding company has already agreed to refund $1,953.00.
The construction cost of the storm sewer is $122,027.05, as shown on the attached
"Project Quantities and Cost Estimate Sbeet".
It is my understanding from your email dated 8/30/02, that the City will send a request to
the bonding company to reduce the bond.
Please let me know if there is anything else I need to do.

a full -turn signal is already indicated in the City/ CDOT Access Control Plan, the traffic
analysis update was intended to substantiate warrants for the signal installation
concurrent with the improvement of Cambridge Avenue between Harmony Road and
Rock Creek Drive. The City's Chief Traffic Engineer Eric Bracke was satisfied with the
analysis and forwarded it along with a request for concurrence to Larry Hass with CDOT
on November 1, 2004. On December 28, 2004 Mr. Delich was told by Mr. Bracke who
was following -up with Mr. Hass on the City's Novemberl, 2004 request that this
signalization information had been misplaced as well. Mr. Bracke re -mailed the request
package to Mr. Hass on December 29, 2004.
As you can appreciate, the scheduling for improvements to Cambridge Avenue and the
intersection depend upon a timely, or at least a predicable review perivu, by C..OT..•C
have made every effort to prepare and direct submissions to CDOT as directed by those
at your office. Please recall that on November 11, 2004 you joined Mark Verata, Michael
Brake and me at the City to discuss the submitted design drawings for Cambridge
Avenue. At that meeting Mr. Brake and I expressed our frustrations with the permitting
process. You seemed to commiserate with us, noting problems in the past, and offered to
intervene with not only the permitting process but the signalization concurrence as well.
I can only imagine the workload and weight of responsibility your office is experiencing,
which have no doubt become even more challenging with Tests Jones' retirement. We
greatly appreciate your assistance in expediting CDOT's review of these submissions and
keeping us apprised of the timeframe for review completion.

Modification Request
The developers of the Harmony Technology Park project would like to request a
modification to the Land Use Code in order to allow radius curb returns on the main
visitor entrance drives into the site.
Land Use Code section to be modified:
The request would require modification to Section 3.6.2(L)(2)(e): `The connection ofa
private drive with a public street shall be made with a driveway cut using a "New
Driveway Approach " in accordance with city street standards.
How would the proposal differ from the standard?
The driveway approach referenced in this Land Use Code section affects driveway
connections to public roads. The standard requires a `curb cut' type of driveway
connection rather than a curb return with a radius. For the Harmony Technology Park
site, the applicant requests use of a curb return radius on the primary visitor entrance
drives into the building sites. The request is being made in order to differentiate the
primary visitor access points from the secondary and service access drives in the business
park. The secondary and service drives would maintain the `curb cut' approach as
specified in the standard.
Why can the standard not be met?
There is no reason the standard cannot be met. The applicant is simply requesting an
alternative driveway connection design.
What problems may result from modification of the standard?
There are no problems that would result from the use of the curb return radii.
What health, safety or welfare problems would be created by the modification?
There are no health, safety, or welfare problems that would be created by the use of a
curb return radius. The radius requested would be a small radius (15'), so would not
allow high speeds at the intersection. In addition, this is a modification request of the
older `Design and Construction Criteria, Standards and Specifications for Streets,
Sidewalks, Alleys and other Public Ways'. The newly adopted Urban Area Street
Standards would actually require these drives to have a 15' curb radius since they would
be considered `High Volume Driveways'. A high -volume driveway is considered one that\
serves a minimum of 350 vehicle trips per day. Based on our traffic study, all of these 1
main visitor access drives will serve between 300 and 400 vehicle trips during the peak
hours only. Therefore, the drives would certainly exceed the minimum of 350 vehicle
trips per day under this new standard.

Thank you for your time to review the proposed Cambridge Avenue Road Improvements
project in Fort Collins. Your input to the design of the Cambridge Ave. and Harmony
Road intersection is critical in allowing for a timely construction schedule and cost
efficient project.
As we have discussed a common requirement for Highway improvements is to overlay the
improved roadway to completely remove lane striping when lane re -striping is necessary
due to redirection of traffic. This letter is provided to you requesting the overlay
requirement be waived for the following reasons:
l . On the westbound lanes the plan is to remove the existing shoulder striping and
re -stripe the shoulder to allow for the addition of a bike lane. The minimal
widening on the westbound lanes is to accommodate the proposed bike lane
and no redirecting of the vehicular lanes is necessary.
2. On the eastbound lanes the plan is to add additional pavement to allow for a
protected left turn movement into the Hewlett Packard campus and to allow for
a 4- foot shoulder on the southern edge of the existing pavement. Additionally
asphalt widening will occur to allow for a protected acceleration lane going
eastbound from Cambridge Avenue.
3. As shown on sheets 32 and 33 of the Cambridge Avenue and Harmony Road
Utility Plans the tire travel paths are contained within existing pavement
theretore vehicle performance will not be impaired due to the widening of the
existing pavement.
4. Typically a scar is left on the pavement from the grinding process that removes
the existing lane striping. This scar can be mitigated by the application of a
polymer asphalt sealant, which will create a consistent color to the asphalt
surface. Additionally new lane striping will be applied within the entire area
of construction within the Cambridge Avenue and Harmony Road intersection.
As represented by this letter and the submitted Utility Plans for Cambridge Avenue and
Hannony Road the developer (Les Kaplan of Imago Enterprises, Inc) proposes to

complete all widening of the asphalt and all new striping as indicated on the plans. He is
committed to completing all of this work during the construction season of 2005, but the
anticipated cost this overlay could jeopardize his ability to fund the project.
