RE: Windtrail On Spring Creek
Dear Mr. McCoy:
This letter is being sent as a follow - up to the request sent to you by the Windtrail Homeowners
Association, the letter dated March 13, 1997, from Kerrie Ashbeck and the need to complete
certain improvements as required in the approval of the Windtrail On Spring Creek Development.
After receiving a copy of the petition letter sent to you by the association, the City decided it is
best to address all of the items associated with the development, including those items needing to
be installed and/or repaired, not just the fire lane at one time. Therefore, the following is a list of
items our field inspector found that need to be corrected as well as those items not previously
addressed.
* Need to construct the bike trail connection from Gilgalad north to Spring Creek, between
Lots 11 & 12 and Lots 10 & 13.
* Asphalt pavement repair at Gilgalad and Northland intersection
* Need to backfill, regrade and relandscape each side of the fire access lane consisting of new
metal edging, fabric and gravel.
* Asphalt pavement repair on Gilgalad from the Northland intersection to 715 Gilgalad, 808 to
820 and the east bound lane from Hill Pond Road to Northland.
* Repair the curb and gutter on the west side of Gilgalad 300 feet north of Hill Pond Road, in
front of Lot 1.
* Install those items addressed in Kerrie's letter, i.e., bollards, ramp and etc. ( see attachment ).

Since many of these items are repairs to the existing street system and appear to have been caused
as a result of the construction activity in this development and will continue to deteriorate, it is
important0at this repair work begin immediately. Please be informed that until such time as the
above mentioned items have been installed/corrected and accepted by the City, we will exercise
our right do withhold building permits for the remainder of the development. In additionr.`we will
not accept the public improvements in this development for maintenance until the work is
complete.
Hopefully, such harsh action will not be necessary and we can count on you to make the repairs
in a timely manner.

Dear John:
This letter is being sent as a follow-up to our meeting at the Windtrail Townhomes site
on Tuesday March 11 with Basil Hamdan of the Stormwater Utility and Kathleen Reavis
of Transportation Planning. As we discussed, attached is a sketch of the improvements
to the emergency access/bike and pedestrian path that are needed. Also included are
the sample specifications for concrete bollards I obtained from the Parks Department.
As we agreed, you are responsible for installing two bollards at each end of the
emergency accessway in the locations shown on the sketch. Bollards are typically
required to restrict the general public from using emergency accessways for vehicular
access while still allowing pedestrians, bicycles, and emergency vehicles to use the
accessway. Since your original plan called for a portion of the width of the accessway
to be constructed out of grass-crete and instead it was constructed entirely in concrete,
the accessway now conflicts with an inlet on Shadowmere Court. The bollards at that
end are to be placed closer to the left side to direct pedestrians and bicycles to the
right. After the bollards are installed, please contact Kathleen Reavis at 221-6140 and
she will issue a work order for City crews to do some striping of the path to also dil ect
users to the right of the inlet.
Since the accessway serves the development and is not part of the City's right-of-way
nor bikeway system, the costs of this initial striping will be billed to you. Future
maintenance of the striping and bollards shall be the responsibility of the Homeowner's
Association. Please notify the appropriate representatives of the Association of this
future obligation. Again, the City is not obligated for maintenance of the striping nor
bollards since the accessway is not part of the City's right-of-way nor is it part of the
City's formal trail system.

Lastly, since the sidewalk and pedestrian ramp at the north end of the accessway must
be replaced due to damage, it was agreed that the ramp should be replaced in the
center of the accessway (instead of aligning it directly with the ramp at the cul-de-sac
on the north side) to facilitate the bicycle and pedestrian use of the connection from this
development to the Spring Creek Trail.
