Collins, CO 80521 Re: Builders Square at Harmony Market Vacation of Easement Request Dear Mike: Architecture/Construction C 93 On behalf of the development team for Builders Square at Harmony Market, I am requesting a vacation of easement as recorded on the plat. The utility easement that lies within the service drive to the South of the proposed structure, must be modified to accommodate the recently submitted administrative change for the canted loading ramp. This modification was a specific request of the Builders Square National Development Department, to change the loading ramp, thereby necessitating changes to the utility layout and the extent of the easement. You are hereby notified that all landscaping and stormwater work for the project is complete and that all erosion control measures required by the Plan and Criteria have been installed. We request that your office perform an inspection of the site and accept the installation in accordance with the terms of the Memorandum. Upon completion of those actions please release 75% ($5,940) of our cash escrow amount of $7,920 which is currently posted for the Memorandum. Thank you for your attention to this matter. Please be informed that this letter of acceptance does not relieve the developer or the contractors, lot owners, or their contractors, of their responsibility for the repair of any damage which may occur as a result of the building construction. The developer will be The Neenan Company, not 600 Grant Associates. In addition we feel changes are necessary which clarify the sequence of events and ownership of various parcels within Harmony Market P.U.D. Second Filing. I have used the Pace Development Agreement as a guide in preparing this draft. This language should replace the first WHEREAS in the Builders Square Development Agreement as it is currently drafted. We are suggesting Oak Farm Inc. be referred to as "Oak Farm" rather than "Owner". If this is acceptable this should be changed throughout the document. In addition the signature block for the developer should be, The Neenan Company, a Colorado Corporation, by David G. Neenan, President and attested by Randy Myers, Comptroller. These changes have been circulated and approved by Oak Farm, The Neenan Company and Tony Fiest. If you are in agreement, please have the changes made. When they are completed, please call Denny Meyer at Neenan or myself and we will pick up the document and have it executed. All outstanding issues have been resolved and it is hoped to begin the project very soon so your cooperation in doing this as soon as possible will be greatly appreciated..
