Tim,
1 have reviewed the draft copy of the Development Agreement and would like to respectfully request some
changes as follows:
General Conditions:
Paragraph C We sec no reason why a building permit cannot be issued until the completion of the listed
improvements. phis requirement is usually for residential development. We would like this restriction
stricken from the agreement or revised to allow for concurrent completion of public improvements and our
building.
Paragraph I: According to the attached Exhibit" R", we are not eligible for any reimbursement for storm
drainage improvejutaus" The inlets and piping along both College and Willox, excluding the inlet box
South of our College Ave. access which we arc piping to, will only handle oft -site water and should
therefore be eligible for repayment.
Paragraph J: Why are molars of as-builts due after "any phase of construction is complete"? Can this be
revised to require molars of as-builts following final inspection of utilities, storm and street improvements?

owners could submit plans for development of the adjacent parcel, which would undoubtedly require grade
revisions as this parcel is in the same Noodplair as our development, and thereby delay our Certificate of
Occupancy. Any proposed development would require engineering review by your department per
Planning requirements and would not be allowed to increase Flows into our storm facilities without
modification to those facilities under their separate P.U.D. Our C.O. should not be contingent on "fhe
Developer obtaining approval._" and adherence to the Final Approved P.U.D. design is addressed
elsewhere in this dOcunlCnt.
Paragraph 4: We request clarification as to what off -site drainage facilities would not be accepted for
mainien<uxe by the City, assuming all facilities are indeed built to Citv standards.
Streets
Paragraph 1: Can you provide us a copy of Section 24-1 12 of the Code of the City for our review. Also,
does "Developer's actual expenses" include em�ineering costs"
Paragraph 2: It is understood that the off -site improvements are "City hrnprovements". The requirement for
competitive bids should have been brought up sooner in the project as we have already awarded this
project to Vanni Construction. Howcvci. it should be noted that Vanni solicited several local contractors
fur bids and only received ( I ). As the contract stands today. Kehn Construction will be doing the street
improvements and it is my understanding that they do quite a bit of City work anyway. It should also be
noted that McDonald's only grants 90,, overhead and profit with no general conditions_ This requirement,
and the lack of prior notification of Such. represents one more major time delay in a project that has taken 2
1 ,'_' years to brio_ to this point We would sugsest that the Citv review Kehn s bid, which we are confident
the City would find to be very reasonable.
Miscellaneous:
I't�raph C. We request that we be allowed to utilize a water truck to mitigate dust rather than have the
job shut down.
One last revision request; for the Developer's approval, we need to revise the contact to Sonny .Jones,

liar the ❑hove mentioned project. These plans address the city's comments from May 20,

In response to your meetings with CDOT, we have incorporated all your requests for the
median redesign.
In response to Mr. Buftington's comments
All vertical and horizontal utility separations have been addressed by minimums
or encasement. The proposed RCP is using the same trench as the existing CMP -
NIII(oc and replace. We've shown all waterline crossing elevations per the city's
as -built drawing 3-0034.
In response to Mr. I lamdan comments:
titorm sewer encasement has been shown.
Water quality volume in the detention pond were not considered for storage, see
volume calculations.
O fsite area and basins has been shown. Basin El is historic but we feel it should
he handled by an agreement with the adjoining property owner, rather than an
casement.
I'he emergency overflow from pond I was designed to have a second chance to
get into the pipe.
The detail for the outfall of the storm sewer in College Ave. is shown in the detail
%1-601-12 on sheet C-313.
All other comments have been addressed in the drainage report.

This letter is in response to the meeting City of Fort Collins' staff had with Tess Jones
from the Colorado Department of Transportation (CDOT) Thursday, June 25, 1998.
The items that we discussed were the dimensions of the proposed median along North
College Avenue.
Please find enclosed, a redlined copy of the Offsite Striping Plan for the Willox Crossing
development. We would ask that you make any necessary changes as suggested on
the striping plan and resubmit the utility plans for this project. The major issues that the
State was concerned with are as follows:
a. The Offsite Striping Plan did not show the existing and proposed striping
to the south of the site. Please extend the existing and proposed striping
beyond the carwash and establish how the proposed striping will match
with the existing striping.
b. Please modify the taper ratio so that it reflects a 12:1 ratio rather than a
11.5 1 ratio_ Make sure that your traffic engineer includes this in the
variance that your traffic engineer is preparing.
C. Please check the vehicle turning movements out of the carwash entrance.
You will need to modify the "bulb" of the median so that it has not affected
the turning movements.
d. Since this median is temporary, make sure that the edges of the median
align with the existing 12-foot chicken lane.
The remaining comments shown on the Offsite Striping Plan are minor so I feel I do not
need to expand on them.

Dear Mr Marlow:
This letter is in response to the meeting City of Fort Collins' staff had with Tess Jones from the
Colorado Department of Transportation (CDOT) on Tuesday, June 16, 1998. The items that
were discussed were the dimensions of the proposed median along North College Avenue
and the requirements for the variances needed with this project.
Please find enclosed, a copy of a sketch of the North College median showing the new
configuration, the various dimensions and taper ratios associated with the median. The
location of the median shown on the sketcin. is approximate and will need to be located
accurately by your engineers. The dimensions, i.e. lengths of the median, are referenced from
the southern edge of the stop bar. What is currently being suggested is shown as follows:
a. 250 feet of lane length
b. 138 feet of taper length (using the minimum taper ratio from the existing access
code which is 11.5:1)
c. Approximately 22 foot long 'bulb" at the end of the median The engineer will be
responsible for seeing to it that turning movements from the carwash will not be
affected by the edge of the median be placed at the north edge of the carwash
access. If turning movements are affected, the median can be constructed as
shown with the dashed line or shifted north 5 to 10 feet
d. Lane transitions will be 120 feet long using a 1 30 redirect taper ratio. All lane
transitions will begin at the location of where the median begins to taper, i.e 250
feet from the southern edge of the stop bar.
e. The edge of asphalt taper will be 75 feet long and started from the curb return.
At that point; the edge of asphalt will follow the lane line for a distance of 45 feet.
Please note that the edge of asphalt will need to be 4 feet from the lane line as
stated in the State Highway Access Code.
f. There will be no landscaping inside the median. It will be constructed with glue -
down curb and filled in with exposed aggregate.
I am requesting that your traffic engineer provide the necessary language for the variances
associated with the median. Currently, the median is deficient in a number of areas when
compared with the allowable conditions in the State Highway Access Code. Please note that

