Adjacent to this site's access. Ziegler Road has an existing attached walk that is proposed to remain. Typically, it would be necessary to detach the sidewalk with a project of this nature. After reviewing the existing field conditions, it is apparent that the large number and size of existing utility structures at the driveway resulted in the existing sidewalk being attached there is simply no other place for it. This issue has been discussed with City Staff and it is agreed that this project should not be burdened with multiple utility relocations to move an existing sidewalk that is functional. The project will improve the driveway access to have radial returns and handicap ramps that will be located as far away from Ziegler Road as possible. The existing walks will be tied to on either side of the new driveway. Because the sidewalk configuration is an existing, functional condition, and because the crossing of the driveway will be greatly improved with the project, it is not anticipated that this variance from the above Standards will compromise the public health, safety and welfare. July 2, 2004 Ms. Susan Joy City of Fort Collins Engineering 281 North College Avenue Fort Collins, Colorado 50522-0580 Re: Feather Ridge Request for Variance #1 — Driveway Return Radius Proj: 1 14-33 Dear Susan: The following is a request for variance from Table 8-2 — Curb Return Radii in the "Latimer County Urban Area Street Standards, October 2002". This variance is requested for the driveway into the site on "Ziegler Road. Chapter 9 of the standards states that all drives off of arterials are required to be Type III or IV (with radial returns). Table 8-2 states that the radius shall be 20'. We are requesting that this standard be varied to allow for 15' radii at this intersection. Existing utilities in this area are driving this variance request. There is an existing drainage manhole and an existing vault on the south side of the drive that can be accommodated with the 15' radius returns shown in Exhibit A. The other constraint is that the walk on the north side of the drive drops downhill sharply as it detaches (making catching back to the existing walk difficult. Exhibit B shows 20' returns and the fact that the existing manhole hits in the curb. Exhibit C shows 20' returns as well and shifts the drive south to miss the manhole, but then the sidewalk encroached onto the existing vault. The problem with relocating any utilities is that there are so many in the area, it would be very difficult and expensive to change the storm pipe (for instance) without impacting other utilities in the area. The reason the radius is set at 20' is to allow drivers to make the tarn without slowing to a stop. This is only an issue for northbound drivers on Ziegler who are going into the site. There is an existing bike lane in this location, and the actual path of a vehicle is able to go through a larger radius than the 15' that is proposed (from the driving lane into the drive). As the exhibits show, there is not a significant change in what a driver will do with the reduced radius. At other locations where a right turn lane is immediately adjacent to the curb (with no bike lane or the bike lane left of the turn lane) it could be argued that the larger return is warranted. Because the actual traffic pattern can be maintained with the geometry proposed (the through lane separated from the 15' return), it is not anticipated that this variance from the above Standard will compromise the public health, safety and welfare.
