Box 142 Pueblo, Co. 81023 Re: Tellez Estates `.subdivision, LeMay Avenue road improvements Dear Mr. and Mrs Nelson This letter is to inform you the proposed Lindenmeier Estates development just north of the Tellez Estates Subdivision is being required to design and construct the LeMay Avenue improvements along, their property frontage as a condition of approval. The City is currently reviewing the utility plans for this project and it is anticipated that they will get approval and the development agreement will be signed by the end of the year. As your are aware the Tellez Estates Development Agreement Amendment Number 1, dated March 19, 1996 stakes " The Developer and the City agree that the Developer is obligated for the construction of the arterial standard street improvements for LeMay Avenue along the frontage of the property, as shown on the approved utility plans on file with the City Engineering Department. The requirement for the construction of said improvements has been delayed until the issuance of a second building permit on the property or until such time as the City determines that said improvements are needed, whichever occurs first." Therefore, It is the City's position that the improvements adjacent to the Tellez Estates Subdivision are to be constructed in conjunction with the Lindenmeier Estate improvements.
