Pursuant to our conversation, I have located a copy of the warranty we gave to Larimer County for the
improvements constructed in Larimer County. The only warranty we signed is as shown on the attached
building permit and I have copied this language directly to the plat. I have also included the owner of
Trilby Rd as a signatory to this plat with a clarification that he is not responsible for any warranty issues.
Please initial these changes signifying your approval and I will then process this amended plat through
the Planning Department and Technical Services. Once you have signed, please notify me that this is
ready for pick up at your office and I will coordinate its retrieval.

During the final stages of construction of the access improvements for Access Permit # 403119, I became
aware of a right-of-way (ROW) problem adjacent to the newly constructed southbound right deceleration
lane along US 287. Although additional ROW was dedicated for the highway lane, that strip is not
adequate for the highway signs that need to be installed in that area. It appears that with the recently
dedicated land, the new highway ROW line is approximately 2 feet west of the new curb and gutter.
Additional ROW is necessary, and I request you work with Mr. Timan to acquire that land for highway
purposes.
Please obtain enough additional ROW to provide a distance of at least 8 feet between the new back of
curb to the ROW line. That will allow the highway signs to be erected at the minimum distance off the
flowline of gutter (as shown in CDOT's Standard Plan S-614-1, attached) and provide room west of those
signs for them to be fully maintained within the highway ROW. That will also place the fence at
approximately 7 t/a feet west of the back of curb, which should be a safe distance from the road for any
livestock on the private property.
That additional ROW should be provided to CDOT by Warranty Deed. I have discussed this issue with
Bob Grube, the Region 4 ROW Manager. Please contact him in Greeley at 970.350.2152 to obtain the
proper format for preparation of that deed, then send the document to me and I will see that Bob reviews
it. Once recorded, you'll need to provide me with a copy of the document. At that time, you'll authorize
the sign and fence installations.
Our Access Inspector, Linda Williams, will not accept the access permit work until the signs and fence are
in place in that new ROW. Use of the access is not authorized until the access improvement is totally
completed and accepted.
I hope you will be successful in negotiating this with Mr. Timan. I conferred with both the County and
City staffs about this issue, and they support the request for additional ROW dedication, rather than an
easement. We recognize that in the future, the Timan property will develop and share this access. At
such time as the Tinian property is developed, a ROW requirement will be made by the local agency. I
believe the local agency will require dedication, with no reimbursement.
I'm sorry that this issue was not recognized during the plan preparation and review period. Please let me
know how you progress with this request.

REF: Plan Revision - Elimination of a traffic control sign
In looking at traffic control signs planned along the new southbound right turn lane of US 287 we have
decided to eliminate the signal ahead sign. That existing CDOT sign was shown to be relocated to Sta.
8+50, 56' It. (see attachment). Please direct the contractor to contact the CDOT Signing/Striping
Manager, Rich Cutler, to arrange for return of that sign to CDOT. Rich can be reached in Greeley at
(970) 350-2285.
Please make certain this change is incorporated into the access permit package and your files.
