In general, having the driveway access within this easement seems to be unusual, will the developer secure permanent legal right for the operation of the driveway? The traffic report states that the site will generate less than 200 daily trips, thus the use of a radius style driveway is not to standards. In general the City Engineer has ruled that an area of up to 750 sq.ft. is allowed to drain over the sidewalk which is exceeded in the present design.
