PZ96-18 OF THE PLANNING AND ZONING BOARD OF THE CITY OF FORT COLLINS VACATING A PORTION OF THE BLANKET UTILITY, DRAINAGE, AND EMERGENCY ACCESS EASEMENT ON TRACT "A", FIRST REPLAT OF WINDEMERE PROFESSIONAL PARK MINOR SUBDIVISION WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the Planning and Zoning Board to vacate certain easements and rights -of -way, by resolution or by approval of replats containing notation of such vacation; and WHEREAS, the Owner of the First Replat of Windemere Professional Park Minor Subdivision, has requested the vacation of a portion the blanket utility, drainage, and access easement on Tract "A" of said Minor Subdivision and more particularly described below; and WHEREAS, the Owner is relocating the existing sanitary sewer main and water main within the easement area to a new utility, drainage, and access easement area being dedicated on the plat entitled "Replat of Lots 2 & 3 and Tract "A" of the First Replat of Windemere Professional Park Minor Subdivision"; and WHEREAS, due to the relocation of said sanitary sewer main and water main, the portion of the original blanket utility, drainage, and access easement on Tract "A" occupied by said utilities is no longer necessary to retain for utility, drainage, nor emergency access purposes; and WHEREAS, all public and private utility agencies and the Poudre Fire Authority have been notified of the vacation request and report no objections. NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City of Fort Collins that the portion of the blanket utility, drainage, and emergency access easement on Tract: "A" of the First Replat of Windemere Professional Park Minor Subdivision described as follows, to wit: A part of Tract "A" of the First Replat of Windemere Professional Park Minor Subdivision, City of Fort Colllins, County of Larimer, State of Colorado which begins at the Northeast corner of said Tract "A" and run thence S 00°03'20" E 20.00 feet along the East line of said Tract "A"; thence S 88059' 40" W 235.03 feet; thence N 01 ° 00' 20" W 20.00 feet to a point on the North line of said Tract "A", thence N 880 59' 40" E 235.36 feet to the point of beginning, containing 4,704 square feet. be and is hereby vacated; UPON THE CONDITION THAT this vacation shall not take effect until the existing sanitary sewer main and the existing water main within said easement area has been relocated and said relocated sanitary sewer main and relocated water main have been accepted by the City; and the City has caused an affidavit giving evidenece of said relocation and acceptance to be duly recorded with the Larimer County Clerk and Recorder. // Passed and adopted at a regular meeting of the Planning and Zoning Board of the City of Fort Collins held this 16th day of December, A.D. 1996.