the State is in the process of adopting a new access code. If in fact this code is approved by
State officials, the variances will need to reference the new criteria in the new code. Listed
below are the items that the traffic engineer should address in the variances.
a. Storage Nength deficiency
b. Lane length deficiency
c. You can reference the median on North College at Vine Drive
d. Address the fact that there is no acceleration lane. You may state that traffic
leaving the carwash will not be allowed to enter an acceleration lane and that the
City does not support acceleration lanes to begin with.
e. If the new code is approved, you will need to base the variances off of the
requirements in that document rather than the existing code. For example, the
minimum taper ratio allowed in the new code is 12:1 and not 11.5:1 as stated in
the existing code.
The traffic engineer will need to include the required lane lengths, taper lengths, storage
lengths, etc. and the rToposed lane lengths, taper lengths, storage lengths, etc. in the
variance request language.

R17: Abandonment and Rededication of an Exclusive Water Easement for the City of Greeley

The City of Grecley is agreeable to abandoning a water line casement at the location mentioned
ahove. In addition, an exclusive 30 foot water line casement shall be dedicated for an existing
water line located in that same property.
['his agreement is in the conceptual stage at this time. McDonald's and its attorney is in the
process of preparing an agreement for Greeley's review and approval.

Dear Tim:
Attached please find the redline comments from the Engineering, Water and Wastewater Utility and
the Stonnwater Utility Departments for the above named project. 1 believe that these comments
have been addressed with the corrections made and shown on the attached blue lines and mylar
sheet, and also throughout this letter.
The main concerns from Engineering dealt with highway permits and any necessary city permits.
We will soon apply for the highway crossing pennit from Henry Rangel of CDOT. I have discussed
that issue with Roger Buffington, and we decided that Greeley should be able to make that
application directly with CDOT.
Roger and I also discussed his concerns shown on the redlines and I believe that all these issues have
been addressed.
For Storm Water Utility concerns I talked to Matt Fater. Most of his comments are addressed on the
revised plan. We will be installing a silt fence around the affected area of construction. Because the
impact of the installation ottee water main on this site is minimal (with regard to disturbed surface),
because McDonald'; will soon be developing this site. and due to the fact that we are a neighboring
municipality. we are requesting a waiver from the escrow requirement. If necessary, we can leave
the silt fence in place until McDonald's begins construction or makes other improvements to restore
the surface. We will work with the erosion. control inspector to mitigate erosion in this area.

Attached is a detail drawing that Tess sent me regarding the State's new
requirements for construction within their right-of-way. As you can see from the
detail the new pavements are constructed to the R-Value of 40 under the
pavement section and an R-value of 25 outside of the pavement section and
within the right-of-way. In addition, the existing pavement is milled to a minimum
depth of 2" for 1-foot width to provide a smooth transition from the existing to the
new pavement sections. This detail does not suggest removing the existing
pavement and reconstructing to an R-value 40

Dear Chris:
The intent of this letter is to inform you that the storm sewer concrete manhole
junction boxes constructed with the Willox Crossing development, in the
Colorado Department of Transportation's right-of-way on State Highway 287
(College Avenue) have been built in accordance with CDOT standards.
As you may recall, I sent a letter to Mr. Doug Dunkin of R&R Engineers on or
about September 9, 1999, requesting some additional information concerning the
redesign of the storm sewer junction boxes. Initially, I had concerns due to the
lack of detail and the size of the proposed redesign. However, in talking to our
construction inspector (Ronda Henson) she stated the manhole junction boxes,
as built in the field, were not sized in accordance with that as proposed by R&R
Engineers. Ronda indicated the size was modified from the R&R proposed
design to accommodate an existing gas line with no box dimension being greater
then 8 feet. Upon further review of the approved plans, I found the CDOT
standard design table includes a manhole design up to 8 foot. Additionally, she
stated that the boxes were built in accordance with the standard reinforcing table
as shown on the approved plan set. Therefore, the manhole junction boxes were
built in accordance with CDOT criteria.

Dear Mr. Dunkin:
I have recently seen the fax that was transmitted to our City Engineering Inspector, Ronda Henson dated 9-
9-99. After quickly reviewing what is proposed I see a few issues that need to be resolved.
I_ These boxes are within the Colorado Department of Transportation's right-of-way and are in the
proposed travel way. The design must comply with their standards, do they meet this, and are they
designed to support the State loading requirements?
2. The fax that I saw did not include any steel reinforcing details, what size rebar, spacing, distance from
walls, slabs, lids and etc.
1 Our inspector has informed me that these boxes are smaller then 4 feet by 10 feet, I understand they
have been built at 4 feet by 8 feet, is this size adequate?
4. What is the elevation of the boxes as it relates to the subgrade and finished street elevation?
5. Please submit to mean Engineers signed and stamped letter stating that the boxes have been designed
and built to meet the appropriate CDOT standard.
